Also in attendance were Rick Isham, County Counsel; Mike Maier, County Administrator; Greg Brown, Lieutenant; Gary Giersdorf, Community Corrections Facility Director; Brad Chalfant, Property Manager; Sue Stoneman, Community Relations Specialist; Andy Crosby, Assistant County Counsel; Susan Mayea, Support Services Manager; Sue Brewster, Assistant County Counsel; and George Read, Community Development Director. CONVENE AS GOVERNING BODY OF BLACK BUTTE RANCH SERVICE DISTRICT 1. Rick Isham stated this was to allow Black Butte Ranch to officially deduct the PERS pre-tax which was adopted for all county employees. The second public hearing will be held on March 29, 1995. Chair Slaughter opened the public hearing. There being no testimony, Chair Slaughter closed the public hearing. VOTE: SLAUGHTER: YES SCHLANGEN: EXCUSED NIPPER: YES CONVENE AS DESCHUTES COUNTY BOARD OF COMMISSIONERS CONSENT AGENDA: Consent agenda items before the Board of County Commissioners were: 1) acceptance of bid and award of contract for La Pine Community Campus; 2) signature of Tri -Ad Contract; 3) signature of Order No. 95-047, correcting Order No. 95-038, Insurance Fund Transfers; 4) signature of a Conservation Easement for Jerry and Cathleen Larsen; 5) signature of final plat for Painted Ridge at Broken Top, Phase I; 6) appointment of Parker Johnstone and Rex Barber, Jr. to the County Farm Board of Review; and 7) signature of replat of first addition to Redmond Memorial Cemetery. VOTE: SLAUGHTER: YES SCHLANGEN: EXCUSED NIPPER: YES PUBLIC HEARING ON SIGNATURE OF ORDER NO. 95-035, LA PINE INDUSTRIAL SITE ANNEXATION INTO LA PINE SEWER DISTRICT Before the Board was a public hearing on signature of Order No. 95-035, La Pine Industrial site annexation into La Pine Sewer District. Andy Crosby reported this was the first of two hearings. This was an order which confirms that the area to be annexed would be benefitted by that annexation. It also sets a date and time for the second public hearing. MINUTES PAGE 2 MARCH 8, 1995 5. Chair Slaughter opened the public hearing. 0146-1235 Ernie Poole, 53196 Ridge Drive, La Pine, testified in opposition to this annexation. He expressed concern regarding the ground water quality in the La Pine basin. Brad Chalfant reported the intent was to bring the existing industrial park into the sewer district. He stated it was the intent to do what we could so that we can begin addressing issues that have been raised with respect to the existing businesses. Ken Travis, La Pine Sewer District, stated the ordinances covered what Mr. Poole was addressing. The County, EPA and DEQ has copies of these ordinances. All of the required tests were done on schedule. There being no further testimony, Chair Slaughter closed the public hearing. NIPPER: I move signature of Order No. 95-035, La Pine Industrial Site Annexation into La Pine Sewer District. SLAUGHTER: I second that. VOTE: SLAUGHTER: YES SCHLANGEN: EXCUSED NIPPER: YES COUNTYWIDE VEHICLE FORFEITURE PROGRAM AND RECOMMENDATION OF SELECTION OF TOWING COMPANY FOR VEHICLE IMPOUNDS Before the Board was a presentation of the countywide vehicle forfeiture program and a recommendation of a towing company for impounded vehicles. Greg Brown reported on the forfeiture program. The forfeiture program began in 1992. The Justice Coalition Committee was formed. Three goals of this committee were to abate nuisances, create a program that would not cost the taxpayers any money, and reduce the driving problem here in Deschutes County. Consolidated Towing was originally awarded the bid for towing and storage of forfeiture vehicles. Greg reviewed how the forfeiture program worked. Sergeant Mike Johnston reported the request for proposal was published in the newspaper and five bids were received. They rated each towing company on a scale of 1 to 5 (lowest bidder received a #1 and highest bidder a #5). Consolidated Towing and Central Truck were the two lowest bidders. A visit to each of these two facilities was then arranged. The two MINUTES PAGE 3 MARCH 8, 1995 6. 0146-1236 facilities were comparable. It was the recommendation to the Board that award of the bid go to Consolidated Towing as they were the low bidder. Daryl Crozier, Central Truck/Track Towing, stated he agreed with the program. Mike Wildman, Consolidated Towing, addressed retail rates. He felt the program worked and was very good. Lori Westfall, Consolidated Towing, testified in support of the program. Bill Barnes, American Towing, testified in support of the bid process. John Hancock, Tired Iron, testified. He stated the cost to the county in his bid would be zero. Ron Barny felt it should be on a rotation basis rather than giving all the business to one company. Greg Brown stated if everyone had the same rate and the county had the facilities a rotation basis might work. He felt that if there was only one company, the Sheriff's Department would know immediately where to find the car. Mike Johnston submitted all five bids to the Commissioners. Richard King, American Towing, stated the Commissioners should look at the bids but they should also look at the facility each business has. Commissioner Slaughter felt he would like to postpone the decision for a week or two. A decision will be made in two weeks (March 22, 1995). SECOND READING OF ORDINANCE NO. 95-011, IMPOSING A 1% INCREASE IN THE TRANSIENT ROOM TAX Before the Board was the second reading of Ordinance No. 95- 011, imposing a 1% increase in the transient room tax. Since the first reading, the Board had agreed to a different funding method for the proposed event center, therefore, the increase in room tax was unnecessary. Mike Maier reported the main purpose to was a transfer to get the solid waste fund set up.
