1991-03395-Order No. 91-011 Recorded 2/8/1991BEFORE THE BOARD OF COUNTY COMMISSIONERS OF-D,ggWTES COUNTY, OREGON An Order Directing Transfer of .. �• Real Property to the City of * Redmond for Public Purposes. * . f s i rL j} RI ERK 3sv � ORDER NO. 91-011 WHEREAS, ORS 271.330 provides that Deschutes County may transfer real property not needed by the County to another governmental body after a hearing; and WHEREAS, a hearing was held on February 6, 1991; and WHEREAS, the Board of County Commissioners find that Deschutes County no longer needs certain real property for public purposes; and WHEREAS, the Board of County Commissioners find that the City of Redmond is a governmental body of the State of Oregon and will use certain real property for a public purpose; and WHEREAS, no objections to the transfer of said real property were expressed at said hearing; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That Deschutes County's interest in the real property described as: Portion of SW 1/4 of NW 1/4 of Section 16, Township 15 South, Range 13 E.W.M., Tax Lot 101, lying in the canyon. Description of a portion of a parcel of land described in Deschutes County Deed Records in Vol. 248, Page 759, said portion lying easterly of a canyon rim bisecting said parcel, located in a portion of the SW 1/4 of the NW 1/4 of Section 16 of Township 15 South, Range 13 E.W.M., City of Redmond, Deschutes County, Oregon, more particularly described as follows: Commencing at the Northwest corner of the SW 1/4 of the NW 1/4 (SW 1/4 NW 1/4) of Section 16, Township 15 South, Range 13 E.W.M.; thence N 89° 34' 30" E along the north line of said SW 1/4 NW 1/4 - 432.80 feet; thence S 000 01' W - 330.01 feet to the south line of the north 330.00 feet of said SW 1/4 NW 1/4 and to the north line of a parcel of land described in Deschutes County Deeds Vol. 248, Page 759, and the true Point of Beginning; thence S 890 34' 30" W along said south and K UNCHED 1 - ORDER NO. 91-011 111990 106 0159 north lines - 200.00 feet to the base of a canyon rim; thence S 370 36' 35" W - 381.60 feet to the intersec- tion of the base of said canyon rim with the west line of said SW 1/4 NW 1/4; thence S 000 01' W along said west line - 30.00 feet to the south line of said parcel recorded in Vol. 248, Page 759; thence easterly along said south line - approximately 432.80 feet to the east line of said parcel; thence N 00° 01' E along the east line of said parcel - 327.99 feet to the Point of Beginning; EXCEPTING THEREFROM that portion conveyed to Deschutes County for road purposes, recorded May 2, 1969, in Book 164, Page 365, Deschutes County Deed Records. Same containing approximately 2.47 gross land acres, subject to all existing easements and right-of- way over and across the above-described parcel of land. AND: Portion of SW 1/4 of NW 1/4 of Section 16, Township 15 South, Range 13 E.W.M., Tax Lot 101, lying above the canyon. Description of a portion of a parcel of land described in Deschutes County Deed Records in Vol. 248, Page 759, said portion lying westerly of a canyon rim bisecting said parcel, located in a portion of the SW 1/4 of the NW 1/4 of Section 16 of Township 15 South, Range 13 E.W.M., City of Redmond, Deschutes County, Oregon, more particularly described as follows: Commencing at the Northwest corner of the SW 1/4 of the NW 1/4 (SW 1/4 NW 1/4) of Section 16, Township 15 South, Range 13 E.W.M.; thence N 89° 34' 30" E along the north line of said SW 1/4 NW 1/4 - 432.80 feet; thence S 00° 01, W - 330.01 feet to the south line of the north 330.00 feet of said SW 1/4 NW 1/4 and to the north line of a parcel of land described in Deschutes County Deed Records Vol. 248, Page 759; thence S 89° 34' 30" W along said south and north lines - 200.00 feet to the base of a canyon rim and the true Point of Beginning; thence S 370 36, 35" W - 381.60 feet to the intersection of the base of said canyon rim with the west line of said SW 1/4 NW 1/4, said point being N 00° 01' E - 30.00 feet from the southwest corner of said parcel recorded in Vol. 248, Page 759; thence N 000 01' E along said west line - 300.57 feet to said south and north lines; thence N 890 34, 30" E along said south and north lines - 232.80 feet to the Point of Beginn- ing; EXCEPTING THEREFROM that portion conveyed to Deschutes County for road purposes, recorded May 2, 1969, in Book 164, Page 365, Deschutes County Deed Records. Same containing approximately 0.80 gross land 2 - ORDER NO. 91-011 106 -� 0160 acres, subject to all existing easements and right-of- way over and across the above-described parcel of land. be transferred to the City of Redmond, the true consideration of which shall be the continued use of a portion of said property for public park purposes, pursuant to ORS 271.330. Section 2. That a bargain and sale deed be executed and delivered transferring said property to the City of Redmond, subject to a reversionary interest of Deschutes County on the portion of the property contiguous to Bowlby Field and below the rimrock should said property cease to be used for public park purposes.
