Assess Properties Benefitted Thereby.
RESOLUTION NO. 94-094
WHEREAS, on April 20, 1994, the Board of County Commissioners
(Board) of Deschutes County, Oregon, initiated, by Resolution No. 94-
039, the improvement of certain dedicated public roads known as Buffalo
Drive, Mountain View Road, Appaloosa Drive, Palomino Drive, Cayuse
Drive, Sorrel Drive, Pinto Drive, Longhorn Drive and Mustang Drive
(hereinafter referred to as "the improvements") in Deschutes County,
Oregon; and
WHEREAS, said resolution was referred to the County Engineer,
who in a report to the Board: investigated the proposed improvements;
estimated the cost of the improvements; determined which properties
were specially benefitted; fixed the boundaries of the local
improvement district; determined a method of apportioning assessments
amongst benefitted properties; prepared a cost estimate of the proposed
improvement; and estimated the amount of the assessment on all
specially benefitted properties, all in accordance with Chapter 12.48
of the County Code; and
WHEREAS, said Engineer's report was accepted by the Board
pursuant to Order 94-074; and
WHEREAS, pursuant to said Order 94-074 and Chapter 12.48 of the
County Code, notice was mailed to benefitted property owners; and
WHEREAS, a hearing on the proposed improvements was held on June
1, 1994, at the Deschutes County Juvenile Justice Center, Hearing Room
A, Bend, for the purpose of hearing testimony and remonstrances related
to said proposed improvements; and
WHEREAS, after notice to benefitted property owners, a second
hearing was held on June 15, 1994 on the proposed improvements; and
WHEREAS, after considering the testimony, the Board finds for
the reasons set forth in the Engineer's Report and the Engineer's
supplemental testimony that the properties to be assessed would be
specially benefitted by the proposed improvements and that the
assessments would be spread amongst the specially benefitting
properties in an equitable manner and that the requirements of Chapter
18.48 otherwise have or can be met; and

WHEREAS, 31 objections were filed with the Board regarding said
proposed improvements, which objections fall short of the number
required to stop the proposed improvements; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
RESOLVES as follows:
Section 1. To improve by contract certain dedicated public
roads known as Buffalo Drive, Mountain View Road (from its beginning at
the end of Vista Ridge Drive to its intersection with Buffalo Drive),
Appaloosa Drive, Palomino Drive, Cayuse Drive, Sorrel Drive, Pinto
Drive, Longhorn Drive and Mustang Drive, all as shown on Exhibit 2 to
the Engineer's Report (dated May 9, 1994) and incorporated herein by
this reference (hereinafter referred to as "the improvements"), to
Deschutes County local road standards in conformance with the scope of
work as set forth in said Engineer's report, incorporated herein by
this reference.
Section 2. To finance said improvements by levying an
assessment against properties specially benefitted by the proposed
improvements.
Section 3. That the boundaries of the local improvement
district shall be as set forth in the map accompanying said Engineer's
Report at Exhibit 2; that the benefitted properties have been
determined to be as listed in said Engineer's report and shown on said
Exhibit 2 map and as listed in Exhibit 1 attached hereto and by this
reference incorporated herein; and that the method of apportioning the
costs of the improvements amongst the benefitted properties shall be as
set forth in said Engineer's report.
Section 4. That steps not be taken to commence said
improvements until a period of at least 60 days passes from the mailing
of notice to owners of benefitted property.
Section 5. That this resolution constitutes notice that the
properties described in Exhibit 1 to this resolution will be subject in
the future to a lien of the assessment for the cost of the improvements
in amounts currently estimated as set forth on Exhibit 1 to this
resolution and finally to be determined later, after completion of the
improvements, by order or resolution of the Board of County
Commissioners.
Section 6. That the assessment for the proposed local
improvements described herein are characterized as "assessments for
local improvements," as that term is used in section llb of Article XI
of the Oregon Constitution (Ballot Measure 5) and are not intended to
be subject to the limitations of said Ballot Measure 5.

proceed with the construction of the proposed improvements, of its
intent to impose an assessment for said improvements, and of its intent
to characterize the assessment against benefitted properties as an
"assessment for local improvements" for purposes of section 11b,
Article XI of the Oregon Constitution.
Section 8. That the County Clerk shall endorse upon the
resolution the date of the filing thereof, and shall record and index
the same in the appropriate lien docket in the office of the County
Clerk.

AND CHARACTERIZATION OF PROPOSED ASSESSMENTS AS NOT SUBJECT TO
SECTION llb, ARTICLE XI OF THE OREGON CONSTITUTION
(BALLOT MEASURE 5)

Having heard testimony and objections on June 1, 1994 and on June
15, 1994 on the proposed Squaw Creek Canyon Recreational Estates LID
and pursuant to Chapter 12.48 of the Deschutes County Code, the Board
of County Commissioners has entered its Resolution 94-094, dated on or
about August 17, 1994, to proceed, subject to Chapter 12.48 of the
Deschutes County Code, with certain local improvements to improve the
following dedicated public road segments: Buffalo Drive (from Wilt
Road to Mountain View Road), Mountain View Road (from Vista Ridge Drive
to its intersection with Buffalo Drive), Appaloosa Drive, Palomino
Drive, Cayuse Drive, Sorrel Drive, Pinto Drive, Longhorn Drive and
Mustang Drive.
Benefitting lots or parcels include all lots described in the
Squaw Creek Canyon Recreational Estates plat (recorded at Plat Cabinet
A, Page 147), 14 lots from the Squaw Creek Canyon Recreational Estates
First Addition plat ( recorded at Plat Cabinet C, Page 59 ) that abut the
north side of Buffalo Drive, tax lot 14 -10 -24 -DO -6200 (Golick); and tax
lot 14-10-24-5600 (Atkins). After the completion of the improvements,
each benefitting property within the local improvement district,
including the property listed in this notice, will be assessed for its
apportioned share of the improvement costs. The boundaries of the
local improvement district, the list of benefitted properties, and the
method for determining how the final assessments will be apportioned
amongst the benefitted properties are all set forth in Resolution 94-
094.
This notice shall constitute notice of intent of the Board of
County Commissioners to assess the property described herein for its
appropriate share of said improvements, in accordance with the method
approved in Resolution 94-094. The estimated amount of the assessment
for this property is <$0,000>.
This notice shall also serve as notice of the Board's intent to
characterize the proposed assessment, for purposes of Section llb,
Article XI of the Oregon Constitution (Ballot Measure 5), as an
"assessment for local improvements" not subject to the limitations of
said Ballot Measure 5.
Any appeal of decisions embodied in Resolution 94-094 brought
under ORS Chapter 34 and under ORS Chapter 305 must be filed within 60
days of the date of Resolution 94-094. Failure to timely appeal from
