ORDER NO. 92-018
WHEREAS, the Board of County Commissioners (Board) has issued
a lengthy written decision denying a conditional use permit and
site plan for a transmission line applied for by PacifiCorp; and
WHEREAS, over one hundred individuals participated in the
hearings and became parties to the Board's decision;
WHEREAS, S 22.28.020 of the Deschutes County Code requires
that all parties to a land use decision receive a copy of a
written decision of the Hearings Body in land use matters, unless
the Board designates individuals to receive a decision as a
representative of a group, organization, group of petitioners or
similar collection of individual participants;
WHEREAS state law requires only that all parties to a land use
permit decision receive written notice of the decision rather than
a copy of the decision itself;
WHEREAS the Board determines that due to the number of parties
involved and the length of the decision it is in the public
interest to mail the final decision to a representative sample of
the parties to the decision;
WHEREAS, the Planning Division staff has forwarded to the
Board a list of parties, attached hereto as Exhibit A, determined
to be representative of the parties to the decision; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the Board's decision in the matter of an
application by PacifiCorp for a conditional use permit and site
plan permit for a transmission line, also known as conditional use
application number 91-116 and site plan application number 91-135
be mailed to the individuals listed in Exhibit "A," attached hereto
and by this reference incorporated herein.

Section 2. That all other parties be notified by issuance
of a written notice of the Board's decision, as required by ORS
215.416(10).
