WHEREAS, Deschutes County has acquired title to certain'-,,
property pursuant to tax foreclosure proceedings on file in the
Circuit Court of the State of Oregon for Deschutes County; and
WHEREAS, the Deschutes County Board of Commissioners did
adopt Order No. 90-168 on December 19, 1990, ordering the
Deschutes County Sheriff to offer property as is described in
Exhibit "A," attached hereto and by this reference incorporated
herein; and
WHEREAS, the Deschutes County Sheriff did offer for sale
that property described in Exhibit "A" on January 25, 1991, in
the hearings room in the Juvenile Justice Building, 1128 N.W.
Harriman, Bend, Oregon, and did accept written bids submitted
through February 15, 1991, pursuant to Order No. 90-168; and
WHEREAS, the Deschutes County Sheriff has received bids
equal to, or in excess of the minimum bids set forth in Order No.
90-168, and the highest bid for each property being herein set
forth in the Sheriff's Return, attached hereto as Exhibit "B,"
and subsequent Amended Sheriff's Returns, attached hereto as
Exhibits "C" and "D," and by this reference incorporated herein;
and
WHEREAS, it appears that the bids set forth in Exhibits "B,"
"C" and "D" are the highest and best bid received at sale, said
bids being equal to or exceeding the minimum bid set forth in
Order No. 90-168, and it is in the best interest of the County tc
accept said bids; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the bids set forth in Exhibits "B," "C" and
"D" are hereby approved and confirmed, subject to the right of
any municipal corporation to purchase property which it has
claims or liens upon, as set forth in ORS 275.170.
Section 2. The Deschutes County Office of Legal Counsel is
directed to prepare a Bargain and Sale Deed for each parcel
listed on Exhibits "B," "C" and "D" to be signed by the Board of
County Commissioners, unless purchased by a municipal corporation
pursuant to ORS 275.170, and thereafter exchanged for the/cer-
tificate of sale given to the purchaser at the time of

Section 3. That the Deschutes County Treasurer is directed
to pay any and all Local Improvement District liens on the
properties listed in Exhibits "B," "C" and "D" from the proceeds
listed in Exhibits "B," "C" and "D."
Section 4. That the Sheriff's sale authorized by Order
No. 90-168 is hereby confirmed and closed.

This auction shall be continuous from and after the above
sale date until closed by the Board of County Commissioners.
Written offers to purchase any parcel not sold on January 25,
1991, shall be received by me in my offices each following Friday
at 1:30 p.m. until the sale is closed. All written offers
received each Friday shall be opened at 2:00 p.m. that day. The
highest offer for any parcel which is equal to or exceeds the
minimum bid price shall be accepted. In the event two or more
offers are equal to or exceed the minimum bid price, the offer
received first shall be accepted. Upon acceptance of such offer,

the sale as to that parcel shall be deemed closed. Written
offers shall be accompanied by a cashier's check payable to
Deschutes County.
Offers may be made through a licensed real estate agent.
The County shall pay a five percent (5%) real estate commission
to any licensed real estate agent presenting an offer which
results in the sale of a property.
All parcels are sold as is. Potential bidders should
thoroughly investigate all aspects of a property prior to bid-
ding. Deschutes County does not guarantee that any parcel is
buildable, suitable for septic system, has legal access, is
vacant or is usable for any particular purpose. The zones
indicated above are the zones as of November 15, 1990. The
County shall not warrant or defend the fee simple title of real
property offered for sale to be free of defects or encumbrances,
but will only sell and convey such title as the County has
acquired by foreclosure or other means.
Conveyance is subject to recorded easements to the United
States or any government agency thereof and the right of any
municipal corporation to purchase such property as provided by
law. The Deschutes County Board of County Commissioners reserves
the right to reject any and all bids. Example copies of County

office of Deschutes County Legal Counsel, Administration
Building, 1130 N. W. Harriman, Bend, Oregon 97701.

the Deschutes County Coucil, according to law. Copy of the notice of sale

oral auction on January 25, 1991 and three were sold by written bids on February
1, 1991.
On February 8, 1991, at 2:00 PM, in compliance with the terms of the
sale, I opened written bids received by my office before 1:30 PM that date.
Only one bid had been received. It was for Parcel #33 for the sum of $9,753.00
from Carrielynn Tennant.
I hereby return the futher of $1,951 received as down payment on lot r
33 to the Deschutes County Treasurer.
