REVIEWED EL DESCHUT COU t IJ ORDER NO. 95-018 0138- 0058 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon, has received the Engineer's proposed assessment for each parcel of land for the improvement of roads in Comanche Circle L.I.D.; and WHEREAS, Deschutes County Code, Section 17.48.240 provides that the Board must set a public hearing by Order of the Board to hear objections to any such proposed assessment; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the report of the Engineer, marked Exhibit "A", attached hereto and by this reference incorporated herein, is hereby accepted, and that a public hearing for the purpose of hearing objections to the proposed assessment shall be held on Wednesday, February 8, 1995, at 10:00 a.m. in the Juvenile Justice Building, 1128 NW Harriman, Bend, Oregon 97701. Section 2. The improvement has been made, inspected by the Engineer and is hereby accepted by County Court. Section 3. That the Director of Public Works, on behalf of the Board of County Commissioners, mail written notice not less than five days prior to the date of said hearing to the owners of the parcels described in Exhibit "A", identifying the parcel, showing the proposed assessment, and giving notice of the hearing scheduled in Section 1 of this Order. Section 4. That the written notice to be given in Section 3 shall comply substantially with the form of notice marked Exhibit "B", attached hereto and by this reference incorporated herein. NIPPER, COMM S IONER EXHIBIT "A" 0138-0069 MEMORANDUM DATE: January 11, 1995 TO: Board of County Commissioners FROM: Tom Blust, County Engineer RE: Comanche Circle LID, Final Assessment Report This report is made pursuant to Sections 12.48.220 and 12.48.240 of the Deschutes County Code (DCC) concerning the compilation of actual costs and determination of the final assessment for the local improvement. Background: On March 30, 1994 the Board of County Commissioners (Board) initiated, by resolution, the improvement of Comanche Circle in Deschutes River Woods Subdivision. A hearing was held on the proposed improvement on May 25, 1994 at which time two objections, out of 15 lots, were filed regarding the proposed road improvement. Subsequently, the Board signed Order Number 94-091 directing the improvement to be made and to construct the road by contract. Construction Contract: Engineering plans and construction contract documents were prepared by the Public Works Department. Bids for the project were opened on July 28, 1994. Bids received from three construction firms: Bend Aggregate and Paving, $92,644.90; Pieratt Brothers, Inc., $100,835.40; and R.L. Coats, $116,713.00. The Board awarded the contract on August 3, 1994, to the low bidder, Bend Aggregate and Paving Co., Inc., in the amount of $92,644.90 (contract included both Seminole Circle LID and Comanche Circle LID). Acceptance of Improvements: The construction of the local improvement was completed by the contractor, and inspected and approved by the Engineer. The final payment on the contract was made on January 4, 1995. The Engineer recommends Board acceptance of the improvements within Comanche Circle LID. Included in this package for the Board's signature is Order No. 95-017 for the acceptance and establishment of Comanche Circle as a County Road. Final Assessment Report 1/11/95 Page 2 Local Improvement - Actual Costs: 0138-0070 The actual costs of the local improvement, as defined in DCC 12.48.041, are as follows: the construction cost is $34,933.83, the engineering and administration cost is $4,765.16, and financing costs are $553.84, for a total improvement cost of $40,252.84. Attached as part of this report are exhibits 1 through 4, detailing the actual costs. Payment of the construction cost was made from the Local Improvement District Project Fund (County Fund # 74). This fund will be reimbursed through assessment payments and a future bond sale (combined with the LID's to be constructed in 1995). The financing cost included as "actual cost" is the interest cost associated with the interim financing from the LID Fund (refer to exhibit "Y'). Based on the method of cost allocation approved by the Board in Order No. 94-091, the assessment to each of the 15 specially benefited lots is $2,683.52 ($40,252.84 divided equally among the 15 lots). The actual cost is approximately 13% below the estimated pre -assessment lien, which was $3,070.00 per lot, as specified in Order No. 94-091.
