UG".42 WHEREAS, by Order No. 90-131, the Board of County Commissioners authorized the creation of the CDD Revenue Fund, into which excess revenue collected by the Community Development Department (CDD) is to be deposited by the County Treasurer and set aside for future expenses incurred by CDD; and WHEREAS, pursuant to Order No. 90-131, the County Treasurer has created the CDD Revenue Fund and, upon signature of this order, is prepared to deposit into the fund excess revenue collected by CDD during the fiscal year 1990-91; and WHEREAS, the Board of County Commissioners has determined that the provisions of Order No. 90-131 do not clearly set forth the method for calculating excess revenue or the procedure for future deposits into the CDD Revenue Fund and that clarification is necessary; now, therefore THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. For purposes of the CDD Revenue Fund, the term "excess revenue" means the difference between the actual fees collected by CDD and CDD's actual expenditures plus 10% of CDD's actual fees collected. Section 2. At the close of each fiscal year, the County Treasurer shall determine if CDD has collected excess revenue during that fiscal year. All such excess revenue shall be deposited into the CDD Revenue Fund. Section 3. In each fiscal year, so long as the CDD Revenue Fund is maintained in the County budget, the fund shall be annually budgeted based upon the balance in the fund and departmental revenue projection. Transfers from the CDD Revenue Fund to the General Fund shall be based upon projected CDD expenses for the next fiscal year. III -,Z -- 1 - ORDER NO. 91-105 (8/7/91) 010'7 0623 Section 4. In the event of shortfalls in the projected CDD revenue arising during a fiscal year, but not anticipated in the departmental revenue projection, the Board may transfer to the General Fund from the CDD Revenue Fund the amount necessary to balance the revenue and expenditures of CDD during the fiscal year.
