Chairman Maudlin called the meeting to order at 10:05 im: �oard
members in attendance were: Dick Maudlin, Tom Throop and Nancy Pope
Schlangen. Also present were: Rick Isham, County Counsel; Bruce
White, Assistant County Counsel; Brad Chalfant, Property Manager;
Karen Green, Community Development Director; George Read, Planning
Director; Kevin Harrison, Senior Planner; Frank Moore, Mental
Health Director; Susan Brewster, Assistant Legal Counsel; Cynthia
Komurka, Animal Control Officer; and Helen Rastovich, Treasurer.
1. PUBLIC HEARING: ORDER 92-026 ANNEXATION TO LAPINE RFPD
Before the Board was a public hearing on Order 92-026
approving the annexation of territory to the LaPine Rural Fire
Protection District and issuing notice of the final hearing
date on April 22, 1992.
Bruce White said the area being proposed for annexation
included the Sunriver Business Park plus school district
property. They checked with the Department of Revenue to
determine whether this process was sufficiently advanced to
get the property on the tax roles for this next tax year. The
attorney for the Fire District and Iry Iverson, Department of
Revenue, determined that after today's public hearing, the
boundary would be sufficiently set so a map could be submitted
by the March 31, 1992, deadline to get on the tax roles.
Chairman Maudlin opened the public hearing for testimony.
Pat McVicar, representing the LaPine Fire District, said he
wanted to reiterate the fire district's support for this
annexation. He said they had received no negative comments on
this annexation. They were prepared to provide the proposed
annexation area with all of the services which were currently
being provided to the rest of the district. There were no
other inhabited areas in the vicinity of the proposed
annexation except for Sunriver proper.
Mary O'Conner, Board of Directors of the Sunriver Business
Park Association, said she and Jim Quinn, President of the
Association, wanted to thank Bruce White, Rick Isham, and Tom
Throop for helping expedite this process.
Chairman Maudlin closed the public hearing.

2. AWARD OF CONTRACT FOR PUBLIC OPINION SURVEY
Before the Board was a recommendation from the Community
Development Director to hire Western Attitudes, Inc., Lake
Oswego, to conduct surveys of public attitudes regarding rural
land use and of agricultural operators in the County. She had
received four proposals from the RFP and felt that Western
Attitudes was ideally suited to conduct this survey.
Chairman Maudlin expressed concerns about the survey. Karen
Green said the survey would determine public attitudes about
what sort of land uses ought to be allowed in rural areas
outside the urban growth boundary. The periodic review farm
study, of which this survey would be a component, would be
looking at the EFU zones to determine if they still met Goal 3
requirements for the preservation of agricultural lands. In
order to make those determinations, a technical study was
being done with OSU staff. Staff wanted to do a public
opinion survey and a farm operators' survey to add to that
base of knowledge. The public opinion survey was primarily
directed at giving the Board some sense of the public's
attitude about rural land uses generally and preservation of
rural land in particular.
Chairman Maudlin said he was concerned about the working of
the survey since he felt the questions in the rivers' study
were so slanted there was only one way to answer them. Karen
Green said the Board would be faced with some policy choices
on how the EFU zones might be reconfigured, and she felt it
would be to the Board's benefit to have a survey in addition
to the public comment at hearings about rural lands generally
and EFU lands specifically. She also felt it would make sense
to "piggyback" onto this survey, a survey of farm operators to
find out what was happening on their ground and what kinds of
income and expenses the farm operators were experiencing.
Commissioner Schlangen asked where they would get the names of
the agricultural operators. Karen Green said the surveyor
would use a census of agriculture which identified farms and
the EFU and farm deferred properties on the tax assessment
roles. That would be the base population from which a random
sample would be drawn and surveyed with a written survey. The
survey questionnaires would be developed by a working group
made up of Western Attitudes Staff and County staff, and then
they would bring the survey to the Board for review.

Chairman Maudlin felt that the survey would be easier to
conduct after the farm study was completed. Karen Green
pointed out that there was a limited time frame for completion
of the farm study. The survey was a last minute addition to
the farm study, and the timing was not what they would have
chosen either. The Board was facing some significant policy
questions in Phase 3 of the Destination Resort program (i.e.
determining to what extent destination resorts ought to be
allowed on farm land), and part of this survey would be
directed at obtaining public attitudes about this issue in
particular. Staff felt knowing the general attitudes of the
community toward destination resorts and hobby farms, as
nonagricultural uses, would be valuable to the Board in making
policy choices.
Chairman Maudlin said he did not want the County to be in the
position of having "attitudes" make the law. Karen Green said
attitudes couldn't make the law, but they could direct the
Board's policy choices as they did with the rivers' study.
Commissioner Throop said he supported the request for
proposals because he felt it was important that the Board
understand what the public was thinking during the decision-
making process. The farm study and the advisory committee,
those testifying at public hearings, and those submitting
written testimony would all be components of information which
the Board could use in making their policy decisions. In
addition, it was important that the Board have a sense of the
views of the general public which could come from a survey.
Chairman Maudlin said he would definitely like to review and
comment on the questions before the survey went out.
Karen Green pointed out that the input the Board was currently
receiving was from people who were very active and possibly
aligned with special interest groups, and many of the people
who came to hearings were also so aligned. She felt the
general public, who weren't actively involved in an interest
group or didn't take the time to attend hearings, weren't
usually heard from. This survey would help the Board
understand their views.
Karen Green said Western Attitudes was uniquely suited to do
this survey because of their background and experience,
particularly with public agency surveys and land use
development surveys. They also would be able to perform the
survey in the short time frame provided in the proposals, and
their cost was within the range of the other proposals
($10,000-$18,000). She requested that the Board approve
entering into a contract with Western Attitudes.

3. ERNEST MONEY OFFER ON COUNTY PROPERTY
Before the Board was approval of an ernest money offer from
Rusty Ertle on County property at 9th and Reed Market Road.
Brad Chalfant said this property was acquired by public works
for the realignment of 9th Street. The offer was for $27,443
and the land was zoned light industrial. The offer was $.50
a sq. ft. which a felt was reasonable given the problems with
the property. Because of its location, they would have to
take access off 9th Street which would require getting
approval from the City of Bend. There was also a segment (Tax
Lot 99) which was owned by the City which they would probably
try to purchase.
SCHLANGEN: I move that we accept the ernest money offer
for county property located at 9th and Reed
Market Road.
