WHEREAS, the State Historic Preservation Office (SHPO) is charged with the responsibility of survey and planning with regard to cultural resources in Oregon under the program authorized by the National Historic Preservation Act of 1966, 16 USC s. 470; and WHEREAS, the State Parks Director has been designated by the Governor as the State Historic Preservation Officer with authority to direct the program of maintaining the Statewide Inventory of Historic Properties, nominating properties to the National Register of Historic Places, and applying to the Department of the Interior for federal grants for historic preservation acquisitions and development; and WHEREAS, SHPO has insufficient staff to adequately carry out the survey and inventory responsibilities under the National Historic Preservation Act of 1966, but has been allocated federal matching funds to fulfill the surveying, -I- 0119-1130 planning and nomination responsibilities authorized by the National Historic Preservation Act of 1966; and WHEREAS, the Oregon Department of Land Conservation and Development requires identification and protection of cultural resources under Goal 5 for the development of local comprehensive plans; NOW, THEREFORE, it is agreed between the parties as follows: PROPONENT AGREES: 1. Proponent agrees to administer the Certified Local Government subgrant in accordance with SHPOs Local Government Procedures. Except as otherwise specifically provided, all documents, reports, and material required by this agreement to be submitted, must be submitted to SHPO on or before August 3 1, 1993. Following is a description of the work product which proponent shall provide SHPO. a. Proponent shall carry out a Certified Local Government program to include nominations to the National Register, review and monitoring of historic landmarks, survey, and development of a historic preservation video as described on pages 2 through 4, Project Scope of Attachment A, incorporated in its entirety by Exhihit A — Resolution 9-2�082 this reference. b. Proponent shall provide to SHPO copies of agenda, staff reports, meeting minutes or other pertinent materials relating to Historic Review Board review of requests pursuant to local ordinance. C. Proponent shall include the following acknowledgement of National Park Service support in its publications: The activity that is the subject of the publication has been financed in part with Federal funds from the National Park Service, Department of the Interior, as provided through the Oregon State Historic Preservation Office. However, the contents and opinions do not necessarily reflect the views or policies of the Department of the Interior, nor does the mention of trade names or commercial products constitute endorsement or recommendation by the Department of the Interior. d. Proponent shall include the following non-discrimination statement in any newsletter, pamphlets, brochures, or published information developed under terms of this agreement. This program receives federal financial assistance. Under Title VI of the Civil Rights Act of 1964 and Section 504 of the Rehabilitation Act of 1973, the U.S. Department of the Interior prohibits discrimination on the basis of race, color, national origin, age or handicap in its federally -assisted programs. Proponent shall provide agendas, staff reports, meeting minutes, and any other materials noted in Attachment A as part of the Pro ect Scope. i. Proponent shall supply written progress reports on or before February 15 and June 1. If the effective date of the agreement is 30 days or less prior to the due date of a progress report, the proponent may submit the report by the next deadline. SHPO shall provide the progress report format and shall review the progress report to determine whether Proponent is adequately performing the provisions of this agreement. Any changes to the scope of work which Proponent wishes to propose based on Proponent's experience during the prior quarter of the project shall be requested at this time. i. State certifies at the time the contract is written that sufficient funds are available and authorized for expenditure to finance costs of this contract within State's current appropriation of limitation. TERMINATION: This contract may be terminated by mutual consent of both parties, or by either party upon a 30 -day notice in writing, and delivered by certified mail, or in person. State may terminate this contract effective upon delivery of written notice to the Proponent, or at such later date as may be established by the State, under any of the -5- 0119-1134 following conditions: a. If State funding from federal, state or other sources is not obtained and continued at levels sufficient to allow for purchase of the indicated quantity of services. When possible, and when agreed upon, the contract may be modified to accommodate a reduction in funds. b. If federal or state regulations or guidelines are modified or changed in such a way that the services are no longer allowable or appropriate for purchase under this contract. C. If any license or certificate required by law or regulation to be held by the Proponent to provide the services required by this contract is for any reason denied, revoked or not renewed. Any such termination of this contract shall be without prejudice to any obligations or liabilities of either party already accrued prior to such termination. The two projects for which funding is requested include: A. The development of an educational video on historic preservation in Deschutes County. II. The Deschutes County Historical Landmarks Commission regularly reviews exterior alterations, sign applications, demolition permits and interior alterations for historic buildings. on average, the Commission has reviewed one per month over the last several years, including a number for National Register properties. Design reviews of specially assessed properties are expected. Recent U.S. Census data showing the County as the second fastest growing area in the State as well as building permit trends over the last year suggest the current rate of review will continue, if not increase. In addition, the Americans with Disabilities Act of 1990 is expected to bring an increase in exterior alteration reviews. This project will assist in funding the costs incurred to conduct the analyses and hold hearings for review by the Historical Landmarks Commission. In addition, Staff and Commission time will be required Project.6/92 Page 2 LArl I D I I /-% OF NT to monitor three major development projects: I�Wo�kGrIgW Parkway project, the city of Bend's downtown redevelopment project, and the City of Redmond's Main Street USA Project. 0119-1140 The Oregon Department of Transportation's Bend Parlomy project will require the re -location of the Oregon Trunk Railroad (Bend Railroad) Depot and will impact other resources. Although the ODOT is developing re -location plans for the Depot under Section 106, Staff time to monitor and to provide coordination assistance will be required. Staff has provided ODOT with research and coordination assistance since fall 1990. The Landmarks commission established a Task Force in Fall 1991 to study options and to develop plans for preservation of local historic resources. Staff time to identify and evaluate alternatives to best protect resources will be required. The City of Bend's downtown redevelopment plan is centered near the H. E. Allen House. It appears the plan will affect facades, awnings and signs of other historic buildings in the downtown area. Depending upon funding sources, the project may also require Staff time for the review and compliance process under Section 106. Staff time related to the Allen House and to develop recommendations to maintain the integrity of buildings in the project area will be required. A retail study for the City of Redinond has recommended the development of a long-term plan to change the face of downtown. The -plan will revitalize the core with an emphasis on reviving period architecture and developing a Main Street USA theme. Nearly one dozen properties and five signs in the core area are listed in the City's historic inventory. The plan will assumably affect facades, awnings and other historic fabric features. Staff and Commission time to review proposed changes and to develop recommendations to maintain the integrity of buildings/structures in the project will be required. Prpgram maintenance consists of inventory management, local liaison activities, public information activities program coordination, projects as assigned by County/City(ies)/Landmarks Commissions and by City/County Planning Directors. An increase in public information activities is anticipated. (This is a basic/additional participation project.) B. Development of Historic Preservation Video. This project will encourage, expand and improve preservation activities by educating the public. The CLG intends to produce a video tape presentation about the joint cities/County Historic Preservation Program. This will be a professionally developed video which will give an overview of JProgram. and resources. t6119-1141 The purpose of the project is to promote historic preservation throughout the community by showing examples of buildings that have been rehabilitated and their positive effects on downtowns and neighborhoods. Incentives for historic preservation, including tax incentives, financial assistance and regulatory relief, will be presented. Through the use of old and new photographs of historic buildings with commentary by a narrator, Landmarks commissioners and developers, the preservation program will be explained and promoted. An analysis of a rehabilitation project under design review guidelines will be presented. It is expected that the video will present a national perspective on a local level on some points. Prospects for the future in light of current development trends will be addressed. Current issues, however, will not be a focus in order to provide a 4 -5 -year product life. As proposed, the videotape will be approximately 15 minutes in length and will highlight the benefits of preservation. The product will be made available to civic and community groups, student groups, the Chamber of Commerce and Welcome Center, and will be shown regularly at the Des Chutes Historical Center, a local museum. (This is a basic/additional participation project.) V. PROJECT COSTIPROPOSED BUDGETS As a Certified Local Government, we are requesting "basic participation" and "additional participation" funding. METHODOLOGY AND PROCEDURE A. Review of 12 Local Landmarks. Monitoring of Maio Development Projects and PrgqKam Maintenance. Review of local landmarks is an ongoing function of the Deschutes County Historical Landmarks Com- mission. Review is initiated when property owners submit applications for approval of alterations of historic sites. The Historic and Cultural Resources Planner serves as staff to the Historical Landmarks Commission and prepares staff reports. Public notice is made in accordance with the County's land use Procedures Ordinance, and all alterations are considered Land Use Actions. Public Hearings are held by the Historical Landmarks Commission and determinations of appropriateness of the proposed alterations are made. Minutes of the proceedings are kept. Appeals', if they occur, are heard by the appropriate governing body, and specific land use procedures are followed for these appeals. These procedures are specified in the Historic Preser vation ordinances of the City and County and in the Land Use Procedures of each jurisdiction. Methods of monitoring major development projects will be as follows: Bend Parkway Proiect 1. Updates and presentations before the Historical Landmarks Commission by Cultural Resources Specialists of the Oregon Department of Trans- portation will be requested and scheduled. 2. A Task Force has been established to study options and to develop plans for preservation of historic resources. Entities represented on the Task Force are City of Bend, Deschutes County, Bend Metro Park & Recreation District, Deschutes County Historical Society and Deschutes County Historical Landmarks Commission. The Oregon Highway Division has been invited to participate. 3. Staff will meet with Department of Transportation and City representatives as the project evolves. 4. AGREEMENT B. Development of Historic Preservation VldeC _k.,m uiL19-1146 Ideas for information to be presented by the video will be formulated at a regular meeting of the Historical Landmarks Commission. A member of the commission has considerable film and video experience, working with major motion picture productions, television stations, OPB, advertising firms and independent video producers. He will serve as consultant to the project. The Historic Resources Planner will solicit suggestions from other preservation organizations. In a general sense, the video History Lives Historic Preservation In Orp-gon Ci (1985) will serve as a model for the project. A local production company will be hired to produce a video as outlined in the Project Scope section of this proposal. In addition, a narrator, a professional voice, will be hired. The Planner will compile information and prepare a draft script and storyboard. The consultant will review the script and assist in storyboard development. The Planner and consultant will work closely with the production firm in pre -production, production and post -production. Pre -production involvement of the Planner will include casting (identification of spokespersons), identifying and arranging for locations, and prop management. The Planner will assist/supervise the production company during filming. The Planner and consultant will make recommendations for editing, audio and other post -production activities. Prior to completion of the final product, the Historical Landmarks Commission will view the video and have an opportunity to make suggestions and recommendations. These will be incorporated into the final product. Seven (VHS) copies will be produced. VII. FIENAL PRODUCTS A. Review of 12 Local Landinarks, Monitorinct of Maio Development Projects and Prggx:am Maintenance. Copies of the Historic Landmarks Commission Findings and Decision and minutes of hearings will be forwarded to the State as a final product. Copies of correspondence, minutes and other documentation of staff or Commission proceedings with the the City of Bend, City of Redmond or the Oregon Department of Transportation regarding the previously described Project.6/92 Page 9 EXHIBIT A ICOF /0 projects will be forwarded to the SHPO. This REEMENT of the program encourages future participation in t e CLG program and has aided in receiving approval of the governing body for this Grant. B. Development of Historic Preservation Video. 0119-1147 one copy of the completed video in 3/411 format, suitable for television and/or cable showing, will be produced. Two copies of the video in VHS format will be forwarded to the SHPO. Five copies in VHS format will be produced for distribution, lending, etc. The intangible product will be information provided to the public of the existence of the Historic Preservation Program.
