ORDER NO. 93-188
WHEREAS, the Board of County Commissioners, by Resolution
93-026, initiated the improvement of a certain dedicated public
road known as Cagle Road; and
WHEREAS, the County Engineer investigated the improvement, and
estimated the cost of the improvement, and a cost estimate of this
improvement has been prepared in accordance with ORS 371.625; and
WHEREAS, it is necessary that notice, pursuant to ORS 371.60,
be mailed to each benefited property owner; and
WHEREAS, it is necessary that a hearing be held for the
purpose of hearing remonstrances to said improvement; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the Engineer's Report relating to the
improvement of a certain dedicated public road known as Cagle Road
be accepted and hereby approved.
Section 2. That a hearing be set on September 8, 1993, at
10:00 a.m. at the Deschutes County Juvenile Justice Building, 1128
NW Harriman, Bend, Oregon, for the purpose of hearing remonstrances
to said improvements.
Section 3. That the Director of Public Works be authorized to
notify benefited property owners of the said hearing and proposed
improvement, in a form substantially as contained in Exhibit "A",
attached hereto and by this reference incorporated herein.

The Board of County Commissioners has initiated the above improvement.
The County Engineer has made a favorable report to the Board of County
Commissioners regarding the proposed improvement. Upon completion of the
proposed improvement, the roads will be accepted into the County Road
System, and will be maintained by Deschutes County.
The total estimated cost of the proposed improvement and the proposed
total amount of the assessment against your land is as shown above.
If you object to the proposed improvement and assessments shown in the
Engineer's Report, you are required to file written objection, if any,
with the Board of County Commissioners, c/o Deschutes County Department
of Public Works, 61150 S.E. 27th Street, Bend, Oregon 97702, within 20
days of the date of this notice, or at the public hearing on the proposed
improvement before the Board of County Commissioners, which will be held
on September 8, 1993 at 10:00 a.m. in the Deschutes County Juvenile
Justice Building, 1128 NW Harriman, Bend, Oregon, in order to stop this
improvement. If more than 50% of the owners of land representing more
than 50% of the total amount of the assessment for the proposed
improvement file objections, the proposed improvement will be declared
abandoned and no new resolution shall be filed within a period of one
year. If the required number of objections are not received, the
improvement will proceed and you will be notified of the actual
assessment when it is determined by the engineer. This assessment, as
finally approved by the Board of County Commissioners, will be entered
into the lien docket of Deschutes County and will be released when the
assessment is paid in full. Owners may apply to make payments in
installments which can be paid over a ten-year period.

SUBJECT: ENGINEER'S REPORT FOR CAGLE ROAD L.I.D.
*******************************************************************************
Deschutes County received a request to improve all Cagle Road
in Bend, Oregon. Due to this request, the Deschutes County
Board of Commissioners initiated a Local Improvement District
by Resolution No. 93-026 signed on April 7, 1993.
The Resolution was referred to the Deschutes County Public
Works Department for an engineering investigation of the
proposed improvements in accordance with ORS 371.625. The
Engineer's investigation of the Cagle Road Local Improvement
District found the following:
1. In the Engineer's judgment, improving the roads to
Deschutes County Road Standards for a Rural Local Road
is feasible.
2. For this road to meet County Road Standards, the
following work must be completed:
a. Mobilization - normal mobilization costs incurred in
preparation of the work.
b. Construction Surveying - Slope staking, subgrade
stakes and base stakes set by contractor's surveyor.
c. Traffic Control - signs and flaggers will be
provided to warn, safeguard, protect, guide and
inform the public and the workers.
d. Subgrade - a substantial amount of earthwork will be
required to provide proper drainage.
e. Base - placing, shaping, compacting and fine grading
of base will be required. An eight (8) inch depth
of compacted cinder base will be utilized. The
finished width shall be thirty-two (32) feet
measured between the edge of shoulders.

f. Paving - the paving will be an 0-9 Asphaltic
Penetration Macadam (Oil Mat). The pavement will be
twenty-four (24) feet in width.
g. Engineering and Administration - the expenses
incurred by the County in the preparation of plans
and specifications, inspection, surveying,
accounting and payment collection and other
incidental costs to Bancroft Bond the project.
3. The estimated cost for improving the roads as outlined
above, is:
a. Mobilization $10,000.00
b. Construction Surveying $ 6,000.00
b. Traffic Control $ 4,000.00
C. Subgrade $11,680.00
d. Base $49,580.00
e. Paving $49,050.00
f. Engineering & Administration $32,600.00
$162,910.00
4. The Engineer looked at four possible methods of
assessment for the Local Improvement District. They are
as follows:
a) Equal Assessments:
$162,910 divided by 32 lots = $5,090 per lot
b) Equal Assessments with the 40 acre parcel receiving
four assessments:
$162,910 divided by 35 lots = $4,655 per lot (the
assessment for the 40 acre parcel would be $18,620)
c) Frontage foot (see attached map):
$162,910 divided by 6443 feet = $25.28 per foot

In the Engineer's judgment, the fairest method of
assessment for the Local Improvement District would be:
Equal Assessment with the 40 acre parcel receiving 4
assessments. With the 40 acre parcel being counted as 4
lots, there are 35 specially benefited lots within the
L.I.D. and the cost to each lot would be
$4,655.00.
5. Attached is a description, assessed value, estimated
assessment and name of owner for each lot in the Local
Improvement District.
