ORDER NO. 93-197 ;T<r- Cn WHEREAS, Resolution No. 93-094 provided for a hearing to consider the exchange of real property between Deschutes County and Paul R. Unger, Alan G. Unger, Anne E. Johnston, Craig R. Unger and Todd J. Unger; and WHEREAS, notice of said hearing was published in a newspaper of general circulation, once each week for four consecutive weeks; and WHEREAS, said hearing was held on October 27, 1993; and WHEREAS, ORS 275.100 requires that the Board of County Commissioners make findings and authorize the exchange of real property after hearing by order; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS and finds as follows: Section 1. That the real properties have been appraised by a licensed and competent appraiser, and that the parties to said exchange agree that the value of the Unger property is $350,000.00 and the value of the County property is $330,000.00. Section 2. That the exchange of real property will provide for the more efficient delivery of County Services in the Redmond area and is in the best interest of the citizens of Deschutes County. Section 3. That Deschutes County authorizes the exchange and transfer of real property which consists of land and buildings at 1st and Olney in Bend, and which is generally described as follows: Lot 11, Lytle Acres Addition to the City of Bend, Deschutes County, Oregon. Section 4. That Deschutes County authorizes the acceptance of the real property being transferred to the County, which consists of land and a building at 737 SW Cascade Street, Redmond, and which is generally described as follows: Lots 7, 8 and 9, Block 14, Original Townsite of Redmond, Deschutes County, Oregon. 1 - ORDER NO. 93-197 (10/27/93) 1993 DEC 0125-0353 Section 5. That the exchange shall be conducted in escrow, wherein the real property shall be transferred by bargain and sale deed and Deschutes County shall equalize values by delivering a promissory note to the Ungers for $20,000.00, payable in equal monthly installments over one year to equalize values, subject to a non -appropriation of payments in the next following fiscal year. Section 6. That upon review and approval of title by Deschutes County Legal Counsel the exchange of interests in real properties as referenced is hereby authorized.
