1992-28232-Order No. 92-073 Recorded 8/19/1992a REV I E D 92—x.8232 LC COUNSEL BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUT 9--t6 ;-�3REGON An Order Directing Transfer of 01x'9-0326 Real Property to the Central Oregon Park and Recreation * :r District to be Used Exclusively for Public Purposes. 4, ORDER NO. 92-073 (,A WHEREAS, ORS 271.330 provides that Deschutes County; may transfer real property not needed by the County to another governmental body after a hearing; and WHEREAS, a hearing was held on August 19, 1992, pursuant to Resolution No. 92-058; and WHEREAS, the Board of County Commissioners find that Deschutes County no longer needs certain real property for public purposes; and WHEREAS, said real property is encumbered by delinquent real property taxes as a result of unforeseeable delays in the transfer of said real property; and WHEREAS, ORS 311.795 allows the Board of County Commissioners to cancel all delinquent taxes, interest, and penalties accrued upon real property transferred to a park and recreation district; and WHEREAS, the Board of County Commissioners find that the Central Oregon Park and Recreation District is a governmental body of the State of Oregon and will use certain real property for a public purpose; and WHEREAS, no objections to the transfer of said real property were expressed at said hearing; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That Deschutes County's interest in the real property described in Exhibit "A," herein attached and incorporated by this reference, be transferred to the Central Oregon Park and Recreation District, the true consideration of which shall be the continued use of said property for park related public purposes, pursuant to ORS 271.330. 1 - ORDER NO. 92-073 (7/15/92) t. 01119 0327 Section 2. That a bargain and sale deed be executed and delivered transferring said property to the Central Oregon Park and Recreation District, subject to a reversionary interest of Deschutes County should said property cease to be used for public purposes. Section 3. That all delinquent taxes, interest, and penalties thereon accrued upon the subject real property be canceled.
