1994-39842-Ordinance No. 94-045 Recorded 10/6/199494-29842 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES REVIEWED Cat" ImE� An Ordinance Amending the Bend Area General Plan Transportation Plan Map and Declaring an Emergency. r, ORDINANCE NO. 94-045 0137-066 7 WHEREAS, The Bend Area General Plan includes" a Transportation Plan Map relating to the transportation facilities in the Bend Urban Area; and WHEREAS, the County Public Works Department applied for a Plan Amendment to make certain changes to the Transportation Plan Map as set forth herein; WHEREAS, the Bend Urban Planning Commission, after review conducted in accordance with applicable law, has recommended approval of the proposed amendments to the Transportation Plan Map of the Bend Area General Plan. WHEREAS, after notice was given and hearing conducted in accordance with applicable law, the Board of County Commissioners has considered the Planning Commission recommendations; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON ORDAINS as follows: Section 1. Adoption of Amendments to Transportation Plan Map. The Transportation Map included as part of the Bend Area General Plan is amended as follows: (1) To realign a collector connection between Brosterhous Road and Murphy Road currently shown on the transportation plan map (as depicted in Exhibit "A" by the letter "A" and labelled "Collector to be deleted") (hereafter referred to as "Current Brosterhous - Reed Market Road collector segment) with a revised collector alignment connecting Brosterhous Road with Reed Market Road (as depicted in Exhibit "A" by the letter "B" and labelled "American Lane collector") (hereafter referred to as "American Lane collector"). (2) To describe an alternative alignment of the existing Brosterhous collector and its intersection with the realigned Brosterhous - Murphy Road collector connector described herein to conform with the configuration shown on Exhibit A and designated therein by the letter "C" and labelled "Alternative Brosterhous Collector Alignment and Intersection." 1 - ORDINANCE NO. 94-045 (October 5, 1994) 1994 97'99 0137"-0668 (3) With respect to existing and planned transportation facilities, this realignment shall have the effect of: (a) Describing and mapping on the transportation plan map a new alignment for the Brosterhous - Murphy Road collector as described herein and deleting the current Brosterhous - Reed Market Road collector segment from the Transportation Plan map; (b) Describing and mapping on the transportation plan map an alternative alignment for the collector described as Brosterhous Road and its intersection with the realigned Brosterhous - Murphy Road collector connector to conform with the description set forth in subsection (2) of this section. (c) Redesignating on the transportation plan map that portion of existing American Lane that coincides with the realigned Brosterhous - Reed Market Road collector segment from a local road functional classification to a collector functional classification. (4) Nothing in this ordinance shall have the effect of removing from the transportation plan map the collector designation from any segment of Brosterhous Road in its current configuration. Section 2. Findings. The Board of County Commissioners adopts as its findings in support of these Plan Map Amendments, the Staff Report of the County Public Works Department attached as Exhibit "B," the memorandum to the Bend Urban Area Planning Commission fromm Public Works dated August 1, 1994, attached as Exhibit "C" and the Addendum to Staff Report attached as Exhibit "D." Section 3. Incorporation of Exhibits. Exhibits "A," "B, "C," and "D" attached hereto are by this reference incorporated herein. Section 4. Severability. The provisions of this ordinance are severable. If any section, sentence, clause or phrase of this ordinance or any exhibit thereto is adjudged to be invalid by a court of competent jurisdiction, that decision shall not affect the validity of the remaining portions of this ordinance or exhibit thereto. Section 5. Codification. County Legal Counsel shall have the authority to format the provisions contained herein in a manner that will integrate them into the County Code consistent with the County Legal Counsel form and style for ordinance codification. Such codification shall include the authority to make such changes, to make changes in numbering systems and to make such numbering changes consistent with interrelated code sections. In addition, as part of codification of these ordinances, County Legal Counsel may insert appropriate legislative history reference. Any legislative history references included herein are not adopted as part of the substance of this ordinance, but are included for administrative convenience and as 2 - ORDINANCE NO. 94-045 (October 5, 1994) 013'7-0669 a reference. They may be changed to correct errors and to conform to proper style without action of the Board of County Commissioners. Section 6. Repeal of Ordinances as Affecting Existing Liabilities. The repeal, express or implied, of any ordinance, ordinance provision, code section, or any map or any line on a map incorporated therein by reference, by this amending ordinance shall not release or extinguish any duty, condition, penalty, forfeiture, or liability previously incurred or that may hereafter be incurred under such ordinance, unless a provision of this amending ordinance shall so expressly provide, and such ordinance repealed shall be treated as still remaining in force for the purpose of sustaining any proper action or prosecution for the enforcement of such duty, condition, penalty, forfeiture, or liability, and for the purpose of authorizing the prosecution, conviction and punishment of the person or persons who previously violated the repealed ordinance. Section 7. Emergency. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. MURPHY RD, Oct. 4, 1994 0137-0671 EXHIBIT "B" A PLAN AMENDMENT APPLICATION Submitted by Deschutes County Public Works Department with the support of the Transportation Advisory Committee and the Concurrence of the City of Bend Planning and Public Works Departments PROPOSAL: TO AMEND THE BEND URBAN AREA GENERAL PLAN BY RE -LOCATING A COLLECTOR STREET SHOWN CONNECTING THE NORTH -SOUTH SEGMENT OF BROSTERHOUS ROAD TO THE SOUTH WITH REED MARKET ROAD TO THE NORTH. THE NEW ALIGNED COLLECTOR WILL UTILIZE THE EXISTING RIGHT OF WAY OF THE NORTH -SOUTH SEGMENT OF AMERICAN LANE AND CONSTRUCT A NEW BRIDGE OVER THE MAIN COI CANAL ON THIS NEW ALIGNMENT TO REPLACE THE EXISTING SUBSTANDARD CANAL BRIDGE. THIS NEW ALIGNED CONNECTOR WILL ELIMINATE A 90 DEGREE CURVE ON AMERICAN LANE AND PROVIDE A CONNECTION WITH BROSTERHOUS ROAD TO THE SOUTH. APPLICANT: Deschutes County Department of Public Works. PROPERTY OWNER: There are two privately owned parcels from which land will have to be acquired for road right-of-way: 1) Property described as T18, R12, S9, TL 2100 located immediately south of the canal adjacent to both American Lane and American Loop is owned by: KBYC, Inc., Company, 1892 Willamette Street, Eugene, Oregon 97401 2) Property described as T18, R12, TL 700 located on the south side of the east -west section of American Lane and the east side of Brosterhous Road is owned by: Lynne L. Perlatti, 52 SE Ninth Street, Bend, Oregon 97701. PROPERTY DESCRIPTION: See the attached location map showing the location of the proposed 60 foot wide right-of-way extending south from Reed Market Road across the Main COI Canal, thence on the current alignment of American Lane to where it makes a 90 degree turn to the west. From this sharp curve, the new right-of-way will make a gentle curve to the west and south to connect with the north south segment of Brosterhous road north of where Rae Road intersects Brosterhous. This new alignment replaces the alignment of a collector shown on the plan that would have extended Brosterhous Road in a direct north -south alignment from were it turns west at American Lane northward to Reed Market Road. BURDEN OF PROOF STATEMENT This proposal to amend the Bend Urban Area Transportation Plan by relocating a north -south running collector from Reed Market Road to Brosterhous Road to a more easterly alignment is being proposed for the following reasons: 1. BRIDGE REPLACEMENT The existing American Lane Bridge over the Main COI 0137-06'72 Canal needs to be replaced soon. The current location of the bridge is not desirable due to the sharp curves in American Lane immediately south of the bridge. The new alignment of the collector will eliminate the curves in the road and put the intersection of American Lane and Reed Market Road farther away from the railroad crossing on Reed Market Road and the intersection of 9th Street and Reed Market Road. This will make the new intersection of American Lane and Reed Market Road potentially safer. 2. MORE NEW ROAD TO CONSTRUCT The replacement of the American Lane Bridge on the alignment of the collector shown on the Bend Urban Area General Plan would force the county and/or City of Bend to Build a half mile of new road to connect the south end of the bridge to Brosterhous Road. The new alignment would not require as much new road to be built to serve the bridge. 3. PURCHASE A BUSINESS The construction of a new bridge to replace the American Lane Bridge on the alignment of the collector shown on the Bend Urban Area General Plan would force the county/public/tax payers to purchase an auto repair business located on the south side of Reed Market Road. This business is located right in the path of where the collector would have to cross the canal to connect with Reed Market Road. 4. CREATE CUL-DE-SAC The construction of a new bridge to replace the American Lane Bridge on the alignment of the collector shown on the Bend urban Area General Plan would place the Reed Market Industrial Area located on American Loop and American Lane in the situation of being a long cul-de-sac. This growing industrial area would only have access from the south once the existing American Lane Bridge was dismantled. 5. UTILIZE EXISTING ROAD The proposed realignment of this north -south running collector utilizes the north -south running segment of American Lane. This road segment is approximately one half mile long, has a 60 foot wide right-of-way and is already a paved road. The alignment of the collector shown on the Plan has no right-of-way or paved road to take use and would thus require the acquisition of more right-of-way and the construction of a greater length of new paved road. 6. ELIMINATE SHARP CURVE The proposed relignment of this north -south running collector would eliminate the current, very undesirable, 90 degree curve on American Lane and replace it with a 0137-0673 modern gentle engineered curve to take the road southwesterly to connect with Brosterhous Road. 7. CITY CONCERN WITH CENTENNIAL The proposed realignment of this north -south running collector would reduce the City of Bend's concern that Centennial Boulevard not be in alignment with this collector at its intersection with Reed Market Road. Centennial Boulevard is a local street to the north of Reed Market Road that the City is trying to protect from through traffic. The City does not want to encourage north -south through traffic to travel on Centennial Boulevard since 9th Street is a north -south arterial street located a short distance to the east. It appears that Centennial Boulevard will intersect Reed Market Road where the Plan now shows the collector from the south also intersecting Reed Market Road. 8. LESS LAND ACQUISITION The proposed realignment of this north -south running collector would require the acquisition of less total land area for public right-of-way and no property with structures. The collector alignment shown on the plan would require a greater amount of right-of-way and the relocation of an existing auto repair business on the south side of Reed Market Road. Thus, the proposed realignment would involve less expenditure for land and structures to obtain road right-of-way. 9. SEQUENTIAL DEVELOPMENT The proposed new alignment allows sequential development of this project by allowing the bridge to be rebuilt and connected to an existing system of roads. The south portion of American Lane below the 90 degree curve could be built at a later time and the widening/overlaying of the existing American Lane to occur at still another time. The collector on the plan would probably have to be built all at once to connect the bridge via a collector road running all the way to Brosterhous. 10. AVOIDS DUPLICATION OF FACILITIES The proposed new alignment of the collector eliminates the need for the parallel collector to the west now shown on the plan from having to be built at all. Why duplicate facilities when American Lane already functions as a collector and would continue to do so even if a collector was built to the west? Why not concentrate as much through traffic as possible on one street? 11. BETTER INTERSECTION ALIGNMENT The proposed new alignment brings the new collector into its intersection with Reed Market Road at a less acute and hence more square angle than is the case of the collector currently shown on the Bend Area General Plan. 0137-0674 12. KEEPS INDUSTRIAL TRAFFIC IN AREA The proposed new alignment would encourage industrial traffic from the Reed Market Industrial Area to use American Lane and thence directly onto Reed Market Road which is an arterial. Why run the traffic over to a parallel collector to the west in an area which is not zoned for industrial use. 13. TOTAL COST The total cost of constructing a collector on the proposed new alignement will be less expensive than constucting a collector on the alignment shown on the Plan for many of the twelve reasons listed earlier. STANDARD AND APPLICABLE CRITERIA: The following criteria may apply: 1. The Bend Area General Plan which establishes goals and policies for land development in the Bend Urban Area. 2. The Deschutes County uniform Development Procedures ordinance which establishes criteria for the land use applications in the county. COMPREHENSIVE PLAN AMENDMENT: To amend the Bend Area General Plan, an applicant must meet the following criteria set forth on page 69 of the Bend Area General Plan: "Plan changes shall be consistent with the goals, objectives, policies, and statements of intent, or these guidelines shall be first changed of amended to reflect new policy. An individual requesting a change shall demonstrate that the change is warrented fue to changed circumstances, a mistake, or other specific facts that demonstrate a public need and benefit for the change." A. The proposed plan chancres will be consistent with goals oblectives, policies and statements of intent of the plan. 1. Applicable Plan Goals and Objectives: (Bend Area General Plan, Page 3). Of the several goals and objectives that served as a framework in the preparation of the Bend Area General Plan, the County believes the following goals and objectives are applicable to this request: 111. To retain and enhance the character and quality of the Bend Area as growth occurs." 114. To recognize and reapect the unusual natural beauty and character of the area so that the feeling of Central Oregon can be retained with the community as growth occurs." 116. To provide a safe and coordinated transportation and circulation system to bring about the best relationships between where people live, work, shop, and play." 0137-0675 "8. To retain and enhance desirable existing areas and to revitalize, rehabilitate, or redevelop less desirable existing areas." 2. Applicable General Policies: (Bend Area General Plan, Pages 4-5). Ahe applicant believes that the following major policies and recommendations are applicable to its request: 113. Future Development and local development standards shall recognize and respect the character of existing areas. Maximum flexibility and development should be encouraged in undeveloped areas." 1110. Street and Highways should be located and constructed in a matter which will accomodate both current and future traffic need, and they should be designed to maintain the character and quality of the areas through which they pass." 1113. Community Appearance shall continue to be a major concern and the subject of a major effort in the area. Street -tree planting and landscaping, sign regulations, and building improvements will all contribute to an improved environment, particulary along Highway 97. Major natural features, such as rock outcrops or stands of trees, should be preserved as a community asset as the area develops. This can be accomplished in subdivisions through careful siting of houses and streets." 3. Transportation Element. The applicant believes the following goals and description in the Transportation Element are applicable: a. Goals. (Transportation Element, Page 1). "To provide a safe, convenient means of movement for people and goods within the urban area." "To recognize and respect the natural features over which streets pass to minimize adverse impacts on those features." DISCUSSION The realignment of the north south collector onto the alignment of American Lane will provide a better crossing of the Main COI Canal than the current bridge located, eliminate a sharp curve immediately south of the bridge, eliminate the 90 degree curve on American Lane further south and utilize an existing roadway thereby reducing both land acquisition and road construction costs. The proposed realignment of this north -south collector also avoids the rolling undeveloped land to the west of the Reed Market Industrial Area. It does not require the removal of an existing operating auto repair business on Reed Market Road. 0137-0676 B. Change is warranted due to changed cicumstances, and other specific facts that demonstrate a public need and benefit for a change. DISCUSSION The change in the Transportation Element of the Bend Area General Plan is warranted sue to a specific acknowledgement that this change will provide better access to this partially developed and growing industrial area. This change will allow Deschutes County to construct a bridge in a safer alignment while improving access to an area that is already partially developed rather than on a more easterly alignment in an area zoned for residential development with no plans for development. Cicumstances have changed in that the county is faced with the need to replace the existing bridge fairly soon and needs to replace it at the best location to safely move both existing through and industrial traffic. CONCLUSION The Bend Area General plan does show a north -south collector street connecting the north -south running Brosterhous Road where it makes a 90 degree turn to the west with Reed Market Road. This change provides a parallel route elimiating several curves and utilizing an existing right-of-way and existing improved road to accomplish the same connection at less cost and in less time. 0137-0677 EXHIBIT "C" DESCHUTES COUNTY DEPARTMENT OF PUBLIC WORKS 61150 SE 27TH STREET BEND, OREGON 97702 M E M O R A N D U M TO: Bend Urban Area Planning Commission FROM: Dick Johnson, Management Analyst DATE: August 1, 1994 SUBJECT: American Lane/Brosterhous Road Plan Amendment ************************************************************* BACKGROUND We've been before the Planning Commiss;on at your June and July meetings to explain why the Deschutes County Public Works Department has proposed an amendment of the Transportation Plan to change the location of a collector. After the July meeting, the staff reviewed alternates "A" and "C" again to make an estimate of costs of the two alternates and look again at the advantages and disadvantages of each option. Alternative "B" and "D" were rejected due to public concerns or problems of implementing them in the field. No further consideration of these alternates was undertaken. The initial reason that a plan amendment is being considered for the relocation of a collector on the plan was the submittal of a tentative plat (TP -94-828) to the County. This tentative plat, if approved as submitted, would have precluded the relocation of the existing American Lane Bridge on the Main Central Oregon Irrigation Canal. In consideration of the proposed tentative plat, it became apparent that the best location for a new American Lane Bridge would also provide a logical canal crossing for the north -south running collector shown on the Plan as a northerly extension of Brosterhous Road parallel to American Lane. By shifting this collector to the east to be on the alignment of American Lane, the collector could take 0137-0678 advantage of the new American Lane Bridge canal crossing. This alignment would also utilize the existing American Lane road improvements -and have a smaller total cost to the public. We are coming back to you at your August meeting with estimates of what it would cost to build the two remaining alternates, a reiteration of the advantages and disadvantages of each alternate and to make a recommendation on amending the Plan. ALTERNATE "A" EXISTING TRANSPORTATION PLAN Advantages 1. This route is already on the Transportation Plan, thus no amendment to the Plan would be required. 2. This route provides the most direct north -south route for Brosterhous Road to connect with Reed Market Road. 3. This route connects with the east -west collector shown on the Plan along the northern edge of the Trap Club Property shown on the Plan. 4. This route creates a four way intersection at Brosterhous Road and American Lane. S. Two area property owners affected by the collector, Mr. Anderson and Mr. Perlotti, are in favor of this route. 6. This route crosses undeveloped land for the most part. 7. This route doesn't take north -south traffic out of direction to the east to reach Highway 97 via Reed Market Road. Disadvantages 1. This route would require the relocation of either Weisner's Automoive Shop or the building containing the Craftsman Contract Carpet and Grounds Maintenance business, or possibly all three businesses. 2. This route would create a poor sight distance situation at Reed Market Road unless its location at the north end was shifted to the west or east several hundred feet. 3. The canal bed would have to be lowered for a considerable distance for the road to cross on this alignment as the canal is higher than Reed Market Road. 4. No public right-of-way now exists on this route. 5. This straight stretch of road could create speed problems on Brosterhous Road. 6. This route doesn't make any use of an existing paved road. 7. A second bridge on American Lane or at least a road connection to the American Lane/American Loop Industrial Area from this route would have to be constructed if this route was used. Otherwise, the industrial area would lose its direct access to Reed Market Road when the existing bridge is removed. The County doesn't want to build two bridges. 8. The Bend Trap Club may well be opposed to this route due to interference with their operation and the need to condemn or purchase a portion of their property to 0137-0679 obtain the needed right-of-way. 9. There may well be opposition to obtaining right-of-way or constructing this route from the property owners having businesses on the south side of Reed Market Road. 10. More land and property owners are involved in obtaining land for this route. 11. This route doesn't address or solve the problem of the existing 90 degree curve on American Lane. 12. This route couldn't be constructed in phases, as the whole project would have to be done at one time to provide both the bridge over the canal and the road all the way south to the current intersection of Brosterhous Road and American Lane. 13. This alternate route would be more expensive to build due to the preceding reasons listed. A cost estimate is included with this memorandum for both this alignment and the American Lane alignment route. ALTERNATE "C" AMERICAN LANE ALIGNMENT Advantages 1. Only three property owners are involved in obtaining the property for the right-of-way for this route. 2. This route provides a good place to cross the COI Canal as it eliminates the two sharp turns on American Lane just south of the canal. 3. This route eliminates the awkward intersection of American Loop and American Lane just south of the bridge. 4. This route provides a good place to intersect with Reed Market Road in terms of sight distance and the distance from the railroad crossing on Reed Market Road. 5. This route provides good spacing on Reed Market Road from the intersection of 9th Street. 6. This route utilizes the existing American Lane right-of-way and roadway improvements for much of the length of the route. 7. No buildings, structures or businesses have to be taken in constucting a road on this alignment. 8. The 90 degree curve on American Lane is eliminated under this route alignment. 9. Less land for right-of-way must be obtained using this route than under the alignment shown on the Plan. 10. This route does not interfere with City of Bend plans for the future southward extension of Centennial Blvd. on the north side of Reed Market Road.. 11. This route provides a good solution for handling the American Loop Tentative Plat (TP -94-828) submitted on land adjoining the canal. This is because the right-of-way can be obtained for the new road alignment through the plat and the old right-of-way for the road leading to the current bridge can revert back to the property owner when the new bridge is constructed. 12. This route can be built in stages with the new bridge 0137-0680 going in as one phase and the elimination of the 90 degree curve on American Lane going in as a second or later phase. 13. The bridge relocation at the north end of American Lane could be undertaken to take place in a manner to keep the existing bridge open while the new bridge is constructed. 14. This route does not severely impact TL 700 as the right of way is merely shifted westward to eliminate the 90 degree curve on American Lane. 15. Only a short portion of.the canal bed has to be lowered to accommodate a new bridge with this route. 16. The total cost of this route is less expensive than the route now shown on the Plan. (See the engineer's attached cost estimate.) Disadvantages 1. This route is not on the Transportation Plan, thereby requiring an amendment of the Plan. 2. This route would result in the mixing of industrial traffic from the American Lane Industrial Area with through traffic on this collector. 3. This route forces north -south traffic on Brosterhous Road bound to or from Highway 97 to go further east before traveling east or west on Reed Market Road. 4. This route doesn't address what's to be done with the east west collector shown on the Transportation Plan crossing the northern edge of the Trap Club property. 5. Selection of this route will require that a determination be made of what to do with the short north -south section of Brosterhous Road south of American Lane. 6. Selection of this route will require that a determination be made of what land use can occur on the small triangular piece of the Perlatti property located west of this route and south of American Lane. 7. There is opposition from both Mr. Anderson and Mr. Perlotti to this route as some right-of-way would have to come from their properties. CONCLUSION The American Lane route is the preferred route due to the lessor total cost and not having to relocate one or more existing businesses. In addition, the American Lane alignment does address the situation with TP -94-828, provides the opportunity to build the route in phases and has more advantages than disadvantages when compared with the route now shown on the Plan. Note also that the estimated $310,000 difference between the route on the Plan and the American Lane alignment may be understated as only the assessed value of the business(es) to be relocated was considered in estimating the cost of the route currently on the Plan. Appraisers often appraise businesses to be moved due to new road construction at a higher value than the recorded assessed value. In the event of condemnation, 0137-0681 juries often reward existing viable businesses considerably more than the assessed value for the trauma of relocation when a new road requires the business to relocate. RECOMMENDATION The Deschutes County Department of Public Works recommends that the Bend Urban Area Planning Commission recommend amendment of the Bend Urban Area Plan Transportation Element to show the alignment of this north -south collector be moved eastward from its current Plan location to American Lane. The proposed transportation plan change to American Lane amends the plan to redesignate American Lane from a local road to a collector road. According to OAR 660-12-060 (2)(a), this change significantly affects the transportation facility. The zoning in the vicinity of the American Lane transportation plan change is IL, Light Industrial north of the east -west segment of the existing American Lane, and RS, Urban Standard Residential south of the east -west segment of the existing American Lane. The land uses that are allowed in the IL and RS zones will be allowed limited numbers of accesses to American Lane consistent with the access restrictions listed in Title 17 of the County Code. The capacity of American Lane will not be advesely affected by the allowed land uses with the established access standards. In addition the level of service for this collector road will not be adversely affected, but will change as additional development occurs on adjacent. Currently this road is operating at a level of service A for most of the day, and drops to a level B at certain peak hours during the day. The proposed realignment of American Lane will enhance the carrying capacity of the road by eliminating two 90 degree corners and tying Brosterhous Road into the realigned American Lane at a 90 degree angle, thereby increasing traffic safety at that intersection. American Lane at this time functions as a collector road with a local road status. The proposed change to a collector road is consistent with the existing use of the road. PA -94-3 PAGE 1
