DESCHUTES COUNTY BOARD OF COMMISSIONERS
Wednesday, November 23, 1994
Chair Nancy Pope Schlangen called the meeting to order at 10:07
a.m. Board of County Commissioners in attendance were Nancy Pope
Schlangen and Barry Slaughter. Also in attendance were Dennis
Maloney, Community Corrections Director, Catherine Morrow, Planner;
Ralph Delamarter, Librarian; Scott Johnson, Commissioner on
Children & Families Director; Brad Chalfant, Property Manager; Sue
Stoneman, Public Relations Specialist; Brad Mulvihill, Juvenile

1. SIGNATURE OF RESOLUTION NO. 94-114, DIRECTING THE CRIMINAL
JUSTICE ADVISORY COUNCIL TO DEVELOP A JUVENILE JUSTICE WORK
PLAN FOR DESCHUTES COUNTY
Before the Board was signature of Resolution No. 94-114,
directing the Criminal Justice Advisory Council to develop a
Juvenile Justice Work Plan for Deschutes County.
Denny Maloney introduced the Advisory Council. Judge Tiktin
reported this was a statutory mandated council. He felt that
juvenile justice was one of the most important issues facing
the community. Jim Carlton, supported the fact that the
County needed to take some action. Cal Krausch, board member
for Commission on Children and Families, supported this
resolution. Brad Mulvihill, Division Manager Juvenile
Department, stated strongly supported this resolution as it
was what was best for the community.

PUBLIC HEARING: ON PERIODIC REVIEW WORK TASK 4 AND RIPARIAN
AREA CUMULATIVE EFFECTS STUDY (RESOLUTION NO. 94-113)
Before the Board was a public hearing on Period Review Work
Task 4 and riparian area cumulative effects study.
Catherine Morrow stated she had provided a packet last week
which included a staff report, a draft of Resolution No. 94-
113, and copies of testimony that was submitted in front of
the Planning Commission public hearing, and a copy of the
draft cumulative effects analysis. She stated we were here to
take testimony on the draft report and the resolution. She
reported the resolution was to amend the periodic review order
for factor one. She stated we were required to do this
because we had a remand order which said we did not adequately
address the cumulative effects of land use actions on riparian
areas. A study was conducted to meet the requirements of the
remand order. This study was to determine whether there had
been any significant cumulative effects resulting from plan
and land use regulation amendments and implementation actions
on the acknowledged plans, factual base, map designations and
policies which relate to statewide planning goal requirements.
She stated in this case it was related to Goal 5. She stated
they were trying to see if the land use actions, such as
conditional uses, setback exceptions, flood planes, fill and
removal, and landscape management review, on river front
properties caused any cumulative effects to the riparian
habitat that we are protecting under Goal 5. She stated the
period that was reviewed in this study was from June 30, 1986
through December of 1992. The rivers and streams were shown
on the map provided by Catherine. Catherine reviewed the
summary of the findings. She reported there were 107 land use
actions on these streams. Site visits were conducted to 70 of
these properties. A form was used to record the data from the
land use action file and the site visits to determine what the
condition of the riparian habitat was before development
action was allowed, what the conditions were in the land use

action that addressed protection of the riparian habitat, and
whether, as a result of those conditions, the riparian habitat
had deteriorate, stayed the same or improved. Of the 107
applications, 78 were on the main stem of the Deschutes, 16
were on the Little Deschutes, 3 on Tumalo Creek, and 3 on
Squaw Creek. Most of the applications were in south county
and most of the habitat deterioration was happening between
Sunriver and La Pine. Parcels with extensive wetland areas
have not experienced deterioration. Catherine reviewed
photographs of riparian areas with the Board.
Bruce White stated that he knew there was an issue with
respect to septic systems in the south county. The 1986 River
Study builds upon our existing plan which has recognized the
area of the south county as an exception area which allows for
dwellings to be sited on all of those plated lots. These lots
were plated prior to any kind of land use planning and are
recognized as exception areas. The plan has been that those
parcels, for planning purposes, are buildable lots. He stated
there has always been an assumption that those lots could be
buildable. He stated that if there were assertions that
somehow change the circumstance that come up because of
increased septic approvals, those were always contemplated as
potentially buildable lots. That was also part of the 1986
River Study.
Bruce also stated that if you look at the Comprehensive Plan,
it recognizes a drought as a natural hazard. This was
recognized during the planning process that droughts do occur.
He stated that does not constitute a change of circumstances
in the intervening time for which this study occurred.
Chair Schlangen opened the public hearing.
Howard Payne read and submitted written testimony from Maret
Pajutee which was in opposition.
Howard Payne also testified on his own behalf in opposition.
He stated he disagreed with the county's conclusion that the
land use regulations for riparian habitat protection have
prevented significant loss during the 1986 to 1992 study
period. He submitted written testimony and some photographs
for the Boards review.
Howard Payne stated that another major cause for riparian
damage occurred from cattle grazing. Aerial photos were
submitted at the Planning Commission public hearing on this
matter showing 100% loss in some areas. The county fails to
impose grazing restrictions when they have the authority to do
so in all zones except EFU. He submitted aerial photos of
cattle damage done in the riparian and stream channels of
Indian Ford Creek during the last 30 days in RR -10 zone lands.

Howard felt it was the county's responsibility to fund and
conduct a flood plane mapping of Indian Ford Creek. He stated
the county had an obligation to protect its citizens from
natural hazards. There are currently applications before the
county for housing developments along the creek which could be
within the 100 year flood plane and build -out could occur
before FEMA gets around to mapping it. The county needs to
implement an enforcement program that would protect riparian
areas to the fullest extent. He felt that since the Community
Development Department was supported primarily by permit fees,
the fee structure should be adjust in order that full
enforcement could occur. He felt that if land development was
causing the damage, then land development permit fees should
pay for the cost.
Howard Payne stated that if Resolution No. 94-113 was approved
as written, he assured that it would be contested at the LCDC
level on the basis that it violates Goal 5, paragraph 2 and
paragraph 3. He requested the Board to make a finding of
significant cumulative effects and move this process to Phase
II.
Bruce White asked Howard Payne if he felt it was the
development actions in the study period that actually caused
that grazing to occur. For example, on Indian Ford Creek has
that grazing always occurred. Howard Payne stated that
apparently had. Bruce White asked if it would be fair to say
that grazing had not then been increase or caused to happen by
any development action the county has approved. Howard Payne
felt it had not been caused by development actions the county
had approved. It stated it was just another force and one
needed to look at all aspects. If you are going to protect
the resource, you have to protect it countywide. He
understood that it could not be protected in the EFU Zone.
Commission Slaughter asked if Howard Payne felt there was an
overall net loss. Howard Payne felt we had a tremendous loss
historically. Howard explained that there was a 1965 and a
1991 photograph of Black Butte Ranch prior to development. He
stated the destruction had removed the riparian area, the golf
course goes right to the stream side, it was mowed regularly
and there was no chance for that riparian area to recover.
Bruce White asked Mr. Payne if he felt there had been much
loss of riparian area since 1986. Howard Payne thought that
most of the loss had occurred prior to that time.
Bruce White explained that Black Butte Ranch was permitted
prior to the County's zoning. Howard Payne stated he realized
that but he wanted to point out how much riparian loss had
taken place even prior to 1986. Bruce White stated the
cumulative effects were to analyze what the cumulative effect

had been under the current effective land use regulations.
Howard Payne stated that was right, but he felt one needed to
look at the broad picture. Howard stated that if you have
lost 50-75% of the riparian prior to 1986, and there was no
enforcement action to prevent constant removal, there would be
no chance for return.
Commissioner Slaughter stated this county was almost totally
undeveloped in the early 1900's. He felt there had been an
incredible amount of riparian areas added to the county
because of the irrigation districts being added throughout the
county. He felt the County had maintained or increased the
amount of riparian areas.
Howard Payne stated that a tremendous amount of riparian area
had also been lost because of logging practices. He stated he
was contesting the inventory because the County had no base
line information or picture of the lots. He felt the County
did not know if the riparian was 10 feet or 30 feet.
Jim Knapp, owner of most of the property in the Indian Ford
Creek area, testified. He felt the vegetation was heavier now
than it was previously on Indian Ford Creek.
Ed Benton resides in the Indian Ford area. He addressed the
rezoning of the flood plain in the Indian Ford Creek.
Catherine Morrow stated some of the upland vegetation had
deteriorated on 50% of the properties but she had not measured
how much on each property. She read a written report from
James Lewis, Planner.
Bruce White asked if we protected the wetlands. Catherine
stated yes. Bruce White asked if it was fair to say the 100
foot setback was under -inclusive of the "wet areas".
Catherine stated that was correct and it would also apply in
the flood plane circumstance. Bruce White asked if the 100
foot setback in other areas was over -inclusive of what was
typically viewed as riparian wetland type areas. Catherine
stated there were a lot of distinctions that were made about
riparian habitat. She stated they made the distinction in the
study as to upland and riparian habitat. In the ESEE it
stated the 100 foot setback was significant to the habitat.
She stated the Department of Forestry used the 100 foot
setback in their hierarchy of riparian protection and they
have different classifications for the area immediately
adjacent.
Bruce White clarified that there are exception of the 100 foot
setback from the streams but that it was under very
restrictive rules. Catherine stated the setback exceptions
were granted under certain circumstances.

Commissioner Schlangen asked if we had a lot of exceptions.
James Lewis reported that out of 70 properties there were 11.
In these 11 exceptions, most of them were granted because of
the odd or irregular shaped lots. The amount of the
deterioration varied on the properties with the exceptions,
but the number of those were small. Catherine stated the
setback exception did not cause the deterioration, it was
caused the lack of compliance.
Bruce White stated most of the lots with the exceptions were
platted in the south county prior to the land use regulations.
He stated we allowed an escape valve through our exceptions
processes to site closer than our 100 foot setback in certain
situations where otherwise the lot would not be buildable.
The county did not say that once the 100 foot setback has been
breached someone could locate 10 feet from the stream. The
county said the 100 foot setback could be violated to the
extent to site the dwelling.
Chair Schlangen closed the public hearing. A work session
will be scheduled for a future date.
4. PUBLIC HEARING: ON ORDER NO. 94-152, THE FORMATION OF THE
REDMOND LIBRARY SERVICE DISTRICT
Before the Board was a public hearing on Order No. 94-152, the
formation of the Redmond Library Service District, Order No.
94-153, the formation of the Bend Library Service District,
Order No. 94-154, the formation of the Sisters Library Service
District, Order No. 94-155, the formation of the La Pine
Library Service District and Order No. 94-156, the formation
of the Sunriver Library Service District.
Rick Isham stated the public hearings could be held as a group
with individual action on each order separately. This was the
date that was noticed for the hearings. If the Board adopted
the order, they will then be set for a final hearing at which
time the districts will be formed or set to an election.
These districts do not propose a tax base because they are
capital improvement districts only. The final board order
would not authorize any ad valorem tax if that final order was
signed.
Chair Schlangen opened the public hearing which covered all
five of the Orders regarding the formation of the Library
Service Districts.
Ralph Delamarter stated that one of the things that the task
force determined was that the entire county be covered by
these library districts and that the school district
boundaries be followed as much as possible. He stated these
districts were for capital improvements only.

Dave Gordon, Library Board Chairman, thanked the commissioners
for their help and for supporting the library.
SIGNATURE OF BOARD'S FINAL DECISION ON A-94-13, AN APPEAL OF
NUV-94-2 (FRALEYj
Before the Board was signature of the final decision on A-94-
13, an appeal of NUV-94-2.
Damian Syrnyk stated he had worked with the applicant and his
attorney to draft a decision. He stated what was before the
Board was the latest version which included some conditions
that the Board, Legal Counsel, Planning Department and Mr.
Fraley had agreed upon at a meeting on October 18, 1994.
Damian reported the Board should have received a letter dated
November 21, 1994, from seven neighbors of the Fraley
property. The letter states that they intend to appeal this
if the Board should complete this process and make a final
decision of the non -conforming use.
SLAUGHTER: I move signature on Board's final decision on
A-94-13 and appeal of NUV-94-2.

Commissioner Slaughter stated he would be watching this issue
very carefully and he hoped that others would help and report
this to code violation. He felt the Fraleys might not abide

Brad reported this hearing was scheduled for Wednesday,
November 29, 1994, but the notices were not published in the
Bulletin. This resolution sets a new hearing date of December
7, 1994.

23. SIGNATURE OF RESOLUTION NO. 94-116 CREATING COMMUNITY
DEVELOPMENT BLOCK GRANT FUND AND MAKING APPROPRIATIONS
Before the Board was signature of Resolution No. 94-116,
creating a Community Development Block Grant Fund and making
appropriations.
Susan reported we received a grant from the Community
Development Block Grant program in the amount of $19,800 for
Terrebonne and $600,000 for La Pine Community Campus.
