ORDINANCE NO. 94-030 - !•�
WHEREAS, the Land Conservation and Development Commission issued
Remand Order 93 -RA -883, requiring Deschutes County to, inter alia,
amend the Deschutes County Comprehensive Plan to complete the Goal 5
process for certain inventoried sites and to adopt policies ensuring
preservation of certain sites; and
WHEREAS, the Deschutes County Historical Landmarks Commission has
conducted a public hearing on proposed amendments to accomplish those
purposes and has made a recommendation to the Board of County
Commissioners and the Board of County Commissioners conducted a public
hearing on the proposed amendments; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. ADOPTION OF ZONING ORDINANCE PROVISION. That Chapter
18.116, Supplementary Provisions, of Title 18 of the Deschutes County
Code, be amended to add a new provision as set forth in Exhibit A,
attached hereto and by this reference incorporated herein.
Section 2. FINDINGS. The Board of County Commissioners adopts as
its findings and conclusions in support of this ordinance the findings
set forth in Exhibit B, attached hereto and by this reference
incorporated herein.
Section 3. EMERGENCY. This Ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this Ordinance takes effect on its
passage.

Section 18.116.240 Protection of Historic Sites
Historic sites listed and described on the county's Goal 5
inventory, contained in the Resource Element of the comprehensive plan,
shall be protected or not protected in accordance with programs set
forth in the ESEE determinations for each individual site, adopted as
part of the Resource Element of the comprehensive plan and any
comprehensive plan policies specifically applicable to the site. The
uses allowed and dimensional standards prescribed by the underlying
zoning designations for designated historic sites are not otherwise
affected by the historic designation.
