Criswell and Sharon * - r'L' L. Criswell and Making the Required Findings. 93-'7594* 0128-0245 ORDER NO. 93-195 WHEREAS, Resolution No. 93-073 provided for a hearing to consider the exchange of interests in real property between Deschutes County and William T. Criswell and Sharon L. Criswell; and -WHEREAS, notice of said hearing was published in a newspaper of general circulation, once each week for four consecutive weeks; and WHEREAS, said hearing was held on October 13, 1993; and WHEREAS, ORS 275.100 requires that the Board of County Commissioners make findings and authorize the exchange of interests in real property after hearing by order; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS and finds as follows: Section 1. That the proposed exchange of interests in real property consists of an exchange of easements which are of equal value. Section 2. That the exchange of easements will provide for a public trail and conservation easement allowing public access along the Deschutes River in furtherance of the adopted goals and policies of the Deschutes County Comprehensive Plan and in the best interest of the citizens of Deschutes County. Section 3. That Deschutes County authorizes the exchange and transfer of an easement appurtenant, for residential ingress/egress to the adjacent real property owned by the Criswells, so long as the public has the beneficial use of the subject trail and conservation easement, both herein described. The easement to be transferred by Deschutes County is generally described as follows: A 30.00 foot wide strip lying 15.00 feet on each side of the following described centerline located in the southwest quarter of the southwest quarter (Government Lot 4) of Section 6 in Township 17 South and Range 12 East of the Willamette Meridian in Deschutes County, Oregon, beingNCHEI) fully described as follows: J'2 21993 Commencing at a 2" brass cap on an iron pipe at the southwest comer of said southwest quarter of the southwest comer; thence South 89°59125" East 1180.65 feet to a 5/8" 2 P 1'9"'3 1 - ORDER NO. 93-195 (10/13/93) 0128-`0246 iron rod per CS No. 02257 at the southeast comer of said southwest quarter of the southwest quarter; thence North 00°20117" West 60.49 feet along the east line of said southwest quarter of the southwest quarter to the point of beginning; thence North 82024101 West 17.59 feet; thence North 76°19'37" West 351.49 feet; thence North 77°48'02" West 58.56 feet; thence North 81°41'44" West 56.59 feet; thence North 89004106" West 57.80 feet; thence South 82012156" West 50.12 feet; thence South 72°17'29" West 49.20 feet; thence South 64035152" West 58.84 feet; thence South 55054105" West 50.17 feet; thence South 55026'16" West 51.55 feet; thence South 64034'00" West 53.95 feet; thence South 72°28105" West 56.91 feet; thence South 83°25131" West 49.32 feet; thence South 88034'18" West 73.17 feet to a point which is North 15.00 feet from the south line of said southwest quarter of the southwest quarter; thence North 89059125" West 192 feet parallel with said south line to the west line of said southwest quarter of the southwest quarter and the terminus of this description. The easement to be transferred by William T. Criswell and Sharon L. Criswell is generally described as follows: A 10.00 foot wide public trail and conservation easement measured at right angles landward from the ordinary high waterline on the left bank of the Deschutes River. The above described easement applies to a parcel located in the southeast quarter of the southwest quarter of Section 6 in Township 17 South and Range 12 East of the Willamette Meridian in Deschutes County, Oregon; said parcel being fully described in Volume 253, Page 1839 of the Official Records, Deschutes County. Section 4. That upon review and approval of title by Deschutes County Legal Counsel the exchange of interests in real properties as referenced is hereby authorized.
