j 90-37494 105 15811 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES OUNTyY, 6ON.R An Order Certifying The Assessments * 225 0425 For Road Improvements on Certain Real Property in Cinder Butte Estates West, First Addition L.I.D., and Requiring Notices. * •'A �kOFiLMEm 90-37619 JAN 9 ORDER NO. 90-172 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon, has held a hearing in accordance with law fixing the assessments of improvements benefiting certain real property in Cinder Butte Estates West, First Addition L.I.D. in Deschutes County, Oregon; and WHEREAS, there were 0 remonstrances to the proposed assessments relating to said property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. The assessments for road improvements in Cinder Butte Estates West, First Addition L.I.D. are hereby certified in accordance with Exhibit "A", attached hereto and by this reference incorporated herein. The assessment so certified is listed as "actual cost" in Exhibit "A". Section 2. That the rate of interest to be charged on unpaid assessments for which financing requests are filed with the Board of County Commissioners, and for assessments for which financing requests are not filed and remain unpaid more than thirty (30) days from the date of assessment, shall be ten percent (10%) per annum. Section 3. That the Director of Public Works shall mail on or before December 19, 1990, notices of the assessments as fixed by this Order to owners of the said property with an application to finance the improvements in not more than six (6) semi-annual installments. The notice of assessment shall substantially comply with Exhibit "B", attached hereto and by this reference incorporated herein. The application to finance improvements shall substantially comply with Exhibit "C", attached hereto and by this reference incorporated herein. Section 4. That the Order, excepting Sections 2, 3, 4 and 5, be published in a newspaper of general circulation within Deschutes County on December 19 and December 26, 1990, with the following heading: 1 - ORDER NO. 90-172 1.05 PUBLIC NOTICE NOTICE OF ASSESSMENT 1581' 225 - OdG The Board of County Commissioners of Deschutes County, Oregon, at its regular meeting on December 12, 1990, adopted Order No. 90-172, assessing the following described property for road improvements. Upon failure of owners to make application to pay the assessments in installments by January 19, 1991, or upon failure of the owner to pay the assessment in full by January 19, 1991, interest will commence and run at the rate of ten percent (10%) per year, and the property assessed will be subject to foreclosure. Section 5. The County Clerk shall, upon the filing of this Order, record and index it upon the lien docket of Deschutes County known as Assessment District Liens. DATED this ,ate day of 1990. Upon failure of the owner of the property assessed to make application to pay the assessment in installments by January 19, 1991, interest will commence to run on the assessment at a rate of ten percent (10%) per year, and the property assessed will be subject to foreclosure if the total amount of the assessment remains unpaid. If you wish to pay in installments, you must fill out the enclosed application listing your name and address. The applicant and property owner of the property described below does hereby waive all irregularities or defects, jurisdictional or otherwise, in the proceedings to cause said improvement to be constructed or made for which the assessment is levied, and in the apportionment and assessment of the cost thereof, and acknowledges that applicant is indebted and the property legally charged with the assessment. Applicant agrees to pay the assessment in six (6) or fewer semi-annual installments, together with interest at ten percent (10%) per annum on all unpaid assessments. The interest shall be paid semiannually in addition to and at the time each principal payment is made. The installments shall be due and payable on the 1st day of April, 1991, the first day of October, 1991, and thereafter on the 1st day of April and the 1st day of October in subsequent years.
