1995-21527-Order No. 95-106 Recorded 6/22/199594 -2152r7 REVIEWED LEGAL COUN EL_ BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES-CIIUN'I'- U", —' Extending Time for Closing of Record * 4 isN' 22 A M 9: I and Setting New Schedule for Written * _ Testimony in the Appeal of MP -94-28 (Mooney Partition) * °{1 ORDER NO. 95-106 Vui WHEREAS, on June 14, 1995, the Board of County Commissioners conducted a public hearing on the appeal of Richard and Sharon Mooney (Applicants) regarding MP -94-28 and set a schedule for receipt of additional written testimony; and WHEREAS, Applicants, by and through their attorneys have requested that the record remain open for an additional period of time beyond 5:00 PM June 21, 1995 to allow submission of septic site evaluations for those proposed parcels for which there are no site evaluations; and WHEREAS, the Board has given due consideration to applicant's request; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That Applicants shall have until the close of the business day on July 7, 1995 to submit septic site evaluations for those proposed parcels for which no septic site evaluations have been performed and any other accompanying supporting evidence of the suitability of the parcels for siting of on-site sewage disposal systems, provided that Applicants submit applications for said septic site evaluations immediately. Section 2. That the Environmental Health Division shall assist applicant in meeting the July 7, 1995 deadline. Section 3. That opponents to the application shall have a 7 -day time period until the close of the business day on July 14, 1995 for rebuttal of any information submitted by Applicants pursuant to Section 1 of this order. The Board shall make its oral decision on the appeal on July 19, 1995. DATED this 21st day of June, 1995.
