1993-45724-Ordinance No. 93-059 Recorded 12/17/1993REVIEWED 93-45724 Qw�J LEGAL CAUUE BEVOA THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTE , An Ordinance Amending PL -18, the Redmond Urban Area Comprehensive Plan Map, to Recognize a New Site for the Deschutes County Fairgrounds and Declaring an Emergency ORDINANCE NO. 93-059 WHEREAS, the Deschutes County Fair Board and Fair Association proposes to move the County fairgrounds to a new site on certain real property located southeast of the City of Redmond; WHEREAS, the location of the new proposed fairgrounds would render obsolete existing language in the Redmond Urban Area Comprehensive Plan; WHEREAS, public hearings have been held on the request consistent with state and county law; and WHEREAS, the Redmond Urban Area Planning Commission recommended adoption of the amendments as proposed; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY ORDAINS as follows: Section 1. AMENDMENTS TO GENERAL LAND USE SECTION. The text of PL -18, the Redmond Urban Area Comprehensive Plan (as set forth in the plan document dated October 1979), found in the General Land Use section at paragraph 3 of page 21 is amended to read as follows: "Future expansion of commercial and general aviation activities at Roberts Field, and availability of land surplus to airport requirements, offer potential for developing a Tourist -Transportation Center between the airport terminal area and the proposed interchange of the alternate arterial route and realigned U.S. 126. This development opportunity would be enhanced by expansion of the adjacent golf course to 18 holes (and relocation of the Fairgrounds onto County land north of the Tourist -Transportation Center]. Development of this commercial area is considered dependent upon construction of the alternate arterial route, realignment and extension of U.S. 126, construction of adjacent complementary facilities, market demands and the institution of a vigorous promotional program." Section 2. AMENDMENTS TO URBANIZATION SECTION. The text of PL -18, the Redmond Urban Area Comprehensive Plan (as set forth in the plan document dated October 1979) , found in the Urbanization section on 1 - ORDINANCE NO. 93-059 page 33 under the heading "Public Lands Allocations - FincV14s" as Finding No. 3 is amended to read as follows: "3. Deschutes County Fairgrounds The Deschutes County Fairgrounds are currently located in the [the] center of downtown Redmond. There is no off street parking available and the facilities are generally outdated. It is desirable to keep the fairgrounds in Redmond because of the City's central location. But the facility must be moved out of an already busy part of the City to a location that can properly accommodate the operation. [An area east of downtown Redmond has been designated open space/park reserve for the new fairgrounds.]" Section 3. AMENDMENTS text of PL -18, the Redmond in the plan document dated Facilities section on page amended to read as follows. "County Fairgrounds TO PUBLIC SERVICE FACILITIES SECTION. The Urban Area Comprehensive Plan (as set forth October 1979), found in the Public Service 87 under the heading "County Fairgrounds" is Deschutes County Fair Facilities occupy a little over 34 acres of land within the City. A majority of the facilities which accommodate fair functions are of older wood frame construction and have definite limitation in regard to uses other than typical fair programs. Diversification in economy and public interest are presenting new demands to older fair facilities which were designed and constructed primarily for traditional agriculturally oriented fairs. This exemplified by current trends in Lane, Douglas, and Jackson Counties, where fair operation account for approximately one month of facility utilization and the remaining portion of the year is devoted to convention activity, trade shows, exhibits and the like. Therefore, existing fair facility reorientation and new construction are reflecting broader utilization of facilities to meet demands of the public. The Crook County facilities at Prineville and resultant use benefits exemplify this factor. [Considering public ownership of considerable acreage north of the airport, this would provide an opportunity to reserve 120-160 acres for a long-range development program for Tri -County Fair activities, Agricultural Services Center, convention and exposition activities.]" Section 4. AMENDMENTS TO PUBLIC SERVICE FACILITIES SECTION. The text of PL -18, the Redmond Urban Area Comprehensive Plan (as set out in 2 - ORDINANCE NO. 93-059 s Pfl w � `7 .1.. the plan document dated October 1979), found in the Public Service Facilities section on page 88 under the heading "Policies" as Policy 2 is amended to read as follows: 2. Relocation, reconstruction and expansion of the fairgrounds [to the area north of the airport identified in the 1974 Plan] should be implemented as soon as possible, including an indoor arena as a major consideration." Section 5. FINDINGS. In support of its decision, the Board adopts the findings and recommendations of the Redmond Urban Area Planning Commission, attached to Ordinance 93-058 as Exhibit "E" and incorporated herein by this reference. Section 6. DELETIONS AND ADDITIONS. Provisions that are to be deleted as a result of the enactment of the above -referenced sections are shown in brackets; provisions that are being added are shown in bold-faced type. Section 7. SEVERABILITY. The provisions of this ordinance are severable. If any section, sentence, clause, or phrase of this ordinance or any exhibit thereto is adjudged to be invalid by a court of competent jurisdiction that decision shall not affect the validity of the remaining portions of this ordinance or exhibit thereto. Section 8. CORRECTIONS. This ordinance may be corrected by order of the Board of County Commissioners to cure editorial and clerical errors and to insert appropriate legislative history references. Section 9. EMERGENCY. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
