1994-02621-Resolution No. 94-001 Recorded 1/19/199494-02F21 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES REVIEWED - q-, LEggOUNSEL COUNTY,OREGON RESOLUTION NO. 94-001 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon has determined that a three-year serial levy should be submitted to the qualified voters of the County outside the tax base as established by Article XI, Section 11, Oregon Constitution, in order to permit the proper operation of Deschutes County Sheriff's Department; and WHEREAS, the Board makes findings, in accordance with Chapter 4.32, Deschutes County Code, set forth in Exhibit A, attached hereto and by this reference incorporated herein, in support of a split levy with $1,988,500 levied each year for three years within the incorporated cities, Black Butte Ranch Service District and Sunriver, and $2,861,500 be levied each year for three years in the remaining unincorporated Deschutes County, Oregon; and WHEREAS, it is necessary to submit the question of authorizing a three-year serial levy to the legal voters of Deschutes County, Oregon; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. Date of Election. The measure set forth in Section 2 of this Resolution shall be submitted in the manner prescribed herein to the qualified voters of Deschutes County, Oregon, at a special election to be held March 22, 1994. At the serial levy election, there shall be submitted to the legal voters of Deschutes County, Oregon, for their approval or rejection, the following measure: CAPTION: SHERIFF THREE-YEAR SPLIT SERIAL LEVY. QUESTION: Shall County levy $4,850,000 each year for three years beginning 1994/95 outside tax base for Sheriff services using split levy? SUMMARY: Sheriff split serial levy will levy $1,988,500 each year for three years within incorporated cities, Black Butte Ranch Service District and Sunriver. These areas fund local patrol services. $2,861,500 each year for three years will be levied in the remaining area of Deschutes County. Difference in the levy amount is the cost of rural Sheriff patrols. Current Sheriff's serial levy ends on June 30, 1994. New levy will increase jail capacity from 54 to 150 inmates. Ten new patrol deputies will be added. Split levy will provide dedicated patrols in rural areas. Funds DARE anti-drug school program. Funds traffic safety team, emergency services, animal control and drug enforcement. Continues special program for arson and murder. Total amount raised by three-year serial levy for Sheriff operations is $14,550,000. This amount of proposed taxes are outside limitation imposed by Section 11, Article XI, Oregon Constitution. Sheriff will continue to receive funds from general fund. This levy will not reduce the property tax collections of other local governments under Section 11(b), Article XI, Oregon Constitution. The revenues raised will be used exclusively for County Sheriff purposes. Section 3. Findings. In accordance with Deschutes County Code Chapter 4.32, the Board hereby adopts the Findings of Fact set forth in Exhibit A, attached hereto and by this reference incorporated herein. Section 4. Deschutes County Sheriff patrol services are not provided within incorporated cities, Black Butte Ranch Service District and Sunriver because these areas are patrolled by local agency patrols utilizing non -county sworn police officers paid by the local agency. The level and types of services provided outside these areas is significantly different because the remainder of Deschutes County is served with peace officer patrol services provided by the Deschutes County Sheriff. The overall cost of providing sheriff services within incorporated cities, Black Butte Ranch Service District and Sunriver is substantially less than the cost of providing services in the remainder of unincorporated Deschutes County, Oregon. The areas where there is a difference are easily identified because the areas receiving patrol services from non -county peace officers are within the limits of Bend, Redmond and Sisters, the boundary of the Black Butte Ranch Service District and Sunriver as defined in Chapter 4.32, Deschutes County Code. Only in the remainder of the county are sheriff patrols routinely provided. If sheriff patrol officers respond within incorporated cities, Black Butte Ranch Service District or Sunriver, the response is in accordance to a request for service, and in the role as back-up, as mutual aid, or when specialized expertise is required. The sheriff patrol response within incorporated cities, Black Butte Ranch Service District and Sunriver is similar to the mutual response arrangements for fire and ambulance services from separate districts. The difference in cost of providing services within the incorporated cities, Black Butte Ranch Service District and Sunriver and the remaining rural areas is $1,378,000 per year based upon the Sheriff's budget. This results in a distribution of rural patrol costs plus one- half of the remaining department budget, or 59 percent of the overall department budget, to the area of Deschutes County outside the incorporated cities, Black Butte Ranch Service District and Sunriver. This percentage, when applied to the levy of $4,850,000 results in a levy of $2,861,500 for the portion of the county outside the incorporated cities, Black Butte Ranch Service District and Sunriver. The attached "Sheriff's Split Levy" budget sheet sets forth the estimated three-year operating budget based upon a split levy.
