Also in attendance were Rick Isham, County Counsel; Larry Rice, Public Works Director; Greg Brown, Sheriff's Department; Florence Torrigino, Health Department Director; Stacy Warren, Planner; George Read, Planning Director; Mike Maier, County Administrator; Frank Moore, Mental Health Director; Darrell Davidson, Sheriff; and Franz Rulofson, 4-H/Extension Service District. 1. CONSENT AGENDA: Consent agenda items before the Board of Commissioners were 1) signature of sublease agreement for Divorce Mediation Office on Rosie Bareis Campus; 2) signature of Intergovernmental Agreement with the Mental Health and Developmental Disability Services Division; 3) approval of the addition of two Mental Health Specialist II's to the Child & Family Team; 4) signature of Indemnity Agreement for LaPine Chamber of Commerce Annual Tree Lighting Event; 5 ) signature of Order NO. 93-221, declaring the result of the Special Election held November 3, 1993, on Deschutes County Room Tax Ordinance; 6) signature of mylar for Hayden Village, Phase 7 & 8; and 7 ) signature of final plat for MJP-92-4 for David & Annette Farnsworth, a partition to divide a 31.16 acre parcel into three parcels in an UAR-10 Zone. DECISION ON AN APPEAL OF HEARINGS OFFICERS DENIAL OF A TENTATIVE PLAT TP -93-815 AND CU -93-86 FOR PATRICK GISLER Before the Board was an appeal of the Hearings Officers denial of a tentative plat TP -93-815 and CU -93-86 for Patrick Gisler. Stacy Warren reported this was a request for a tentative plat for 142 -lot subdivision and a conditional use permit for 76 multi -family units on a currently unzoned 40 -acre parcel. The Hearings Officer denied the applicants proposal based on insufficient evidence to demonstrate that the proposed subdivision would be served by an approved community municipal water or public water system or sewer system. 1 3. 0129-0050 Commissioner Slaughter stated he had received a letter stating there was a need for more low income housing in the area. He felt there was a need for duplexes, apartments and/or low income housing. He felt the applicant had met most of the requirements. Commissioner Throop stated he felt there were three primary issues with this application, which was sewer, water and transportation access. He felt the applicant had supplemented the record sufficiently regarding the sewer by providing a letter from the sewer district saying they would provide service to the development. He felt the water issue had also been supplemented. Commissioner Throop felt that prior to getting a final plat approval the applicant would need to have a Water Right from the State Water Resources Department for a water permit and a guaranteed method of delivering water to the subdivision. Commissioner Throop reported that there had not been a transportation access study and one was not required. He would support approving the application. Commissioner Schlangen felt the deficiencies were addressed at the public hearing. She felt the Hearings Officer's decision should be overturned. Commissioner Throop asked if the applicant would be willing to participate in a turn lane on Huntington Road at the point that traffic studies indicate the need. Dan Van Vactor, representing Patrick Gisler, stated the applicant would be willing to commit to the turn lane under the circumstances described. SCHLANGEN: I move approval of this application which includes the conditions in the staff report and the addendum to the staff report plus language on a left turn lane. SLAUGHTER: Second. VOTE: SCHLANGEN: YES SLAUGHTER: YES THROOP: YES UPDATE TO BOARD ON LA PINE SERVICES Various Department Heads updated the Board on Deschutes County services that are offered to the La Pine community. Brad Chalfant reported the restrictive covenants are to give guidance and provide the orderly growth of the La Pine Industrial Park. VOTE: SCHLANGEN: YES SLAUGHTER: YES THROOP: YES APPROVAL OF PROCLAMATION CLAIMING DECEMBER 1 OF EACH YEAR AS WORLD AIDS DAY Before the Board was a proclamation claiming December 1 of each year as World AIDS day. SLAUGHTER: I move that Deschutes County declare December 1 of each year as World AIDS Day. SCHLANGEN: I'll second that motion. VOTE: SCHLANGEN: YES SLAUGHTER: YES THROOP: YES SIGNATURE OF FINAL PLAT FOR HEALY MEADOWS Before the Board was signature of final plat for Healy Meadows. Commissioner Schlangen reported this was a project that will be located east of the City of Bend. It is a three building project. One building is for low income renters, one for transitional housing until a person can find rental housing and the third building will house a resource center. Commissioner Schlangen requested the Board approve the plat upon review as the plat is not ready yet. SCHLANGEN: I move signature of final plat for Healy Meadows upon review. SLAUGHTER: Second. APPROVAL OF WEEKLY ACCOUNTS PAYABLE VOUCHERS Before the Board was approval of weekly accounts payable vouchers in the amount of $136,548.63. DISCUSSION OF KNOTT LANDFILL CLOSURE TIMELINE Larry Rice, Public Works Director, reported there would be a meeting on Wednesday, December 8, 1993, at 3:00 p.m. with Department of Environmental Quality to discuss the life left in Knott Landfill. After meeting with the DEQ, Larry Rice stated he will receive a determination from them as to what the County must do. It would be two weeks before the determination would be received by the County. He also informed the Board that a final report would be compiled and available at the January 25, 1994 meeting. Larry felt there were three options, which are keep the landfill where it is, get an in -region landfill or export. 9. APPOINTMENT OF MIKE SWOPE TO THE DESCHUTES RIVER RECREATION HOMESITES UNIT #6 SPECIAL ROAD DISTRICT Before the Board was appointment of Mike Swope to the Deschutes River Recreation Homesites Unit #6 Special Road District.
