Section 5. That if written requests for an election are not filed by at least 15 percent of the electors or 100 electors, whichever is the lesser number, registered in the proposed district at the time of the final hearing, the Board will enter its final order creating the district, as set forth herein. The dwellings in the subdivision are currently served by the Ponderosa Pines Water Company, a water company organized under Oregon law. The proposed district would be a successor to the Water Company and would continue the service currently being provided by the Company. The Ponderosa Pines subdivision is surrounded by National Forest land in an area west of the La Pine core area. The subdivision consists of four plats, platted as follows: Ponderosa Pines, platted on July 3, 1970 (103 lots); Ponderosa Pines First Addition, platted on December 12, 1970 (85 lots); Ponderosa Pines Second Addition, platted on March 2, 1973 (108 lots); Ponderosa Pines Third Addition, platted on August 29, 1977 (62 lots); and Ponderosa Pines Fourth Addition, platted on September 15, 1978 (106 lots). The development has 464 one to 1 1/2 -acre parcels, 345 of which currently have single-family dwellings on them. The development is currently served by a central water supply system owned by the Water Company. The water source consists of two deep wells, and water is distributed to each lot by a system of water mains installed in the streets of the subdivision. In addition, the water system has a 100,000 gallon reservoir. All water mains necessary to serve each lot have been installed. The first well was drilled and approved by the State of Oregon Water Resources Department on June 30, 1970 and served lots in the first two plats; the second well was drilled and approved by the State on March 27, 1979 and was to provide capacity to serve the lots in the remainder of the subdivision. This infrastructure was largely in place by 1979. Platting of the subdivision and construction of the water supply system infrastructure pre -dates the current comprehensive plan and zoning, adopted on November 1, 1979. In the comprehensive plan, the area covered by the subdivision was designated "Rural Residential" and was zoned "RR -10. " The area was excepted from the requirements of Goal 4 in the Goal Exceptions Statement of the comprehensive plan as already committed to development. No exception for this area was taken from either Goals 11 or 14, the goals that restrict urban uses and facilities from occurring outside urban areas. The Comprehensive Plan implements Goals 11 and 14 with regard to public services in General Policies No. 1 and 2 of the Public Facilities part of the Plan and are the applicable comprehensive plan policies for the purposes of this discussion. General Policy No. 1 states that "public facilities . . . shall be provided at levels and 4 - ORDER NO. 95-050 (3-29-95) 0138--0832 in areas appropriate for such uses based upon the carrying capacity of the land, air and water, as well as the important distinction between urban and rural uses." General Policy No. 2 relating to Public Services identifies water supply systems as a "key facility" and states a general policy that such facilities "shall be located in urban areas or in rural service centers, if necessary, to meet the needs of existing rural residents. Key facilities shall be built to encourage urban, rather than increased rural, residential development. (emphasis supplied) " The purpose of this policy is to guide the development of new key facilities so that they generally occur within urban growth boundaries or rural service centers. It does not apply to key facilities, such as those at issue here, whose existence pre -date the adoption of the plan. With such key facilities already in place, the formation of the district does not in and of itself enable the construction of new key facilities that might violate Policy No. 2. Accordingly, the formation of the Ponderosa Pines Water District would not be inconsistent with the provisions of the comprehensive plan. 5 - ORDER NO. 95-050 (3-29-95) EXHIBIT 4 ORDER 95-050 0138-0833 NOTICE OF FINAL HEARING BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A public hearing regarding a petition proposing the formation of the Ponderosa Pines Water District, will be held on Wednesday, April 19, 1995, at 10 a.m. in the Deschutes County Juvenile Justice Building, Room A, 1128 NW Harriman, Bend, Oregon. The boundaries of the proposed District are described in Exhibit 1, attached hereto and by this reference incorporated herein. The purpose of the proposed District formation is to provide water supply district services for the inhabitants of the district to be formed. All interested persons may appear and be heard. Upon conclusion of the final hearing, the Board will enter its final order creating the district, unless written requests for an election are filed at or before the hearing by resident voters within the district numbering not less than 15% of the registered voters, or 100 voters, whichever is the lesser number. The meeting location is wheelchair accessible. For the deaf or hard of hearing, an interpreter or assistive listening system will be provided with 48 hours notice.
