ORDER NO. 92-009 WHEREAS, Resolution No. 91-089 provided for a hearing r the exchange of property between Deschutes County and Betty --Jo Rhoden; and 0108 1243 WHEREAS, said hearing was held on November 20, 1991, with a decision being rendered on December 18, 1991; and WHEREAS, ORS 275.100 requires that the Board of County Commissioners authorize the exchange of lands after hearing by order; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS and finds as follows: Section 1. That the properties described below are of equal value: The lands to be transferred by Deschutes County are generally described as follows: Parcel 1. The South One -Half of the Northwest One -Quarter and the Northwest One -Quarter of the Northwest One -Quarter of Section 3, Township 18 South, Range 13 East, Willamette Meridian, Deschutes County, Oregon. EXCEPTING THEREFROM: That portion within the right-of-way of Bear Creek and the right-of-way of Ten Bar Road. Parcel 2. A parcel of land containing 20.00 Acres, more or less, located in a portion of the Southwest One -Quarter of Section 32, Township 17 South, Range 13 East, Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: Beginning at a point on the westerly right-of-way line of Byram Road which bears North 01°13117" West a distance of 1318.20 feet from an aluminum cap marking the South One - Quarter Corner of said Section 32; thence South 89°59'44" West a distance of 1384.43 feet; thence North 00°04'58" �'?%C; o7C?�ED KEYPHED East a distance of 629.61 feet; thence South 89°58'39" East a distance of 1384.43 feet to, said westerly right-of-way��� FE line of said Byram Road; thence along said westerly right - of -line South 00004158" West a distance of 628.96 feet to the "Point of Beginning," the terminus of this description. A parcel of land containing 20.00 Acres, more or less, located in a portion of the Southwest One -Quarter of Section 32, Township 17 South, Range 13 East, Willamette 1 - ORDER NO. 92-009 (2/5/92) 4. 0108 1244 Meridian, Deschutes County, Oregon, being more particularly described as follows: Beginning at a point on the westerly right-of-way line of Byram Road which bears North 00°48'00" West a distance of 1947.05 feet from an aluminum cap marking the South One -Quarter Corner of said Section 32; thence North 89°58139" West a distance of 1384.43 feet; thence North 00°04158" East a distance of 629.61 feet; thence South 89°57'03" East a distance of 1384.43 feet to said westerly right-of-way line of said Byram Road; thence along said westerly right -of -line South 00°04'58" West a distance of 628.96 feet to the "Point of Beginning," the terminus of this description. The lands to be transferred by Betty Jo Rhoden are generally described as follows: Northwest quarter of the Southwest quarter of Section 8 and the Northeast quarter of the Southeast quarter of Section 7 in Township 18 South, Range 13, East of the Willamette Meridian, Deschutes County, Oregon. Section 2. That the exchange of such property will enhance recreational opportunities for residents of Deschutes County and thus is in the best interest of Deschutes County. Section 3. That the Deschutes County property manager shall file a partition application to partition the County land so that the aforementioned exchange may be consummated. Section 4. That upon the successful partition of the County land, title to said properties shall be reviewed and approved by Deschutes County Legal Counsel. Section 5. That upon review and approval of title by Deschutes County Legal Counsel and upon the successful completion of the partitioning of the County land, the exchange of real property as referenced is hereby authorized.
