ORDER NO. 91-126 WHEREAS, Deschutes County has acquired title to�2 r in 11 property pursuant to tax foreclosure proceedings on files' -I n rthe Circuit Court of the State of Oregon for Deschutes County, panq� WHEREAS, the Deschutes County Board of Commissioners dice"adopt Order No. 91-102 on August 14, 1990, ordering the Deschutes County Sheriff to offer property as is described in Exhibit "A," attached hereto and by this reference incorporated herein; and WHEREAS, the Deschutes County Sheriff did offer for sale that property described in Exhibit "A" on September 20, 1991, in the hearings room in the Juvenile Justice Building, 1128 N.W. Harriman, Bend, Oregon, and did accept written bids submitted through September 27, 1991, pursuant to Order No. 90-102; and WHEREAS, the Deschutes County Sheriff has received bids equal to, or in excess of the minimum bids set forth in Order No. 90-102, and the highest bid for each property being herein set forth in the Sheriff's Return, attached hereto as Exhibit "B," and subsequent Amended Sheriff's Return, attached hereto as Exhibit "C", and by this reference incorporated herein; and WHEREAS, it appears that the bids set forth in Exhibits "B" "C" are the highest and best bid received at sale, said bids being equal to or exceeding the minimum bid set forth in Order No. 90- 102, and it is in the best interest of the County to accept said bids; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the bids set forth in Exhibits "B" and "C" are hereby approved and confirmed, subject to the right of any municipal corporation to purchase property which it has claims or liens upon, as set forth in ORS 275.170. Section 2. The Deschutes County Office of Legal Counsel is directed to prepare a Bargain and Sale Deed for each parcel listed on Exhibits "B," and "C" to be signed by the Board of County Commissioners, unless purchased by a municipal corporation pursuant to ORS 275.170. Section 3. That the Deschutes County Treasurer is directed to pay any and all Local Improvement District liens on the properties KEYp.. EXHIBIT "A" 0107 1813 This auction shall be continuous from and after the above sale date until closed by the Board of County Commissioners. Written offers to purchase any parcel not sold on September 20, 1991, shall be received by me in my offices through the following Friday at 1:30 p.m. and shall be opened at 2:00 p.m. that day. The highest offer for any parcel which is equal to or exceeds the minimum bid price shall be accepted. In the event two or more offers are equal to or exceed the minimum bid price, the offer received first shall be accepted. Upon acceptance of such offer, the sale as to that parcel shall be deemed closed. Written offers shall be accompanied by a cashier's check payable to Deschutes County. Offers may be made through a licensed real estate agent. The County shall pay a five percent (5%) real estate commission to licensed real estate agents who appear at the sale on behalf of a client whose bid is accepted by the Board of County Commissioners. Commissions shall not be paid to realtors representing themselves or any entity in which they have a financial interest. Realtors who wish to appear at the auction on behalf of a client and therein be eligible for a real estate commission shall register at the time of the sale and provide a photocopy of their current real estate license to County personnel at the auction. Commissions will not be paid unless the realtor registers and provides the required documentation at the time of sale. All parcels are sold as is. Potential bidders should thoroughly investigate all aspects of a property prior to bidding. Deschutes County does not guarantee or warrant that any parcel is buildable, suitable for septic system, has legal access, is vacant or is usable for any particular purpose. The zones indicated are the zones as of July 25, 1991. Also indicated is the septic status (where known) as determined from the records of the Deschutes County Community Development Department on July 25, 1991. The County shall not warrant or defend the fee simple title of real property offered for sale to be free of defects or encumbrances, but will only sell and convey such title as the County has acquired by foreclosure or other means. Conveyance is subject to recorded easements to the United States or any government agency thereof and the right of any municipal corporation to purchase such property as provided by the right to reject any and all bids.
