ORDER NO. 94-151 0-11-31 -1-3 1� WHEREAS, a petition requesting annexation of territory ik La Pine Rural Fire Protection District was offered for filing with the County Clerk of Deschutes County, Oregon; and WHEREAS, upon determining that said petition, as modified with a revised legal description, met the filing requirements of ORS Chapter 198, said petition was accepted for filing by the County Clerk on behalf of the Board of County Commissioners; and WHEREAS, the County Assessor's Office has verified that said petition was signed by 100% of the owners of real property in the territory to be annexed; and WHEREAS, notice was published in accordance with law in The Bulletin on November 15, and 22, 1994, of a public hearing to consider the proposed annexation; and WHEREAS, a public hearing was held on the petition on November 30, 1994, and continued to December 7, 1994, to hear the petition and any objections thereto, and to determine whether, in accordance with the Comprehensive Plan, applicable Land Conservation and Development Goals and the criteria prescribed by ORS 199.462 and 198.805, the affected area would be benefitted by annexation of said territory into La Pine Rural Fire Protection District; and WHEREAS, after consideration of economic, demographic and sociological trends and projections pertinent to the proposal, past and prospective physical developments of the land that would directly or indirectly be affected by the proposal, and all other matters considered to be relevant to the petition, the Board is of the opinion that the area would be benefitted by annexation of the said territory to the said district; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the petition for annexation of territory into La Pine Rural Fire Protection District be approved. Section 2. That the boundaries of the territory annexed to the district are as set forth in the legal description and as indicated on the map attached hereto as Exhibit 1 and 2, respectively, and incorporated herein by this reference. That the applicable land use criteria pertinent to the proposed district annexation, the facts found by the Board and the reasons why the Board believes those facts to bring the proposal within the requirements of the applicable land use criteria are described in Exhibit 3, attached hereto and by this reference incorporated herein. Section 4. That the territory described Section 2 herein is declared to be annexed to La Pine Rural Fire Protection District as of the date of this Order. Section 5. That after signature, a copy of this order shall be forwarded to the Oregon Department of Revenue, Deschutes County Assessor's Office, and Klamath County Assessor's Office. Section 6. The purpose of this District is to provide fire protection services within said District. Section 7. The recitals and the provisions set forth herein shall serve as the Board's findings supporting this order. DATED this 7th day of December, 1994. Under the Public Facilities section of the County Comprehensive Plan, on page 97, General Policies is the following: 5. Deschutes County shall encourage the formation of special service districts to serve rural needs rather than becoming involved with serving those needs. The County will foster coordination and mutual planning between the County, special districts, utility companies and service corporations. This shall include trenching where appropriate. It is clear from the Comprehensive Plan that these service districts, such as fire districts, are necessary and appropriate. Quality Services Performed with Pride
