P ORDER NO. 91-070-106 1141 WHEREAS, Deschutes County acquired title to certain property pursuant to tax foreclosure proceedings on file in the Circuit Court of the State of Oregon for Deschutes County; and WHEREAS, the Deschutes County Board of Commissioners did adopt Order No. 89-008 on February 15, 1989, ordering the Deschutes County Sheriff to offer for sale that property described in Exhibit "A," attached hereto and by this reference incorporated herein; and WHEREAS, the Deschutes County Sheriff did offer for sale that property described in Exhibit "A" on March 15, 1989, at the West door of the Deschutes County Courthouse, Bend, Oregon, and did accept written bids submitted through August 8, 1989, pursuant to Order No. 89-008; and WHEREAS, the Deschutes County Sheriff received bids equal to, or in excess of the minimum bids set forth in Order No. 89-008, and the highest bid for each property being herein set forth in the Sheriff's Return, attached hereto as Exhibit "B," and supplemental Sheriff's Returns, attached hereto as Exhibits "C" and "D," and by this reference incorporated herein; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: That the Sheriff Sale authorized by Order No. 89-008 is hereby closed nunc pro tune, as of August 9, 1989. Written offers to purchase any, parcel not sold on March 15, 1989, shall be received by me in my offices each following Tuesday at 1:30 p.m. until the sale is closed. All written offers received each Tuesday shall be opened at 2:00 p.m. that day. The highest offer for any parcel which is equal to or exceeds the minimum bid price shall be accepted. In the event two or more offers are equal to or exceed the minimum bid price, the offer received first shall be accepted. Upon acceptance of such offer, the sale as to that parcel shall be deemed closed. Offers may be made through a licensed real estate agent. The County shall pay a five percent (5%) real estate commission to any licensed real estate agent presenting an offer which results in the sale of a property. Forms to be used for written offers are available in the Sheriff's Office, Justice Building, 1100 N. W. Bond, Bend, Oregon. All parcels are sold as is. Deschutes County does not guarantee that any parcel is buildable, suitable for septic system or usable for any particular purpose. The zones indicated above are the zones as of the date of appraisal. The County shall not warrant or defend the fee simple title of real property offered for sale to be free of defects or encumbrances, but will only sell and convey such title as the County has acquired by fore- closure or other means.
