ORDINANCE NO. 94-006 WHEREAS, the Land Conservation and Development Commission issued Remand Order 93 -RA -883, requiring Deschutes County to, inter alia, amend the Deschutes County Comprehensive Plan to adopt a Goal 5 "1B" policy for historic resources, to complete the Goal 5 process for two significant sites and to adopt policies ensuring preservation of sites; and WHEREAS, the Deschutes County Historical Landmarks Commission has conducted a public hearing on the proposed amendments and has made a recommendation to the Board of County Commissioners and the Board of County Commissioners conducted a public hearing on the proposed amendments; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. ADDITION OF HISTORIC SITE TO HISTORIC INVENTORY. That the inventory of historic sites in the Resource Element of the Deschutes County Comprehensive Plan, as adopted by Ordinance 92-018 in Exhibit B, be amended to add the Fall River Fish Hatchery Ice House as set forth herein in Exhibit A, attached hereto and by this reference incorporated herein. Section 2. AMENDMENT OF LIST OF HISTORIC SITES WITH INSUFFICIENT INFORMATION. That the list of sites identified as having insufficient information in the Resource Element of the Deschutes County Comprehensive Plan, as adopted by Ordinance 92-018 in Exhibit C, be repealed and replaced with the list set forth herein in Exhibit B, attached hereto and by this reference incorporated herein. Section 3. ADOPTION OF COMPREHENSIVE PLAN POLICY FOR SITES WITH INSUFFICIENT INFORMATION. That the Historic and Cultural section of the Deschutes County Year 2000 Comprehensive Plan be amended to add as a new policy the policy set forth in Exhibit C, attached hereto and by this reference incorporated herein. Section 5. FINDINGS. The Board of County Commissioners adopts as its findings and conclusions in support of the policies and amendments set forth herein the Findings attached as Exhibit "D" and incorporated herein by reference. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. PAGE 1 OF 1 - EXHIBIT C TO ORDINANCE NO. 94-006 0135-2120 Exhibit D FINDINGS OF BOARD OF COUNTY COMMISSIONERS SUPPORTING ADDITION OF SITE TO HISTORIC INVENTORY, REVISING LIST OF 1B SITES AND ADOPTION OF 1-B HISTORIC SITE POLICY Procedural Background On March 18, 1992, the Board of County Commissioners adopted Ordinance 92-018, an inventory of Privately Owned Goal 5 Historic Resources. At that time, nineteen (19) sites were listed in Exhibit "C" to Ordinance 92-018 as sites with insufficient information to proceed under Goal 5 (1A). On June 10, 1993, the Land Conservation and Development Commission issued Remand Order 93 -RA -883 requiring Deschutes County to adopt a 111B" policy for those sites. In 1992, the Deschutes County Historical Landmarks Commission reviewed the nineteen (19) sites. The project was conducted under a grant from the State Historic Preservation Office and complied with Goal 5 and the County's Historic Preservation ordinance, codified as Chapter 2.28 of the Deschutes County Code. The commission considered resources individually, selecting sites for survey, but rejecting those with no extant resource, those altered significantly to compromise their integrity, or those lacking locational data. Sites selected for survey were researched by Commission members and staff. Evaluations and updates further eliminated sites. One site, Fall River Fish Hatchery 'Ice House' , was found to be significant (1C) , fourteen (14 ) sites were found not significant (1A) and four (4) sites were found still to have insufficient information (1B), requiring additional research and evaluation to determine significance. Addition of Fall River Hatchery Ice House to Inventory After investigating the site, a Staff Report on the Fall River Fish Hatchery 'Ice House' was prepared. On March 26, 1992, the Commission rated the site in accordance with Goal 5 as provided under Chapter 2.28 of the Deschutes County code, finding it significant with a rating of 37.5. A public hearing was held on June 25, 1992. The hearing was continued to August 27, 1992 at which time the Landmarks Commission took the further step of adopting a conflicts and ESEE analysis for the site and recommending that it receive protection under the County's Historic Preservation Ordinance. Insignificant Sites The Goal 5 Rule requires that only those "significant" historic sites be placed on the county's historic inventory. The Commission determined that fourteen (14) sites were not significant (1A) and that no further consideration of the sites was necessary. The Goal 5 process may be deferred on sites with insufficient information as to quantity, quality or location to be placed on the inventory until enough information has been developed to determine whether or not each such site is significant. These sites are as follows: Tumalo Grange Terrebonne Grange Central Oregon Irrigation District Rock 0' the Range Bridge These sites will be researched and reviewed by the Landmarks Commission during the 1994-95 State Historic Preservation office grant period ending August 31, 1995.
