RESOLUTION NO. 94-051
WHEREAS, ORS 275.100 provides that the Board of County
Commissioner declare its intention to exchange an interest in land
by proper resolution; and
WHEREAS, a hearing shall be held for the purpose of receiving
objections to the proposed exchange of interest in land; and
WHEREAS, Deschutes County intends to exchange an interest in
land with Trinity Evangelical Lutheran Church of Bend; now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That Deschutes County intends to transfer an
interest in the real property described below:
A parcel of land containing 3.95 acres, situated in the
NE4 SE -1 of Section 22, T. 17 S., R. 12 E., W. M.,
Deschutes County, Oregon and described as follows:
Commencing at the EJ Corner of Section 22; THENCE along the
East Line of Section 22, S 0002'53" W 777.58 feet to the
North Line of Butler Market Road and 40 feet from the center
thereof; THENCE along said North Line, S 46056112" W 100.76
feet to the POINT OF BEGINNING, a #5 steel rod; THENCE
continuing along said North Line, S 4605611211 W 253.23 feet to
a point; THENCE continuing along said North Line, 181.98 feet
along the arc of an 1105.92 -foot radius curve, the chord of
which bears S 51014143" W 181.75 feet to a point; THENCE N
00003'27" E 873.90 feet to a point; THENCE 569.71 feet along
the arc of an 859.9 -foot radius curve, the chord of which
bears S 32012133" E 559.34 feet to a point; THENCE S 13013'45"
E 117.35 feet to the Point of Beginning.
The interest in land to be transferred by Trinity Evangelical
Lutheran Church of Bend, pertains to the real property described
below:

BEGINNING AT A POINT, a #5 plastic -capped steel rod set
along the E -W C4 Line of Section 22, from which the El
Corner thereof bears N 89°58118" E 400.00 feet; THENCE S
00003'27" W 259.62 feet to a point; THENCE 216.97 feet
along the arc of an 859.9 -foot radius curve, the chord of
which bears N 51°14143" W 216.39 feet to a point; THENCE
N 65038'45" W 444.80 feet to a point along the South Line
of the NUID Main Canal; THENCE along said South Line, N
78021'27" E 445.57 feet to a point; THENCE continuing
along said South Line, 78.93 feet along the arc of a
480.3 -foot radius curve, the chord of which bears N
84003155" E 78.84 feet to a point; THENCE continuing
along said South Line, N 88043128" E 74.55 feet to a
point; THENCE S 00016151" W 128.99 feet to the Point of
Beginning.
Section 2. A hearing for the purpose of receiving objections
to the above described exchange will be held at 10:00 a.m. on
Wednesday June 29, 1994, at the Deschutes County Juvenile Justice
Building, 1128 NW Harriman, Bend, Oregon.
Section 3. That the Clerk of the County Court shall give
notice of the time and place for the hearing set in Section 2 of
this Resolution by publication of the notice marked Exhibit "A,"
attached hereto and by this reference incorporated herein, in "The
Bulletin" once each week for four consecutive weeks prior to the
date of such hearing.

The property interest being transferred by Deschutes County
consists of a right of reversion on a portion of the real property
held by Bend Metro Park and Recreation District and now known as
Canal Park on Butler Market Road in Bend.
The property interest being transferred to Deschutes County
consists of a right of reversion on property being acquired by Bend
Metro Park and Recreation District adjacent to Canal Park in Bend.
Any person may appear and make objections to the proposed
exchange.
