RESOLUTION NO. 95-021
WHEREAS, ORS 271.330 provides that Deschutes County may transfer surplus
property to another governmental body by proper resolution and hearing; and
WHEREAS, the Bend Metro Park and Recreation District has requested that the
County transfer to it the County's interest in certain surplus property without consideration;
and
WHEREAS, the Board of County Commissioners finds that Bend Metro Park and
Recreation District is another governmental body in the State of Oregon, and will use said
property for public purposes; and
WHEREAS, ORS 271.330 provides that said transfer shall only be made upon notice
and after hearing; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That Deschutes County intends to transfer the following property interest
herein described as:
A parcel of land lying in the SE 1/a NW 1/a of Section 6, Township 18 South,
Range 12 East, Willamette Meridian, Deschutes County, Oregon, said parcel
being a portion of that Deschutes County property described in the Statutory
Bargain and Sale Deed between Bend Metropolitan Park and Recreation
District, Grantor, and Deschutes County, Grantee, recorded May 19, 1994 in
Volume 339, Page 2841 of Deschutes County Record of Deeds, being more
particularly described as follows:

Beginning at the #5 rebar with an aluminum cap stamped "LS 1031"
monumenting the point of intersection of the North-South centerline of said
Section 6 with the Southerly Right of Way line of Simpson Avenue, said
monument also being the Northeasterly corner of the Bend Metro Park and
Recreation District property described in the Bargain and Sale Deed recorded
January 10, 1983 in Volume 365, Page 270 of Deschutes County Record of
Deeds; thence, South 00°41'16" East 100.01 feet along said North-South
centerline to the Southeasterly corner of said Bend Metro Park and Recreation
District property; thence, leaving said North-South centerline, along the
southerly property line of said Bend Metro Park and Recreation District
property, South 62°13'35" West 246.92 feet to the Point of Beginning; thence,
continuing along said southerly property line, South 62'13'35" West 510.97 feet
to the Southwesterly corner of said Bend Metro Park and Recreation District
property; thence, leaving said southerly line, along the westerly line of said Bend
Metro Park and Recreation District property, North 06°2322" West 300.01 feet
to the #5 rebar with an aluminum cap stamped "LS 1031" monumenting the
Northwesterly corner of said Bend Metro Park and Recreation District property
and the Southerly Right of Way line of Simpson Avenue; thence, leaving said
westerly property line, along said Right of Way line, 100.69 feet along the arc of
a 1312.11 foot radius non -tangent curve to the right, the long chord of which
bears South 85'48'55" West 100.66 feet to the #5 rebar with an aluminum cap
stamped "LS 1031" monumenting the Northwest corner of said Deschutes
County property described in deed Volume 339, Page 2841; thence, leaving said
Right of Way line, along the Westerly line of said Deschutes County property
South 05'21'30" East 344.56 feet to a #5 rebar with an aluminum cap stamped
"LS 1031"; thence, 164.24 feet along the arc of a 206.58 foot radius curve to the
left, the long chord of which bears South 28°08'06" East 159.95 feet to a #5
rebar with an aluminum cap stamped "LS 1031'; thence, South 50°54'42" East

61.50 feet along the arc of a 289.27 foot radius curve to the right, the long chord

Section 2. That a hearing for the purpose of receiving objections to the above transfer
will be held at 10:00 a.m. on Wednesday, March 15, 1995, at the Deschutes County
Administration Building, 1130 N.W. Harriman, Bend, Oregon.

Section 3. That the Clerk of the County Court shall give notice of the time and place
for the hearing set in Section 2 of this resolution by publication of the notice marked Exhibit
"A," attached hereto and by this reference incorporated herein, in "The Bulletin" once each
week for two consecutive weeks prior to the date of such hearing.

Justice Building, 1128 N.W. Harriman, Bend, Oregon, the Board of County Commissioners of Deschutes
County, Oregon, will hold a hearing on a land transfer of real property from Deschutes County to Bend
Metropolitan Park and Recreation District. The real property to be transferred by Deschutes County is
