DeBernardi and Ella J. DeBernardi, husband and wife; and WHEREAS, said hearing was held on January 8, 1992; and WHEREAS, ORS 275.100 requires that the Board of County Commissioners authorize the exchange of lands after hearing by order; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS and finds as follows: Section 1. That the contingent future interest in properties described below are of equal value: The contingent future interest to be transferred by Deschutes County is a right of reverter in the real property described as follows: All in Section 25, Township Seventeen (17) South, Range Twelve (12), East of the Willamette Meridian, Deschutes County, Oregon; the West Half of the Northeast Quarter (A NE4), containing 79.09 acres, more or less. The interest in land to be transferred by Gary L. DeBernardi and Ella J. DeBernardi, husband and wife, pertains to the real property described below: The Southwest Quarter of the Southwest Quarter (SW4 SW4) of Section Fourteen (14), TOWNSHIP EIGHTEEN (18) SOUTH, RANGE TWELVE (12) EAST OF THE WILLAMETTE MERIDIAN, Deschutes County, Oregon. EXCEPTING THEREFROM a tract of land lying in the Southwest Quarter of the Southwest Quarter (SW4 SW4) of Section Fourteen (14), TOWNSHIP EIGHTEEN (18) SOUTH, RANGE TWELVE (12) EAST OF THE WILLAMETTE MERIDIAN, Deschutes County, Oregon, being more particularly described as, ollows: 1- ORDER NO. 92-002 (1/8/92) ��' fJ,IC.RGFULME 0108 0963 Beginning at the Southwest corner of said Section 14; thence North 89°37107" East, 1362.99 feet along the South line of said Section 14 to the Southeast corner of the said Southwest Quarter of the Southwest Quarter (SW4 SW4); thence North 00047153" West, 1327.56 feet along the East line of the said Southwest Quarter of the Southwest Quarter (SW4 SW4) to the Northeast corner of the Southwest Quarter of the Southwest Quarter (SW4 SW4); thence South 89031'45" West, 5.59 feet along the North line of the Southwest Quarter of the Southwest Quarter (SW4 SW4) to a point on the centerline of S.E. 27th Street as now located; thence continuing along the North line of the Southwest Quarter of the Southwest Quarter (SW4 SW4), South 89031145" West, 40.00 feet; thence South 00021'22" East, 227.23 feet; thence 1655.11 feet along the arc of a 1060 foot radius curve to the right, the chord of which bears South 44022'31" West, 1492.03 feet; thence South 89006124" West, 257.21 feet to a point on the West line of said section 14; thence South 00029135" East, 38.43 feet along the West line of said Section 14 to the Southwest corner of said Section 14, being the Point of Beginning. Section 2. That the exchange of such property is in the best interests of the County. Section 3. That title to said properties be reviewed and approved by Deschutes County Legal Counsel. Section 4. That upon review and approval of title by Deschutes County Legal Counsel and upon the successful completion of the partitioning of the County land, the exchange of real property as referenced is hereby authorized.
