1993-23572-Order No. 93-163 Recorded 7/7/1993i 93.23572 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring the Result of *_ the Special Election Held on June *`'`` _} 29, 1993, on the Deschutes County *' 911 County Service District Measure Election Relating to a Two -Year Operating Serial Levy. 0127--0426 ORDER NO. 93-163 WHEREAS, a special election in Deschutes County, Oregon, was held on June 29, 1993, on the Deschutes County 911 County Service District measure set forth in Exhibit "A;" and WHEREAS, the Abstract of Votes at the election, set forth in Exhibit "B," shows that a majority of the votes cast were in favor of the measure; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: That at the special election held in Deschutes County, Oregon, on June 29, 1993, 11,762 electors votes "Yes" and 9,382 electors voted "No" on the measure captioned "Two -Year Operating Serial Levy," set forth in Exhibit "A," attached hereto and by this reference incorporated herein, as evidenced by the Abstract of Votes, marked Exhibit "B," attached hereto and by this reference incorporated herein; and that the measure is declared to have passed. ALLOWS VOTER AP- PROVAL OF URBAN RE- NEWAL BOND REPAY- MENT OUTSIDE LIMIT QUESTION: Shall Oregon's Con- stitution be amended allowing local voters to authorize taxes outside Article XI limit to repay urban re- newal bonds? EXPLANATION: Payments for bonds are generally excluded from the property tax rate limit, but courts have interpreted Ballot Measure 5, adopted in 1990, to include taxes to pay urban renewal bonds within the limit. This measure maintains the limit on urban renewal bonds, which may be used for community devel- opment and housing, unless local voters authorize bond payment out- sidethe limit. If this measure passes, cities orcounties could ask voters to approve taxes outside the tax limita- tion to repay current or future urban renewal bonds. ESTIMATE OF FINANCIAL IM- PACT - Local revenue impact: No direct impact. To the extent voters approve urban renewal taxes to re- pay debt outside Measure 5's limits, urban renewal revenuewill increase. If taxes imposed outside the limit replace levies currently imposed in- side the limit and the area is cur- rently above the Measure 5 nonschool limit, local city and county revenue will increase. State rev- enue impact: No direct impact. o YES BALLOT - SPECIAL ELECTION COUNTY, OREGON - JUNE 29, 1993 DESCHUTES COUNTY 9-1-1 COUNTY SERVICE DISTRICT 9-1. TWO-YEAR OPERAT- ING SERIAL LEVY. QUESTION: Shall County 9-1-1 District levy $397,000.00 each year for two years outside tax base for operating purposes beginning in 1993-94? SUMMARY: Funds provided by the two-year serial levy will be used to maintain existing Deschutes County 9-1-1 County Services District ser- vices. The proposed two-year serial levy will replace a prior levy that ends in June 1993. The total amount to be raised by the two-year serial levy for 9-1-1 opera- tion purposes is $794,000.00. This amount of proposed taxes is outside the limitation imposed by Section 11, Article XI, Oregon Constitution. This tax is subject to the other gov- ernmental purposes limit of Section 11(b), Article XI, of the Oregon Con- stitution. Approval of this measure would not reduce the property tax collections of other non -school dis- trict units of local government avail- able under the provisions of Section 11(b), Article XI, Oregon Constitu- tion and implementing legislation. The revenues raised will be used exclusively for other governmental purposes. The estimated tax impact of this measure is 7 cents per thousand dollars of assessed valuation. The estimated tax cost for this measure is an ESTIMATE ONLY based on the best information available from the county assessor at the time of the estimate. o YES �W 0127-'0427 DESCHUTES COUNTY 9-2. DESCHUTES COUNTY TRANSIENT ROOM TAX EXEMPTIONS QUESTION: Shall County Code amendment eliminating tax exemp- tions for personally rented short term and vacation rentals be ap- proved? SUMMARY: Renters of hotel, motel and similar accommodations pay transient room taxes. Rev- enues from the transient room tax, paid by these renters, have been used to partially pay for County services used by County visitors and promote tourism. The ordi- nance eliminates the exemption from taxation for facilities such as homes, condominium units and cabins personally rented by the owner beginning October 1, 1993.
