An Ordinance Amending the Bend Urban
Area General Plan to Adopt Policies
Regarding the Designation of Extensions
to the 27th Street and 18th Urban Minor
Arterials and Declaring an Emergency.
ORDINANCE NO. 94-015
WHEREAS, the Transportation Plan Map of the Bend Urban Area Plan
is being amended concurrently by Ordinance 94-012 to designate
extensions to existing designated urban minor arterials known as 18th
Street and 27th Street; and
WHEREAS, the Board of County Commissioners finds that the public
interest requires that such designations be made with certain
limiting conditions and that a text amendment to the Bend Urban Area
General Plan is appropriate for the expression of such conditions;
and
WHEREAS, the Board of County Commissioners has considered the
recommendations of the Planning Commission and the public in regards
to these plan policies; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
ORDAINS AS FOLLOWS:
Section 1. The text of the Transportation Circulation Element
of the Bend Urban Area General Plan, as amended, is further amended
to add a new policy provision as follows:
"32. The designation of the 27th Street extension and the 18th
Street extension as urban minor arterials in County
Ordinance 94-012 to the transportation map of this plan are
conditioned as follows:
(a) As urban minor arterials, these roadways are viewed as
being commuter routes. They are not intended to
become a part of a bypass system to facilitate passage
of non -local traffic, such as truck traffic, around
the core of the urban area.
(b) The County shall take such action as may be possible
to further recognition and use of the 27th Street
extension and 18th Street extension as local commuter
routes, consistent with their designation as urban
minor arterials, including signage, load limitations
and recommended speed limits.

(c) No access shall be granted to the 27th Street
extension from the tract currently occupied by the
U.S. Forest Service nursery and generally described as
the NE 1/4 of Section 22 of Township 17 S., Range 12
E.W.M.
(d) The remaining portion of the park parcel currently
owned and occupied by the Bend Metro Parks and
Recreation District lying between the 27th Street
extension and the Nasu Loop subdivision shall not be
used for any use other than for park or open space
purposes."
Section 2. Findings. The Board of County Commissioners adopts
as its findings in support of this ordinance the staff reports of the
County Public Works Department and Planning Division attached as
exhibits to Ordinance 94-012 and by this reference incorporated
herein.
Section 3. Severability. The provisions of this ordinance are
severable. If any section, sentence, clause, phrase, area, overlay
or other separable part of this ordinance or any exhibit thereto is
adjudged to be invalid by a court of competent jurisdiction, that
decision shall not affect the validity of the remaining portions of
this ordinance or any exhibit thereto.
Section 4. Emergency. This Ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this Ordinance takes effect on
its enactment.
