an Oregon=minicipal corporation, held at the office of the corpora-
tion on the 3rd day of October , 1990 , pursuant to legal call
therefor according to law. There was present a quorum of the duly
elected and qualified directors of said corporation; whereupon the
following resolution, upon motion duly made and seconded was unani-
mously adopted:
1. Resolved, that the corporation enter into a Municipal Lease
Purchase Agreement plus all schedules, exhibits and attachments thereto,
with United States National Bank of Oregon, as Lessor (hereafter
called Lessor) and this corporation as Lessee covering the lease of
Computer Processor and Memory , said agreement being
dated September 26 , 1990 , calling for rental amounts not exceed-
ing in the aggregate $ 50,000.00 plus interest at the rate of
8.00 % per annum, such agreement transacted under the provisions of
ORS , and such agreement containing a provision indemnify-
ing the Lessor against loss and expense incurred as a result of interest
income from the Lease becoming taxable, or incurred as a result of the
exclusion of any portion of interest paid by Lessor which is currently
deductible.
2. Resolved, that any two of the following persons
Lois Prante, Dick Maudlin or Tom Throop
are authorized and empowered in the name of this corporation to execute
and deliver to the Lessor the above described Municipal Lease Purchase
Agreement together with all exhibits, schedules and attachments.
3. Resolved, that this resolution shall constitute a continuing
authority to the designated person or persons to act on behalf of this
corporation, and the powers and authority granted herein shall continue
until revoked by this corporation, and formal written notice of such
revocation shall have been given to the Lessor.
4. Resolved, that the Municipality covenants as follows regarding
any federal tax legislation which may apply to this Lease:
The Lease is not a private activity lease; ;a(

The Municipality does not reasonably expect to issue
' "tax exempt obligations exceeding $10 million during
the calendar year;
The Municipality designates the Lease as a qualified
tax - exempt obligation for purposes of the deduction
— for interest expense by financial institutions.
5. Resolved, that the Secretary of this corporation be and he is
hereby authorized and directed to deliver to Lessor a copy of this
resolution, properly certified by him.
This certifies, that the undersigned is the Secretary of the above
named municipal corporation; that the foregoing is a full, true and
correct copy of this resolution unanimously passed by the Board of
Directors thereof at a meeting of said Board held on the day and the
place above specified, legally called and held, at which a quorum was
present and voting.

An Order Certifying The Assessments
For Road Improvements on Certain
Real Property in Leona Lane L.I.D.,
and Requiring Notices.
ORDER NO. 90 -138
WHEREAS, the Board of County Commissioners of Deschutes County,
Oregon, has held a hearing in accordance with law fixing the
assessments of improvements benefiting certain real property in Leona
Lane L.I.D. in Deschutes County, Oregon; and
WHEREAS, there were ,y0 remonstrances to the proposed
assessments relating to said property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. The assessments for road improvements in Leona Lane
L.I.D. are hereby certified in accordance with Exhibit "A ", attached
hereto and by this reference incorporated herein. The assessment so
certified is listed as "final cost" in Exhibit "A ".
Section 2. That the rate of interest to be charged on unpaid
assessments for which financing requests are filed with the Board of
County Commissioners, and for assessments for which financing
requests are not filed and remain unpaid more than thirty (30) days
from the date of assessment, shall be ten percent (10 %) per annum.
Section 3. That the Director of Public Works shall mail on or
before October 9, 1990, notices of the assessments as fixed by this
Order to owners of the said property with an application to finance
the improvements in not more than 20 semi - annual installments. The
notice of assessment shall substantially comply with Exhibit "B ",
attached hereto and by this reference incorporated herein. The
application to finance improvements shall substantially comply with
Exhibit "C ", attached hereto and by this reference incorporated
herein.
Section 4. That the Order, excepting Sections 2, 3, 4 and 5, be
published in a newspaper of general circulation within Deschutes
County on October 9 and October 16, 1990, with the following heading:

The Board of County Commissioners of Deschutes County,
Oregon, at its regular meeting on October 3, 1990,
adopted Order No. 90 -138, assessing the following
described property for road improvements. Upon failure
of owners to make application to pay the assessments in
installments by November 9, 1990, or upon failure of the
owner to pay the assessment in full by November 9, 1990,
interest will commence and run at the rate of ten
percent (10 %) per year, and the property assessed will
be subject to foreclosure.
Section 5. The County Clerk shall, upon the filing of this Order,
record and index it upon the lien docket of Deschutes County known as
Assessment District

BACKGROUND:
On July 19, 1989, the Board of County Commissioners held a
public hearing on the improvement of Leona Lane within the
above referenced Local Improvement District. At that hearing
there were four objections to the project out of the twenty six
property owners.
The project was approved at that hearing and by Order Number
89 -055 dated August 2, 1989. The improvement was directed to
be made by Force Account. The road was constructed in
conjunction with the Meadow Lane and Dyke Road Local
Improvement District.
DISCUSSION:
The Public Works Department had prepared an initial cost
estimate prior to the hearing. The estimate was $50,000.00 for
the total cost of the project with an individual cost being
$1,923.08 per lot. The final costs have been tabulated and the
total cost is $49,596.04 for a per lot cost of $1,907.54.
RECOMMENDATION:
The Public Works Department recommends that the cost of
$49,596.04 be assessed against the 26 lots which front on the
improved road at the rate of $1,907.54 per lot as shown in
Exhibit "A ".

LEONA LANE LOCAL IMPROVEMENT DISTRICT
(BANCROFT BONDING ACT, ORS 223.205 TO 223.300)
TO THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
Pursuant to the provisions of the Act of the Legislature of the State of
Oregon, known as the "Bancroft Bonding Act ", (ORS 223.205 to 223.300, as
amended), applicant makes application to finance the portion of the cost of
the road improvement levied against applicant's property and being part of
the improvement of roads in unincorporated Deschutes County, Oregon, as the
same has been determined and assessed by the Board of County Commissioners
of Deschutes County, Oregon, and Order No. 90 -138, and docketed upon the
Docket of Assessment District Liens of Deschutes County, Oregon.
The applicant and property owner of the property described below does
hereby waive all irregularities or defects, jurisdictional or otherwise,
in the proceedings to cause said improvement to be constructed or made for
which the assessment is levied, and in the apportionment and assessment of
the cost thereof, and acknowledges that applicant is indebted and the
property legally charged with the assessment.
Applicant agrees to pay the assessment in twenty (20) or fewer semi - annual
installments, together with interest at ten percent (10 %) per annum on all
unpaid assessments. The interest shall be paid semiannually in addition to
and at the time each principal payment is made.
The installments shall be due and payable on the 1st day of April, 1991,
the first day of October, 1991, and thereafter on the 1st day of April and
the 1st day of October in subsequent years.
