1995-17657-Minutes for Meeting March 22,1995 Recorded 5/23/19959E-17657 0146-1223 MINUTES DESCHUTES COUNTY BOARD OF COMMISSIONERS Wednesday, March 22, 1995 Chair Slaughter called the meeting to order at 10:01 a.m. Board of County Commissioners in attendance were Barry Slaughter and Bob Nipper. Also in attendance were Rick Isham, County Counsel; Mike Maier, County Administrator; Bruce White, Assistant County Counsel; Andy Crosby, Assistant County Counsel; Tom Blust, County Engineer; and Sue Stoneman, Community Relations Specialist. 1. CONSENT AGENDA: Consent agenda items before the Board of County Commissioners were: 1) approval of training request for Doug Hartzell and Tim Schimke to attend the Northwest Regional Solid Waste Symposium; 2) approval of out-of-state training at N.W. Gang Investigators Meeting in Boise, Idaho; 3) selection of towing company for vehicle impounds; 4) signature of Resolution No. 95-043, creating a petty cash account for Ready Set Go; 5) signature of Conservation Easement for property owned by Douglas Lowe; 6) reappointment of Theola Freitas to Special Road District #6 Board of Directors; 7) signature of replat of Courtyards at Broken Top (12 Lots); 8) signature of final partition plat for Minor Partition MP -94-20 for Eldon Pearson; 9) signature of Resolution No. 95-051, rescinding Resolution No. 95-023, regarding Galen Road Local Improvement District; and 10) signature of mylar for The Forum. PUBLIC HEARING FOR REMONSTRANCES FOR APACHE ROAD LOCAL IMPROVEMENT DISTRICT AND SIGNATURE OF RESOLUTION NO. 95-047, DIRECTING IMPROVEMENT TO BE MADE BY CONTRACT Tom Blust reported the residents had petitioned the county to improve certain roads in that subdivision. The proposal was to improve Apache Road and Lakeview Drive. The roads within that Local Improvement District would be improved to rural local district road standard. The estimated assessment per lot was $4,276 each. The construction would start this summer with completion in the fall. Walter Hyde testified in support of this local improvement district. Caryl Nye, resident on Apache Road, testified in support of the local improvement district. Doug Emerson, lives on Apache Road, agreed that the road was in terrible shape. He testified in opposition of the local improvement district. Anne Hyde testified in support of the local improvement district. Gordon Halcroft testified in support of the local improvement district. Walter Hyde stated the original proposal covered River Woods too. Tom Blust stated there was a petition that was being circulated to cover the rest of Lakeview and Riverwood Drive not included in the proposed local improvement district. There being no further testimony, Chair Slaughter closed the public hearing. NIPPER: I move signature of Resolution No. 95-047, directing improvement to be made by contract for Apache Road and Lakeview Drive, subject to review by legal counsel. SLAUGHTER: I will second that. Commissioner Nipper stated he was voting for this because there was a need for emergency vehicles to have access to this area. Commissioner Slaughter stated he agreed. VOTE: SLAUGHTER: YES SCHLANGEN: EXCUSED NIPPER: YES MINUTES PAGE 2 MARCH 22, 1995 0 4. 5. 0146-1225 PUBLIC HEARING: ON ORDER NO. 95-050, REGARDING THE FORMATION OF THE PONDEROSA PINES WATER DISTRICT Before the Board was a public hearing on Order No. 95-050, regarding the formation of the Ponderosa Pines Water District. Bruce White reported this hearing was to determine if the boundaries were appropriate. There were approximately 490 lot and about 350 were built out. If the Board approved the district, this order would establish a second hearing date which would allow for remonstrances and if 15% were received, it would have to go to election. He recommended the Board hold the public hearing, sign the order and leave it open until next week. Chair Slaughter opened the public hearing. Rod Gray testified on behalf of the formation of the district. The formation of a district would allow them to borrow money through the state water system. There would be no additional taxes to sustain this system. There are about 160 full time residents. Bob Olson in support of the formation of this water district. Jerry Barnberker testified in support of the water district. Bruce White requested the Board leave the public hearing open until March 29, 1995 at 10 a.m. SIGNATURE OF ORDER NO. 95-044, AUTHORIZING THE REFUND OF TAXES Before the Board was signature of Order No. 95-044, authorizing the refund of taxes.
