ORDINANCE NO. 92-009 WHEREAS, the RL Zone currently has a minimum rear standard of 20 feet. REV LE COUINSEL 0108 1462 yard setback WHEREAS, the definitions of lot line front, rear and side in Title 19 create undue problems for corner lots that have two or three roads abutting the properties. WHEREAS, it is desirable that the rear setback for a yard that serves as a side yard be reduced to a reasonable setback similar to a side yard setback standard. WHEREAS, the Bend Urban Area Planning Commission, after notice given and hearing conducted in accordance with applicable law, has recommended approval of the proposed Text Amendment to Section 19.24.050 as set forth herein, that would make the desired changes; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF ORDAINS AS FOLLOWS: COUNTY, OREGON, Section 1. Section 19.24.050 of Title 19 of the Deschutes County Code is amended as follows: 19.24.050. Lot Requirements. The following lot requirements shall be observed, provided that the Hearings Body or Planning Director may allow smaller lots or different housing types in a new subdivision approved pursuant to this Ordinance and consistent with the Comprehensive Plan designation for preservation of forested areas or significant rock outcroppings when these lots are internal to the subdivision or after hearing if they are located on the edge of the new plat. A. Lot Area. Every lot shall have a minimum area of 20,000 square feet. B. Lot Width. Every lot shall have a minimum average width of 100 feet. C. Frontage. Front Yard. The front yard shall be a minimum of 30 feet. E. Side Yard. A side yard shall be a minimum of five feet and the sum of the two side yards shall be a minimum of 15 feet. F. Rear Yard. The rear yard shall be a minimum of 20 feet. In the case of corner lots or similar situations where the parcel abuts two public roads or alleys, the rear yard may be reduced to five feet for the rear yard that serves as a side yard. A side yard is recognized where a property line is perpendicular to a front lot line where access is obtained and an address is assigned. In all cases the solar setback requirements shall be met. G. Lot Coverage. Maximum lot coverage by buildings and structures shall be 35 percent of the lot area. H. Solar Setback. The solar setback shall be as prescribed in Section 19.88.210. (Ord. 83-041 Ss. 8, 1983). Section 2. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
