WHEREAS, on the 3rd day of April, 1991, The Board of County
Commissioners held a hearing in the Deschutes County Juvenile
Justice Building, Bend, Oregon, on the issue of whether or not a
certain Black Labrador dog and a certain Newfoundland cross dog
kept by Judith Briles engaged in the killing, wounding, injuring
or chasing of livestock; and
WHEREAS, any dog not under the control of its owner or keeper
found chasing livestock not on the property of such owner or keeper
shall be prima facie deemed to be engaged in killing, wounding,
injuring, or chasing of livestock; and
WHEREAS, Ralph McNulty, Tori Chilen, and Judith Briles offered
testimony before the Board of County Commissioners and the Board
having considered the evidence and testimony, and being fully
informed in the premises; and
WHEREAS, the Board finding that a certain Black Labrador dog
and a certain Newfoundland cross dog kept by Judith Briles while
on the premises of Ralph McNulty and not under the control of its
owner or keeper on or about March 23, 1991, engaged in the chasing
of livestock; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That the certain dogs described as a Black
Labrador dog and a Newfoundland cross dog owned by Judith Briles
in the possession of the Deschutes County Humane Society Shelter
be killed in a humane manner.
