WHEREAS, the Bend-LaPine School District No. 1 proposed a Text
Amendment to Section 19.92.030 of Title 19, to add public schools
to the list of structures not subject to height regulations.
WHEREAS, the Bend Urban Area Planning Commission, after notice
given and hearing conducted in accordance with applicable law, has
recommended approval of the proposed Text Amendment to Title 19;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. Section 19.92.030 of Title 19 of the Deschutes
County Code is amended as follows:
19.92.030. Exception to Height Regulations. Height
limitations set forth elsewhere in this Ordinance shall
not apply to barns, silos, water towers and tanks or
other farm buildings and structures, provided they are
not less than 50 feet from every lot line; public
schools, chimneys, church spires, belfries, cupolas,
domes, smokestacks, flagpoles, grain elevators, cooling
towers, fire hose towers, masts, aerials, elevator
shafts and other similar projections and outdoor theater
screens, provided said screens contain no advertising
matter other than the name of the theater. This
exception does not apply to the solar access provisions
of Section 19.88.210 and 19.88.220.
Section 2. This Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this Ordinance takes effect on its
