ORDER NO. 95-073 ON 7 _ 01 to g WHEREAS, Deschutes County has acquired title to certain real property pursuant to a variety of means, including right of way purchase, judicial forfeiture and real property tax foreclosure proceedings on file in the Circuit Court of the State of Oregon for Deschutes County; and WHEREAS, the Deschutes County Board of Commissioners did adopt Order No. 95- 072 on May 3, 1995, ordering the Deschutes County Sheriff to offer for sale the real property described in Exhibit "A," attached hereto and by this reference incorporated herein; and WHEREAS, the Deschutes County Sheriff did offer for sale that real property described in Exhibit "A" on June 2, 1995, on the lawn adjacent to and east of the Deschutes County Administration Building, 1130 N.W. Harriman, Bend, Oregon, and did accept written bids submitted through June 7, 1995, pursuant to Order No. 95-072; and WHEREAS, the Deschutes County Sheriff has received bids equal to, or in excess of the minimum bids set forth in Order No. 95-072, and the highest bid for each property being herein set forth in the Sheriffs Return, attached hereto as Exhibit "B," and subsequent Amended Sheriffs Return, attached hereto as Exhibit "C", and by this reference incorporated herein; and WHEREAS, Thomas Porter, the apparent high bidder for Parcel #11 as referenced in Exhibit "B" and "C" failed to pay the amount bid at sale, said bid was subsequently declared invalid for failure of consideration wherein Parcel #11 was withdrawn from the sale; and WHEREAS, with the exception of Parcel #11, it appears that the bids set forth in Exhibits "B" and "C" are the highest and best bid received at sale, said bids being equal to or exceeding the minimum bid set forth in Order No. 95-072, and it is in the best interest of the County to accept said bids; and WHEREAS, notice was given to all municipal corporations within Deschutes County pursuant to ORS 275.170 as described in Exhibit "D," attached hereto and by this reference incorporated herein, and said municipal corporations having failed to respond within 20 days, any such assessment liens claimed pursuant to ORS 275.130 are waived; now, therefore, KF r',t; j;[D PAGE 1 OF 2 - ORDER NO. 95-073 (6/28/95) t�;�;,0r;..IAED J U L 1995 i9`. Returned or dishonored checks will be prosecuted to the full extent of the law. This auction shall be continuous from and after the above sale date until closed by the Board of County Commissioners. Written offers to purchase any parcel not sold on June 2, 1995, shall be received by me in my offices through the following Wednesday, June 7, 1995, at 4:00 p.m. and shall be opened at 4:15 p.m. that day. The highest offer for any parcel which is equal to or exceeds the minimum bid price shall be conditionally accepted. Upon acceptance of such offer, the sale as to that parcel shall be deemed closed. Written offers must be accompanied by a cashier's check payable to Deschutes County and must include the complete name and mailing address of the bidder. Offers may be made through a licensed real estate agent. The County shall pay a five percent (5%) real estate commission to licensed real estate agents who appear at the sale on behalf of a client whose bid is accepted by the Board of County Commissioners. Commissions shall not be paid to realtors representing themselves or any entity in which they have a financial interest. Realtors who wish to appear at the auction on behalf of a client and therein be eligible for a real estate commission shall register on May 29 and 30, 1995, at the Property Management Office, 1340 N.W. Wall Street, Bend, Oregon and provide a photocopy of their current real estate license to County personnel. Commissions will not be paid unless the realtor pre -registers and provides the required documentation at the time of registration. All parcels are sold as is. Potential bidders should thoroughly investigate all aspects of a property prior to bidding. Deschutes County does not guarantee or warrant that any parcel is buildable, suitable for septic system, has legal access, is vacant or is usable for any particular purpose. The County shall not warrant or defend the fee simple title of real property offered for sale to be free of defects or encumbrances, but will only sell and convey such interest as the County acquired by foreclosure or other means and holds at the time of sale.
