ORDINANCE NO. 93-061 REVIEWED LEGAL COUNSEL DESCHUTES COUNTY, OREGON U. 93 _ * rt WHEREAS, the Deschutes County Fair Board and Fair Association proposes to site a County fairgrounds on certain real property located southeast of the City of Redmond (fully described in Exhibits "A" and "B" and hereinafter referred to as "subject property"); WHEREAS, on this date under Ordinance 93-058 the Board of County Commissioners for Deschutes County has reconfigured the Redmond Urban Growth Boundary so as to bring the subject property in its entirety within the Redmond Urban Growth Boundary and to change the plan designations of the subject property from Light Industrial and Agriculture to Fairgrounds to accommodate the proposed fairgrounds; and WHEREAS, the underlying zoning of the subject property is currently Light Industrial (M-1) on one portion of the property and Exclusive Farm Use - Alfalfa Subzone (EFU-AL) on the remainder as set forth in Exhibit "C," and it is necessary to change the zoning of the subject property to accommodate the proposed fairgrounds and to be consistent with the revised plan designations adopted on this date; and WHEREAS, public hearings have been held on the zone changes consistent with state and county law; and WHEREAS, the Redmond Urban Area Planning Commission recommended adoption of the amendments as proposed; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY ORDAINS as follows: Section 1. ADOPTION OF CHANGES TO REDMOND URBAN AREA ZONING MAP. That Ordinance No. 80-201, the Redmond Urban Area Zone Map, as amended, is further amended to change the underlying zone designation on the subject property as described in the legal description attached hereto as Exhibit "A" and by this reference incorporated herein and by the map attached hereto as Exhibit "B" and by this reference incorporated herein, from Light Industrial, M-1, (under the Redmond Urban Area Zoning Ordinance) and Exclusive Farm Use, EFU-AL, (under the Deschutes County Zoning Ordinance) to Fairgrounds, F -G, (under the Redmond Urban Area Zoning Ordinance. 1 - ORDINANCE NO. 93-058 ,! +101, 1993 Section 2. FINDINGS. In support of its decision, the Board adopts the findings and recommendations of the Redmond Urban Area Planning Commission, attached as Exhibit "E" to Deschutes County Ordinance No. 93-058 adopted on this date and incorporated herein by this reference. Section 3. REPEAL OF ORDINANCES AS AFFECTING EXISTING LIABILITIES. The repeal, express or implied, of any ordinance, ordinance provision, code section, or any map or any line on a map incorporated therein by reference, by this amending ordinance shall not release or extinguish any duty, condition, penalty, forfeiture, or liability previously incurred under such ordinance, unless a provision of this amending ordinance shall so expressly provide, and such ordinance repealed shall be treated as still remaining in force for the purpose of sustaining any proper action or prosecution for the enforcement of such duty, condition, penalty, forfeiture, or liability, and for the purpose of authorizing the prosecution, conviction and punishment of the person or persons who previously violated the repealed ordinance. Section 4. SEVERABILITY. The provisions of this ordinance are severable. If any section, sentence, clause, or phrase of this ordinance or any exhibit thereto is adjudged to be invalid by a court of competent jurisdiction that decision shall not affect the validity of the remaining portions of this ordinance or exhibit thereto. Section 5. CORRECTIONS. This ordinance may be corrected by order of the Board of County Commissioners to cure editorial and clerical errors and to insert appropriate legislative history references. Section 6. EMERGENCY. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
