ORDER NO. 95-019
WHEREAS, on the 6th day of December, 1994, and the 11th day of
January, 1995, the Board of County Commissioners held a hearing in
the Deschutes County Board of Commissioners, conference room, 1130
NW Harriman, Bend, Oregon, on the issue of whether or not a certain
black dog known as "Griz" kept by Robert Ingram Kemnitz engaged in
the killing, wounding, injuring or chasing of livestock; and
WHEREAS, any dog not under the control of its owner or keeper
found chasing livestock not on the property of such owner or keeper
shall be prima facie deemed to be engaged in the killing, wounding,
injuring, or chasing of livestock; and
WHEREAS, Animal Control Officer Les Hamilton, Robert Hoar,
Keenan Hoar, Robert Kemnitz and Roberta Kemnitz offered testimony
before the Board and the Board having considered the evidence and
testimony, and being fully advised in the premises; and
WHEREAS, the Board finding a lack of evidence to prove that
said dog was chasing livestock; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That the certain dog described as a black dog
known as "Griz" kept by Robert Ingram Kemnitz impounded at the
Deschutes County Humane Society, Bend, Oregon, be released.
