1994-10674-Minutes for Meeting December 22,1993 Recorded 3/15/199494-10674 0129-0024 MINUTES DESCHUTES COUNTY BOARD OF COMMISSIONERS 2 3 December 22, 1993 Chair Throop called the meeting to order at 10:05 a.m. Board members in attendance were Tom Throop, Nancy Pope Schlangen, and Barry Slaughter. Also in attendance were Brad Chalfant, Property Manager; Bruce White, Assistant Legal Counsel; Rick Isham, Legal Counsel; Kevin Harrison, Planner; Sue Stoneman, Support Services Manager; Florence Torrigino, Health Department Director; and Dave Leslie, Planner. 1. CONSENT AGENDA: Consent agenda items before the Board of Commissioners were 1) acceptance of warranty deed Hynes/Oelkers right-of-way acquisition on Powers Road; 2) appointment of Kathleen Boni, James Mann, Stuart Garrett, Jeff Robberson, Ken Wilhelm, Susan Shepardson, Sue Hollern, Calvin Krosch, Ruth Wahl, and Walter Rietz to the Deschutes County Commission on Children & Families; 3) appointment of Dr. Patrick O'Rourke to the Deschutes County Library Board of Directors; 4) Reappointment of Vernetta Minton to the Lazy River Special Road District Board of Directors; 5) Appointment of Kit Osborn to the Redmond Airport Commission; and 6 ) Signature of final plat for the Courtyards at Broken Top. PUBLIC HEARING: ON ORDER NO. 93-226, WESTLUND ANNEXATION INTO RFPD #2 Before the Board was a public hearing on Order No. 93-226, Westlund Annexation into RFPD #2. Bruce White reported receiving a petition from the landowners to annex into RFPD #2 and withdraw from RFPD #1. Both of the fire districts had signed off on this item. No objections have been received regarding this matter. Chair Throop opened the public hearing. There being no testimony, the public hearing was closed. Brad Chalfant asked the Board to approve this order subject to review as the legal description was not yet complete. SCHLANGEN: I will move signature of Order No. 93-236, subject to review. APPROVAL OF INTERAGENCY AGREEMENT WITH OREGON HEALTH DIVISION FOR DESCHUTES COUNTY IMMUNIZATION ACTION PLANNING Before the Board was approval of an Interagency Agreement with Oregon Health Division for Deschutes County immunization action planning. Florence Torrigino, Health Department Director, reported this was additional revenue to the Health Department in the amount of $20,000 to put together an action plan for immunization. VOTE: SCHLANGEN: YES SLAUGHTER: YES THROOP: YES DECISION: ON PLAN AMENDMENT AND ZONE CHANGE AT DESCHUTES JUNCTION FOR THE FAGENS Commissioner Slaughter stated he did not want to see another rural service center so close to Bend. He felt the junction was an unsafe area. Commissioner Throop stated there was only .6 of an acre remaining of the rural service center. This is a nonconforming use. He felt the intersection on Highway 97 was the most dangerous place in Deschutes County and would be the last place he would want to see development occur. He felt there were adequate public facilities and commercial services located in that area. He supported the staff recommendations and the Hearings Officer's decision. Commissioner Schlangen felt the zone change and exception were not called for or in the best interest of the public. She stated the road and intersection were not safe for additional traffic. VOTE: SCHLANGEN: YES SLAUGHTER: YES THROOP: YES SIGNATURE OF LETTER FROM CITY/COUNTY TO DEPARTMENT OF TRANSPORTATION Chair Throop reported there was a letter being drafted by the City of Bend to the Department of Transportation for signature by Bend City Commissioners and Deschutes County Commissioners in regards to the Parkway project. He requested an approval subject to review as he knew the Board of County Commissioner had not yet had a chance to review the letter.
