ORDER NO. 94-136
WHEREAS, ORS 271.330 provides that Deschutes County may transfer property not
needed by the County to another governmental body after a hearing; and
WHEREAS, a hearing was held on November 23, 1994; and
WHEREAS, the Board of County Commissioners find that Deschutes County no
longer needs certain surplus property for public purposes; and
WHEREAS, the Board of County Commissioners find that the Oregon Department
of Transportation is a governmental agency of the State of Oregon and will use certain surplus
property for road right of way purposes; and
WHEREAS, no objections to the transfer of said surplus property were expressed at
said hearing; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, AUTHORIZES AND ORDERS as follows:
Section 1. That Deschutes County's interest in the property described as in Exhibit "A,"
attached hereto and by this reference incorporated herein, be transferred to the Oregon
Department of Transportation, the true consideration of which shall be the use of said
property for road right of way purposes, pursuant to ORS 271.330.

Section 2. That all appropriate documents be executed and delivered transferring said
real properties to the Oregon Department of Transportation subject to the constraints of state

PUBLIC NOTICE
On Wednesday, November 23, 1994, at 10:00 a.m., in Hearings Room "A' of the
Juvenile Justice Building, 1128 N.W. Harriman, Bend, Oregon, the Board of County Commis-
sioners of Deschutes County, Oregon, will hold a hearing on a property transfer between
Deschutes County and the Oregon Department of Transportation, another governmental body
of the State of Oregon. The property to be transferred by Deschutes County to the Oregon
Department of Transportation is described in Exhibit "A," attached hereto and by this
reference incorporated herein.
The parties intend that various County owned parcels within the right of way of the
Bend Parkway Project be transferred to the State of Oregon.
Any person may appear and make objections to the proposed transfer.
