WHEREAS, the Board of County Commissioners of Deschutes County,
Oregon, has held a hearing in accordance with law fixing the
assessments of improvements benefiting certain real property in
Meadow Lane and Dyke Road L.I.D. in Deschutes County, Oregon; and
WHEREAS, there were IVO remonstrances to the proposed
assessments relating to said property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. The assessments for road improvements in Meadow
Lane and Dyke Road L.I.D. are hereby certified in accordance with
Exhibit "A", attached hereto and by this reference incorporated
herein. The assessment so certified is listed as "final cost" in
Exhibit "A".
Section 2. That the rate of interest to be charged on unpaid
assessments for which financing requests are filed with the Board of
County Commissioners, and for assessments for which financing
requests are not filed and remain unpaid more than thirty (30) days
from the date of assessment, shall be ten percent (10%) per annum.
Section 3. That the Director of Public Works shall mail on or
before October 9, 1990, notices of the assessments as fixed by this
Order to owners of the said property with an application to finance
the improvements in not more than 20 semi-annual installments. The
notice of assessment shall substantially comply with Exhibit "B",
attached hereto and by this reference incorporated herein. The
application to finance improvements shall substantially comply with
Exhibit "C", attached hereto and by this reference incorporated
herein.
Section 4. That the Order, excepting Sections 2, 3, 4 and 5, be
published in a newspaper of general circulation within Deschutes
County on October 9 and October 16, 1990, with the following heading:

The Board of County Commissioners of Deschutes County,
Oregon, at its regular meeting on October 3, 1990,
adopted Order No. 90-137, assessing the following
described property for road improvements. Upon failure
of owners to make application to pay the assessments in
installments by November 9, 1990, or upon failure of the
owner to pay the assessment in full by November 9, 1990,
interest will commence and run at the rate of ten
percent (10%) per year, and the property assessed will
be subject to foreclosure.
Section 5. The County Clerk shall, upon the filing of this order,
record and index it upon the lien docket of Deschutes County known as
Assessment District Liens.

SUBJECT: Meadow Lane and Dyke Road L.I.D. - Final Engineers Report
BACKGROUND:
On April 5, 1989, the Board of Commissioners held a public
hearing on the improvement of Meadow Lane and Dyke Road within
the above referenced Local Improvement District. At that
hearing there were only 10 remonstrances filed regarding said
road improvements.
Subsequently on April 26, 1989 the Board of Commissioners
signed an order relating to the Improvement of Meadow Lane and
Dyke Road and directed the improvement to be made by Force
Account.
The roads were constructed by County•Forces during he Summer of
1989 in conjunction with Leona Lane which is in the immediate
area.
DISCUSSION:
The Public Works Department had prepared a cost estimate prior
to the hearing. The people affected by the improvement were
notified of the total cost and their individual cost per lot.
This estimate was $80,000 for the project with an individual
cost being $2,051.28 per lot. The final costs have been
tabulated and the total cost is $77,503.67 for a per lot cost
of $1,987.27.
RECOMMENDATION:
The Public Works Departrrent recommends that the cost of
$77,503.67 be assessed against the 39 lots which front on the
improved roads at a rate of $1,987.27 per lot as shown in
Exhibit "A".

MEADOW LANE AND DYKE ROAD LOCAL IMPROVEMENT DISTRICT
(BANCROFT BONDING ACT, ORS 223.205 TO 223.300)
TO THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
Pursuant to the provisions of the Act of the Legislature of the State of
Oregon, known as the "Bancroft Bonding Act", (ORS 223.205 to 223.300, as
amended), applicant makes application to finance the portion of the cost of
the road improvement levied against applicant's property and being part of
the improvement of roads in unincorporated Deschutes County, Oregon, as the
same has been determined and assessed by the Board of County Commissioners
of Deschutes County, Oregon, and Order No. 90-137, and docketed upon the
Docket of Assessment District Liens of Deschutes County, Oregon.
The applicant and property owner of the property described below does
hereby waive all irregularities or defects, jurisdictional or otherwise,
in the proceedings to cause said improvement to be constructed or made for
which the assessment is levied, and in the apportionment and assessment of
the cost thereof, and acknowledges that applicant is indebted and the
property legally charged with the assessment.
Applicant agrees to pay the assessment in twenty (20) or fewer semi-annual
installments, together with interest at ten percent (10%) per annum on all
unpaid assessments. The interest shall be paid semiannually in addition to
and at the time each principal payment is made.
The installments shall be due and payable on the 1st day of April, 1991,
the first day of October, 1991, and thereafter on the lst day of April and
the 1st day of October in subsequent years.
