ORDER NO. 94-015 0125-1406
WHEREAS, the Board of County Commissioners of Deschutes County,
Oregon, has held a hearing in accordance with law fixing the
assessments of improvements benefiting certain real property in 73rd
Street L.I.D. in Deschutes County, Oregon; and
WHEREAS, there were remonstrances to the proposed
assessments relating to said property; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. The assessments for road improvements in 73rd
Street L.I.D. are hereby certified in accordance with Exhibit "A",
attached hereto and by this reference incorporated herein. The
assessment so certified is listed as "actual cost" in Exhibit "A".
Section 2. That the rate of interest to be charged on unpaid
assessments for which financing requests are filed with the Board of
County Commissioners, and for assessments for which financing
requests are not filed and remain unpaid more than thirty (30) days
from the date of assessment, shall be nine percent (99,5) per annum.
Section 3. That the Director of Public Works shall mail on or
before February 9, 1994, notices of the assessments as fixed by this
Order to owners of the said property with an application to finance
the improvements in not more than 20 semi-annual installments. The
notice of assessment shall substantially comply with Exhibit "B",
attached hereto and by this reference incorporated herein. The
application to finance improvements shall substantially comply with
Exhibit "C", attached hereto and by this reference incorporated
herein.

The Board of County Commissioners of Deschutes County,
Oregon, at its regular meeting on January 26, 1994,
adopted Order No. 94-015, assessing the following
described property for road improvements. Upon failure
of owners to make application to pay the assessments in
installments by March 10, 1994, or upon failure of the
owner to pay the assessment in full by March 10, 1994,
interest will commence and run at the rate of nine
percent (90) per year, and the property assessed will be
subject to foreclosure.
Section 5. The County Clerk shall, upon the filing of this Order,
record and index it upon the lien docket of Deschutes County known as
Assessment District Liens.

NOTICE OF ROAD IMPROVEMENT ASSESSMENT
(BANCROFT BONDING ACT, ORS 223.205 TO 223.300)

Amount of Assessment: $4,330.21
The Board of County Commissioners of Deschutes County, Oregon
adopted Order No. 94-015, certifying the above assessment on
the above-described property on January 26, 1994, for road
improvements benefiting said property.
Upon failure of the owner of the property assessed to make
application to pay the assessment in installments by March
10, 1994, interest will commence to run on the assessment at a
rate of nine percent (9%) per year, and the property assessed
will be subject to foreclosure if the total amount of the
assessment remains unpaid.
If you wish to pay in installments, you must fill out the
enclosed application listing your name and address. You must
then sign the application and mail it to the Director of
Public Works, Deschutes County Public Works Department, 61150
SE 27th Street, Bend, Oregon 97702, no later than March 10,
1994. You will be sent information regarding your payments
from the Deschutes County Treasurer.
If you wish to pay the full amount, you must do so on or
before March 10, 1994. Payment is to be made to the Deschutes
County Treasurer, Deschutes County Courthouse, Bend, Oregon
97701.

APPLICATION TO FINANCE IMPROVEMENT FOR
73RD STREET LOCAL IMPROVEMENT DISTRICT
(BANCROFT BONDING ACT, ORS 223.205 TO 223.300)
TO THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
Pursuant to the provisions of the Act of the Legislature of the State of
Oregon, known as the "Bancroft Bonding Act", (ORS 223.205 to 223.300, as
amended), applicant makes application to finance the portion of the cost of
the road improvement levied against applicant's property and being part of
the improvement of roads in unincorporated Deschutes County, Oregon, as the
same has been determined and assessed by the Board of County Commissioners
of Deschutes County, Oregon, and Order No. 94-015, and docketed upon the
Docket of Assessment District Liens of Deschutes County, Oregon.
The applicant and property owner of the property described below does
hereby waive all irregularities or defects, jurisdictional or otherwise,
in the proceedings to cause said improvement to be constructed or made for
which the assessment is levied, and in the apportionment and assessment of
the cost thereof, and acknowledges that applicant is indebted and the
property legally charged with the assessment.
Applicant agrees to pay the assessment in twenty (20) or fewer semi-annual
installments, together with interest at nine percent (90) per annum on all
unpaid assessments. The interest shall be paid semiannually in addition to
and at the time each principal payment is made.
The installments shall be due and payable on the 1st day of April, 1994,
the first day of October, 1994, and thereafter on the 1st day of April and
the 1st day of October in subsequent years.
