RESOLUTION NO. 94-124 0137-1903 WHEREAS, Deschutes County Code chapter 2.36 authorizes and designates the Board of County Commissioners to serve as the local contract review board; and WHEREAS, ORS 279.015(2) and Deschutes County Code 4.04.040 authorize the local contract review board to exempt certain public contracts or classes of public contracts from competitive bidding requirements; and WHEREAS, the Board of County Commissioners finds it in the public interest to exempt such contracts from bidding; and WHEREAS, the attached findings marked as Exhibit 1 have been made by the Public Works Department pursuant to ORS 279.015 and submitted to the Board for approval; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That service contracts for snow removal are exempt from competitive bidding requirements pursuant to ORS 279.015(2) and Deschutes County Code 4.04.040. DATED this 21st day of December, 1994. In the past the Department has retained a variety of firms to handle snow removal where the availability of resources and the firm's location promise speedy and cost-effective service. Andy Crosby, of Legal Counsel, and I have discussed whether service contracts for snow removal require the initiation of competitive bidding. It is our opinion that it would be very inefficient to engage in bidding for these contracts. The preparation of specifications for snow removal would be difficult to define since performance under the contract is contingent on the weather. Moreover, a quick response to snow accumulation requires that the contracting firm be in close proximity to the particular road section. We are therefore recommending that the Board adopt a resolution to exempt snow removal service contracts from competitive bidding as allowed by ORS 279.015(2) and DCC 4.04.040. In support of this resolution, the Department has made the following findings: 1. that such an exemption does not encourage favoritism or substantially diminish competition since: a) snow removal firms are selected on the basis of available resources and proximity to the snow removal site b) for the purpose of efficiency, the County will seek to contract with firms where performance under the contract is a natural extension of services already being provided by the firm 2. that the awarding of contracts pursuant to the exemption will result in substantial cost savings to Deschutes County since: a) contracting with firms in close proximity to the snow removal site will allow the Public Works Department to reassign personnel and equipment to more efficient locations b) the County will avoid administrative costs associated with bidding numerous small contracts required to EXHIBIT 013'7-1905 establish snow removal service at various -Stas .........�. 3. that the hourly rate fee to be utilized in snow removal service contracts will be consistent with market rates for such labor and equipment 4. that contracting with snow removal firms on the basis of available resources and proximity to the snow removal site will further the public interest by insuring swift and efficient response to conditions requiring snow removal service
