' ` s ` n � 2 DESCHUTES COUNTY BOARD OF COMMISSIONERS March 31, 1993 ;t ER" Chair Throop called the meeting to order at 3:01 p.m. Board members in attendance were Tom Throop, Nancy Pope Schlangen, and Barry Slaughter. PUBLIC HEARING: BOARD REVIEW OF HEARINGS OFFICER'S DECISION ON CU - 91 -177 AND MP -92-56 FOR CAM MEYERS Paul Blikstad gave the staff report. He reported this application was to create two 20 acre parcels out of a 40 acre parcel and a conditional use permit for a farm dwelling one of the 20 acre parcels. The Hearings Officer issued a written decision on January 11, 1993, approving the partition and the conditional use permit subject to the farm management plan. Chair Throop opened the public hearing. Chair Tom Throop asked for disclosure from Commissioners for any pre -hearing contacts in this matter. All commissioners reported having no prehearing contacts. Chair Throop also asked audience members if they felt any member of the Board of the Commissioners should be challenged with bias or inability to make a fair decision in this matter. No challenge was made from the public. Cam Meyers testified that she wanted to partition the 40 -acre parcel into two 20 -acre parcels. She stated the 20 acres with the two houses on it produced sixty tons of hay last year. She said 10 acres of the other parcel will be planted with hay and the rest of the land will have cattle on it. She was also planning to put a dwelling on this parcel. The septic system and driveway has already been approved and the property is fenced. She would be tilling and planting as soon as the weather allows. Commissioner Schlangen asked what the timeline was for the cow and calf operation. Cam Meyers said it would depend on the feed supply. She said she would keep eighteen cattle at all times. She did not feel that the property would support more cattle than that. Commissioner Throop asked if she had a problem receiving the conditional use permit, putting the structure into place, and owning the livestock before getting a building permit. The applicant said she would prefer the building permit before the livestock being placed on the property. Commissioner Throop said the livestock did not have to be on the property but they would need to be in her ownership. Commissioner Throop said the intent would be to build the dwelling and then move the livestock onto the property. Commissioner Throop asked Cam Meyers if she would have an objection if there was a condition of this approval, that should one of the MICROFILMED 10EYg e 44EC 3 iy1A 1993 6199 N1A� :" 0126--0083 houses need to be remodeled then the other house would be given up for a storage building. Cam Meyers felt that was possible to work with because she felt the building would not meet remodeling codes. Being no further testimony, Chair Throop closed the public hearing. SCHLANGEN: I move we uphold the Hearings Officer's approval of the conditional use permit and the partition with the added condition that the farm plan include the purchase of fourteen bred cows before the building permit can be issued. A letter will be sent to applicant amending the Hearings Officer's decision regarding the existing structures with Board's signature upon review. SLAUGHTER: Second.
