LICENSING AGREEMENT FOR VIDEO RENTAL IN JAIL Before the Board was chair signature on a Public Performance License agreement with Films Incorporated to allow public performances of videotapes of any licensed films in the Deschutes County Jail for an inmate population of 50. Rick Isham said the County would be violating the copyright protection act if they showed videos to inmates (which was considered a "public performance") without this license. The license was $125 for one year. THROOP: I'll move chair signature. MAUDLIN: I'll second the motion. VOTE: THROOP: YES SCHLANGEN: Excused MAUDLIN: YES 2. FEE ADJUSTMENT FOR RECYCLE BOX HAULING Before the Board was a request from the Director of Public Works that the Board approve a fee adjustment for hauling recycle boxes. They had previously estimated that $90 would cover the costs, however Bruce Bailey said they were losing money at this rate and requested a reevaluation. Larry Rice said he had met with Bend Garbage, the representative of Deschutes Transfer Company, and they agreed to the following rates based upon actual mileage and loading and unloading time. They split up the costs based upon the mileage ($1.10/mile) and added a fix costs of $55 for the hour involved with the loading and unloading. They averaged the mileage into three categories and added the fixed costs as follows: (1) Sunriver, the shortest haul, would be $101; (2) Eagle Crest, Southwest, Northwest, Negus, and Sisters, with an average round trip mileage of 51, would be $111; and (3) LaPine and Black Butte, with an average mileage of 80, would have a rate of $136. THROOP: I'd move the fee adjustment for the recycle box hauling effective November 1, 1991. RESOLUTION 91-079 AND ORDER 91-100 CONCERNING VACATION OF OMAHA ROAD Before the Board was signature of Resolution 91-079 accepting petition to vacate a portion of Omaha Road and Order 91-100 accepting Engineer's Report and setting a public hearing for December 4, 1991. THROOP: I'll make a motion which would adopt those two elements including the setting of the public hearing. MAUDLIN: Second the motion. VOTE: THROOP: YES SCHLANGEN: Excused MAUDLIN: YES 4. PLANNING ASSISTANCE GRANT FROM DLCD Before the Board was chair signature of a Planning Assistance Grant Agreement from the Department of Land Conservation and Development for $3,300. THROOP: I'll move signature and submittal. MAUDLIN: Second the motion. VOTE: THROOP: YES SCHLANGEN: Excused MAUDLIN: YES 5. ORDINANCE 91-043 RELATING TO ON-SITE SEWAGE DISPOSAL Before the Board was signature of Ordinance 91-043 amending Chapter 13.08 of the Deschutes County Code, relating to on-site sewage disposal. Rick Isham said this ordinance would update the references in the ordinance. He said the County was required to implement the state DEQ program. When an ordinance to implement that program was adopted, the County couldn't include language to "include all future amendments," but had to update the ordinance periodically to include the most current references. The County had been operating under the current DEQ rules, and this would just update the references. PAGE 2 MINUTES: 10/23/91 f 0168 0061 THROOP: Move first and second reading by title only. ORDER 91-131 CHANGING ROAD NAMES Before the Board was signature of Order 91-131 changing the name of Topaz Street to Zircon Drive and changing the name of Topaz Place to Topaz Court. WEEKLY WARRANT VOUCHERS Before the Board were weekly bills in the amount of $235,896.91. THROOP: I'll move approval subject to review. MAUDLIN: Second the motion. PROPOSED CHANGE IN FLOATING HOLIDAY POLICY Karen Green came before the Board to request that County employees be given a holiday on the day after Thanksgiving instead of their "floating holiday." She said that most of the people in her department wanted to take that day off, and PAGE 3 MINUTES: 10/23/91 she felt this was the best way to handle it. Larry Rice pointed out that there were a couple of county departments which had labor agreements outlining the holiday schedule which could not be changed without agreement from the unions. Commissioner Throop said he wasn't concerned whether CDD closed on that Friday, but didn't want it to affect the remainder of the County employees. Chairman Maudlin wanted to leave the holidays the way they were, and felt the department could be manned by the few people who wanted to take their floating holiday around Christmas or New Years. The Board decided to deny Ms. Green's request and leave the holiday policy alone. 9. MP -90-33 ON HELMHOLTZ ROAD FOR CATHARINE HOLMES Before the Board was signature of MP -90-33 creating two 20 -acre parcels in an EFU-20 zone on Helmholtz Road for Catharine Holmes. APPOINTMENT TO DESCHUTES BASIN RESOURCE COMMITTEE Before the Board was a request from the Deschutes Basin Resource Committee that Jim Mann be appointed to the committee to fill the remainder of Matt Holmes' term.
