DESCHUTES COUNTY BOARD OF COMMISSIONERS
February 5, 1992
Chairman Maudlin opened the meeting at 10 a.m. Board members in
attendance were Dick Maudlin and Tom Throop. Also present were:
Rick Isham, County Counsel; Oscar Bratton, Assessor; Joan Rotsolk,
Deputy Assessor; and Paul Blikstad, Planner.
1. CONSENT AGENDA
Consent agenda items before the Board were: #1, approval for
Public Works to purchase a tractor and pump for a water truck;
#2, approval of the CYSC Amendments to the 1991-93
Comprehensive Plan for the Community Action Program and the
CASA Program; #3, appointments to the CYSC, Great Start
Subcommittee, Student Retention Initiative Subcommittee and
Juvenile Services Advisory Subcommittee; #4, Appointments to
the Deschutes Basin Resource Committee; #5, signature of
Conservation Easement for property on the Deschutes River
owned by George and Virginia Oldham; #6, signature of
Conservation Easement for property on the Deschutes River
owned by Lisa Lazarus; #7, signature of Order 92-011 changing
the name of Evans Road to Evans Way; #8, signature of Rental
Agreement for Redmond Sheriffs Substation; and #9, signature

2. PUBLIC HEARING: ORDINANCE 92-008 AMENDING TITLE 19` -TO ADD
MANUFACTURED HOMES
Before the Board was a public hearing on Ordinance 92-008
amending Section 19.64.030 to Title 19 establishing
manufactures home sales and service as a conditional use in
the IL, Light Industrial Zone.
Paul Blikstad said this ordinance amendment went before the
Urban Area Planning Commission on Monday, January 27, 1992,
and was approved unanimously. He said normally they would
have done notice of that meeting, however since there was a
"crisis," they only did notice for this hearing.

Chairman Maudlin opened the public hearing and asked for
testimony.
Chairman Maudlin said the applicant had lost their lease at
their current location and the site they wanted to move to was
zoned light industrial, which allowed trailers as a
conditional use but did not speak to manufactured homes.
Brian MacRitchie, 1070 NW Bond, Bend, testified on behalf of
his client, Skycrest Enterprises which was the applicant. He
said his client was a subtenant at their present spot on north
Highway 97 across from Bend River Mall. Their sublease
expired on January 31, 1992. They were in the process of
renegotiating that lease through the middle of December,
however the landlord decided not to renew the lease, so they
had to find a place to move in a hurry. He had taken the
interim time to find a spot. They found two lots across from
Mountain View Mall with two owners who were willing to sign
parallel five years leases with a five year renewal option and
a right of first refusal in the event the property went up for
sale. The west side of Highway 97 was zoned CH -Commercial
Highway, however on the east side it was IL zone. In the CH
zone, manufactured housing sales was an outright permitted
use, however in the IL zone it mentioned trailers as a
conditional use but did not mention manufactured housing. He
felt it was just an oversight in the drafting that
manufactured housing was not listed as a conditional use in
the IL zone. The landlord had filed with the court, so they
needed to move as rapidly as possible. He said the lots were
between Bend Honda and Marine and Central Oregon Sandblasting.
His client had been in business at its present site for three
years and employed eleven people. They also subcontracted
with 60 different businesses and were a critical sales lot for
Fuqua Homes.
Commissioner Throop asked County Counsel if he had an opinion
on what the original language in the IL zone meant when it
referred to trailers. Rick Isham said that initially the IL
zone was intended to be a little different than the Commercial
Highway zone, but over the years that distinction had blurred.
Therefore IL zones along the highway had tended to be more in
the nature of retail/commercial type uses rather than true
industrial type uses. He said the costs of properties zoned
IL and CH along Highway 97 were fairly equal.
Commissioner Throop asked Mr. MacRitchie what the access would
be to this property. Mr. MacRitchie said they would have
access off a frontage road. He requested that the Board
approve the amendment as quickly as possible so they could
keep their business going.

TAX REFUND ORDER 92-012
Before the Board was signature of a tax refund Order 92-012 in
the amount of $2,360.99. These were refunds resulting from a
loss of value do to the Awbrey Hall fire. Joan Rotsolk said
not all properties with losses in the first, received refunds
because some of them had rebuilt prior to the January 1991
review, and therefore were not eligible.
When asked about the unusual amount of tax refunds this year
due to "errors," she said they had purchased new computer
hardware and so all of their computer programs had to be
rewritten. Linda from Data Processing had felt she would be
able to rewrite them all before they were needed, however they
were unable to meet that goal. Therefore, some of. the
programs were run without having time to check the results,
and some of the programs were not rewritten in time and the
calculations had to be done by hand. This resulted in greater
errors being made this year. She said most of the problems
were due to trending errors resulting from problems with the
computer. However she said there were also additions to the
tax role which balanced out some of the refunds. She felt
that most of these problems could be worked out before the
next cycle, but there was still a considerable amount of
programming to do. The Board asked her to submit a breakdown
of what needed to be done in order to be ready for the next
cycle.

6. CDD REQUEST TO USE CONFERENCE ROOM A
The Community Development Department requested that they be
allowed to regularly schedule Conference Room A from 8:00 am
to 9:00 am each Wednesday morning. The Board agreed that they
could use the room as long as they were aware that if the
Board needed the facility, they would be bumped.
7. SUBDIVISION PLAT FOR COLVIN ESTATES

Colvin Estates Phase I off Daggett Lane for Michael Tennant.
