WHEREAS, Deschutes County Public Works petitioned the Board of
County Commissioners of Deschutes County, Oregon, to vacate a portion of
all that portion of Groff Road in Sections 16, 17, 20 and 21 of Township
18 South, Range 13 East W.M., located in Deschutes County, Oregon; and
WHEREAS, the Board of County Commissioners has determined it to be
in the public interest to consider such vacation; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That it is the intent of the Board of County
Commissioners of Deschutes County, Oregon, to vacate all that portion of
Groff Road in Sections 16, 17, 20 and 21 of Township 18 South, Range 13
East W.M. described in Exhibit "A", attached hereto and by this
reference incorporated herein, because it appears the road is no longer
needed for public use, and will not be needed in the future.
Section 2. That the County Engineer shall file an Engineer's
Report with the Board of Commissioners, describing the ownership and
uses of property to be vacated, and whether the vacation would be in the
public interest, within fourteen (14) days of the date of this
Resolution.

PROPOSED DESCRIPTION FOR THE VACATION
OF A PORTION OF
GROFF ROAD
All of that portion of Groff Road (Established 1920- 40
Ft. R.O.W.) in Sections 16, 17, 20, and 21 of Township 18
South, Range 13 East, W.M., Deschutes County, Oregon, that is
shown as "existing right-of-way to be vacated" on Sheet No. 1
of the Plat of Survey of Rickard Road (CS 04289) per PLS 1031
as filed with the office of the Deschutes County Surveyor on
October 11, 1990._
SUBJECT TO the reservation of a utilities easement in and
upon all of the property; for the purposes of continuing,
constructing, installing, maintaining, repairing,
reconstructing, replacing, enlarging and altering; wires,
poles, pipes, lines, structures, casings supports, equipment,
facilities and appurtenances; at the present and in the
future; necessary or convenient; to Deschutes County, a
political subdivision of the State of Oregon, its agents,
licensees and permittees; forever.

ENGINEER'S REPORT FOR PUBLIC ROAD VACATION
DATE: MARCH 2, 1993
TO: BOARD OF COUNTY COMMISSIONERS
FROM: DESCHUTES COUNTY ENGINEER
SUBJECT: ENGINEER'S REPORT RELATING TO THE VACATION OF ALL
THAT PORTION OF GROFF ROAD IN SECTIONS 16, 17, 20
AND 21 OF TOWNSHIP 18 SOUTH, RANGE 13 EAST W.M.,
LOCATED IN DESCHUTES COUNTY, OREGON.
1. Property proposed for vacation is owned by Deschutes
County and is no longer in use for roadway purposes.
Groff Road has been realigned and the right-of-way
lying to the north has been dedicated for road way
purposes.
2. It appears this property does not provide access to
public lands, rivers, streams or natural features.
3. It is the Engineer's assessment that the proposed
vacation is in the public interest as this
right-of-way is no longer needed for roadway
purposes and can be returned to private ownership
and put on the tax rolls.
4. The following other pertinent facts were considered
in making this report: Preliminary notices were
sent to all involved Utilities, the Fire Department,
Community Development Department, and the County
Property Manager. No comments were received.
