1992-29821-Order No. 92-085 Recorded 8/27/1992REVIE 92-29821 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF-DESCHUTES C UNSEL An Order Relating to the * G-7 Community Development Department Revenue Fund. 01 i9ob-0446'` ORDER NO. 92-085- C:':3 c -n WHEREAS, by Order No. 90-131, the Board of County Commissioners authorized the creation of the Community Development Department Revenue Fund, into which excess revenue collected by the Community Development Department ("CDD") is to be deposited by the County Treasurer and set aside for future expenses incurred by CDD; and WHEREAS, by Order No. 91-105, the Board of County Commissioners clarified the method for calculating CDD's excess revenue; and WHEREAS, pursuant to Order No. 91-105, the County Treasurer has deposited into the fund excess revenue collected by CDD during the fiscal year 1991-92; and WHEREAS, the Board of County Commissioners has determined that the provisions of Order No. 91-105 are inconsistent with CDD's adopted budget for the fiscal year 1991-92, that clarification of the method of calculating CDD's excess revenue is necessary and that additional excess revenue should be deposited into the CDD Revenue Fund; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. For purposes of the CDD Revenue Fund, the term "excess revenue" means the difference between actual revenue collected by CDD and CDD's actual expenditures plus 10% of CDD's actual revenue collected. Section 2. At the close of each fiscal year, the County Treasurer shall determine if CDD has collected excess revenue during that fiscal year, and all such excess revenue shall be deposited into the CDD Revenue Fund. Section 3. In each fiscal year, so long as the CDD Revenue Fund is maintained in the County budget, the fund shall be annually budgeted based upon the balance in the fund and departmental revenue and expenditure projection. Transfers from the CDD Revenue Fund to the General Fund shall be based upon projected CDD expenses for the next fiscal year. Section 4. In the event of shortfalls in the projected CDD revenue arising during a fiscal year, but not anticipated in the departmental revenue projection, the Board may transfer to the General 1 - ORDER NO. 92-085 (8/26/92) ",=,r►� t. j V IE I . 0I1-9-0447 Fund from the CDD Revenue Fund the amount necessary to balance the revenue and expenditures of CDD during the fiscal year. Section 5. The County Treasurer shall deposit in the CDD Revenue Fund excess revenue collected by CDD during fiscal year 1991-92, as provided in this order, less the amount of excess revenue previously deposited pursuant to Order No. 91-105.
